H. B. No. 26, by Mr. Dickey, entitled "An Act to repeal Section 1 of Chapter LVI of the Penal Code of 1869 and Chapter XXXVI of the Session Laws of 1890, relating to the desertion of husband or wife."

REPORTS OF STANDING COMMITTEES.

Mr. Hihio presented a Minority Report from the Committee on Finance on the claim of Mr. H. M. Dow, for a reimbursement of $440.00, stating that there were not sufficient reasons given by the claimant to entitle him to such sums of moneys. Mr. Makekau moved that the Report, together with the Report of the Majority, be taken up for consideration. Carried.

Mr. Makekau moved that the House adjourn. Carried.

BILLS ON SECOND READING.

The following Bill was taken up for consideration on its second reading:

II. B. No. 2, by Mr. Dickey, entitled "An Act to appropriate an Emergency Fund to be used in repairing the damage caused by the late storm," upon report from the Committee on Public Lands and Internal Improvements, recommending the following amendments:

By striking out the words "Thirty thousand dollars" in Section 1, line 2 thereof, and inserting the words "Twenty-five thousand dollars" in lieu thereof; by inserting in Section 2, and line 3 thereof, after the words "deem necessary for the purpose mentioned," the following words: "Hawaii---Hilo, $2,500; Hamakua, $2,500; North Kohala, $1,000, and other districts on the Island of Hawaii, $2,000. Maui---Makawao, $6,000; Wailuku Mountain Road to Lahaina, $3,000; Hana, $2,000; Lahaina, $1,000. Kauai, $4,000. Oahu---Waialua, Koolauloa and Koolaupoko, $1,000."

On motion of Mr. Makekau, the report was adopted. Mr. Dickey moved that $10,000 be inserted in place of $6,000 for Makawao, and that $1,000 for Molokai be added. Lost. On motion of Mr. Robertson, H. B. No. 2 passed its second reading as amended. On motion of Mr. Gilfillan, the Bill was ordered typewritten and placed on the order of the day for March 9th.

REPORTS OF STANDING COMMITTEES.

The following report of Standing Committee was presented: On H. B. No. 9, by Mr. Kaniho, entitled "An Act to repeal Section 922, 925, and the second paragraph of Section 924, Part V, Chapter 59, of the Penal Laws as compiled in 1897, relating to vaccination," from Mr. Beckley, Chairman of the Committee

on Public Health and Education, recommending that Bill should be immediately passed at this session. On motion of Mr. Makekau, the report was laid upon the table, to be considered with the Bill.

On motion of Mr. Beckley, the House thereupon stood in recess until 2 o'clock p. m.

The following report of Standing Committee was presented: On H. B. No. 11, by Mr. Kaniho, entitled "An Act to abolish personal taxes and to repeal Sections 806, 807 and 809 of the Civil Code, relating thereto," from Mr. Emmeluth, Chairman of the Committee on Finance, recommending that as the Bill relates to matters of revenue, it should be referred to the Select Joint Committee on Taxation for consideration and report. On motion of Mr. Dickey, the report was adopted.

On H. B. No. 12, by Mr. Haaheo, entitled "An Act to repeal Section 861 of the Civil Laws of 1897," from Mr. Emmeluth, Chairman of the Committee on Finance, recommending that, as the Bill relates to matters of revenue, it should be referred to the Select Joint Committee on Taxation for consideration and report. On motion of Mr. Dickey, the report was adopted.

The following Bills, notice of which had previously been given, were introduced, read by title, passed first reading, and were ordered printed:

H. B. No. 40, by Mr. Hoogs, entitled "An Act to prevent the employment of minors in places where intoxicating liquors are sold, and to prevent minors from visiting such places."

H. B. No. 41, by Mr. Makainai, entitled "An Act providing for names and numbers of streets, roads and lanes in the District of Honolulu, Island of Oahu."

H. B. No. 42, by Mr. Makainai, entitled "An Act providing for the numbering of buildings and lots in the District of Honolulu, Island of Oahu."

H. B. No. 43, by Mr. Monsarrat, entitled "An Act giving the right of appeal to any person adjudged in contempt by any Circuit Court or by Judge of any Circuit Court, or by any Disrict Magistrate, or by any officer or person authorized by the laws of said Territory to take testimony, in the Territory of Hawaii, from such decision to the Supreme Court of said Territory; and prescribing the procedure governing the same, and providing for bail in such appeals."

Notice was given of intention to introduce the following

RESOLUTIONS.

The following Resolutions were introduced:

H. R. No. 11, by Mr. Nailima:

Be It Resolved, that the Clerk of the House be instructed to forward the requisite communications to the Agent of Public Lands, whereby the said Agent of Public Lands may furnish this House all land transactions made by him from 1890 to present date, and to furnish the names of all persons who are connected with such transactions.

Being seconded by Mr. Dickey, the Resolution was adopted.
II. R. No. 12, by Mr. Kekaula:

Be It Resolved, that by this the Clerk of the House is hereby requested to forward the following questions to the Superintendent of Public Works, and the said questions to be answered within four days: In the Session of 1898 it was inserted in the Appropriation Bill---first, an item of $800 to lengthen the wharf at Hookena; second, an item of $200 for a warehouse at Hookena. Why was not the work accomplished?

On motion of Mr. Dickey, the Resolution was adopted.

A Resolution by Mr. Ahulii as follows:

Be It Resolved by the Legislature of the Territory of Hawaii, that an appropriation of $30,000 be inserted in the Appropriation Bill for road from Kipahulu to Mokulau, in the District of Hana, Island of Maui.

On motion of Mr. Mahoe, consideration of the Resolution was postponed, to be taken up with the Appropriation Bill.

BILLS ON THIRD READING.

The following Bill was taken up for consideration on its third reading:

H. B. No. 3, by Mr. Robertson, entitled "An Act relating to the jurisdiction of Circuit Judges at Chambers in matters concerning the relation of guardian and ward; and amending Section 1367 of the Civil Code and Section 38 of Chapter 57 of the Session Laws of 1892 as amended by Act 56 of the Session Laws of 1898." On motion of Mr. Robertson, the Bill was amended by striking out in Section 1, and lines 5 and 6 thereof, the words "of the Circuit Court of the First Circuit," by inserting in line 5 thereof the word "Circuit" between the words "any" and "Judge"; by striking out in Section 2, and line 15 thereof, the words "the First" and inserting the word "any" in lieu thereof.
