On motion of Mr. Prosser, and by unanimous consent, the rule was suspended, and said bill referred back to the committee, with power to report complete.

Mr. Prosser, from the committee on manufactures, to which was referred the Assembly bill entitled "An act to continue the charter of the Oneida Manufacturing Society," reported in favor of the passage of the sanie.

On motion of Mr. Hubbell, and by unanimous consent, the rule was suspended, and said bill referred back to the committee, to report complete.

Mr. Prosser moved to take from the table the Assembly bill entitled "An act to amend an act entitled 'An act to authorize the city of Buffalo to loan its bonds to the Buffalo and Pittsburgh Railroad company,' passed April 15, 1858."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to the report of the committee, and it was decided in the affir-、 mative.

Ordered, That said bill be read a third time.

Mr. Paterson, from the committee on claims, to which was referred the Assembly bill entitled "An act for the relief of Melissa P. Lewis, for canal damages," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Paterson, from the committee on claims, to which was recommitted the Assembly bill entitled "An act to stay proceedings in relation to claims and awards for the diversion of water from the Black river, for the Erie and Black river canals," reported the same to the Senate, for its consideration, which report was agreed to, and said bill committed to the committee of the whole.

The hour of two o'clock having arrived, the Senate took a recess until four o'clock.

The Senate again met.

Mr. Noxon, from the select committee of eight, reported the following bills as proper to be referred to the standing committees reporting them, with power to report complete; being the Assembly bills entitled as follows:

"An act empowering the boards of supervisors in the respective counties of this State, to fix and determine the compensation to be allowed for the conveyance of juvenile delinquents to houses of refuge, and insane criminals to insane asylums."

"An act to amend the Revised Statutes in relation to laying out public roads and the alteration thereof, in the towns of North Castle and Lewisboro, in the county of Westchester."

"An act to authorize the appraisal and payment of damages to Adam Dominick and others."

"An act to amend an act entitled 'An act to incorporate the village of Clyde, in the county of Wayne,' passed May 2, 1835."

"An act authorizing the Hempstead and Jamaica Plankroad company to collect increased tolls, upon certain conditions."

"An act to amend the act incorporating the village of Sing Sing, in the county of Westchester, passed April 9th, 1853, and the acts supplementary thereto, and amendatory thereof."

"An act to amend an act entitled "An act in relation to dividends to stockholders of Academies and other institutions of learning, and the distribution of the public funds to the same,' passed April 15, 1857."

The President put the question whether the Senate would agree to the report of said committee, except the last named bill, and it was decided in the affirmative.

On motion of Mr. Noxon, the said last named bill was laid on the table.

The bill entitled "An act for the relief of the Ausable Plankroad company," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the special order, being the Assembly bill entitled as follows:

"An act to authorize increased compensation to the contractors on section number 207 of the Erie canal enlargement."

And after some time spent therein, Mr. Scott, from said committee, reported in favor of the passage of said bill, with amendments. Mr. W. A. Wheeler renewed the motion made in committee of the whole, to strike out the enacting clause of said bill.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative, as follows:
