The President then put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

On motion of Mr. Loveland,

Resolved, That the committee on public buildings, to whom was referred the bill in relation to the enlargement of Clinton Prison, be discharged from the further consideration of the same, and that the same be referred to the standing committee on State prisons.

On motion of Mr. Boardman,

Resolved, That the Clerk be directed to furnish each of the pages of the Senate, with a copy of the Red Book, the same as at previous sessions.

On motion of Mr. Halsted, and by unanimous consent, so much of the rules were suspended prohibiting bills being ordered to a third reading without being acted upon in committee of the whole, so that the bill entitled "An act to revise the charter of the village of Binghamton," may be referred to a select committee, consisting of Messrs. Truman and Boardman, with power to report complete.

Mr. Scott moved to take from the table the motion to non-concur in the amendments made by the Assembly, to the bill entitled “An act to enable agricultural and horticultural societies to extend a more perfect protection to their property and the property of exhibitors at fairs, and to allow the board of managers to appoint a police for that purpose."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to non-concur in said amendments, and it was decided in the affirmative.

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have non-concurred in their amendments..

On motion of Mr. John D. Willard,

Resolved, That hereafter the hour of meeting of the Senate on Tuesday and Thursday evenings, for the consideration of general orders, be 7 o'clock.

Mr. Brandreth moved to reconsider the vote just taken, on passing the resolution.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to said resolution, and it was decided in the negative.

On motion of Mr. Mather,

Resolved, That the Clerk of the Senate be and hereby is authorized to furnish to each of the reporters, one copy of the Red Book or Manual.

Mr. Spinola offered the following resolution :

Resolved, That there be printed 2,000 extra copies of the last annual report of the State Treasurer; 1,000 for that officer, and 1,000 for the use of the Senate.

Ordered, That said resolution be referred to the committee on public printing.

The hour of 12 o'clock, having arrived, the President announced the special order, being the resolution offered by Mr. Schell, relative to the purchase of Cuba, and the amendment offered thereto by Mr. Diven.

On motion of Mr. Paterson, the resolutions were made the special order for Friday, the 25th inst., at 12 o'clock.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to extend the time for the collection of taxes in the county of Herkimer."

"An act to authorize the Troy and Boston Railroad Company to erect a freight depot and construct a track in the City of Troy." "An act to extend the term of service of supervisors."

And after some time spent thereon, Mr. Ames from said committee, reported in favor of the passage of said first and second mentioned bills, with amendments, which report was agreed to, and said bills ordered engrossed for a third reading.

Mr. Ames, from said committee, reported progress on said third mentioned bill, and asked and obtained leave to sit again.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

Assembly bill, “An act to incorporate the Hahneman Medical College."

Assembly bill, "An act to amend an act entitled 'An act for the prevention of frauds upon the canal revenues,' passed April 14, 1855,"

"An act to amend the eighth title, of chapter eight, of part third of the Revised Statutes, entitled 'Of proceedings for the collection of demands against ships and vessels.""

And after some time spent therein, Mr. Darling, from said committee, reported progress on said bills, and asked and obtained leave to sit again.

On motion of Mr. Paterson,

The Senate adjourned to half-past seven o'clock, P. M.

HALF-PAST SEVEN O'CLOCK, P. M.,

The Senate again met.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to authorize the incorporation of Juvenile Reformatory Asylums."

"An act making appropriations for the canal debt, and the maintenance of the canals, for the fiscal year commencing on the first day of October, 1859, and to supply a deficiency in a former appropriation."

Assembly bill, "An act relating to the term of office of the county treasurer of the county of Monroe."

And after some time spent therein, Mr. Halsted, from said committee, reported in favor of the passage of said first mentioned bill, which report was agreed to, and said bill ordered engrossed for a third reading.

Mr. Halsted, from said committee, reported progress on said second and third mentioned bills, and asked and obtained leave to sit again.

A message was received from the Governor, through his private secretary, in the words following:

ALBANY, Feb. 17, 1859.

To the Senate:-I approved the bills bearing the following titles, at the dates respectively named:

Feb. 12. "An act to change the name of Margaret Skivington, to Winnie Alida Ostrander."

"An act to amend an act entitled 'An act to revise, amend and consolidate the several acts relating to the village of Whitesboro'.'

15. "An act authorizing the Baptist Society of Sweden and Bergen, to sell their parsonage."

"An act to provide for the appointment of commissioners of deeds in the village of Ballston Spa."

16. “An act to authorize the Common Council of the City of Hudson to fund the floating debt of said city, and for other purposes."

"An act to authorize the Rochester Bank to reduce its capital stock."

Assembly bill, "An act authorizing persons convicted before magistrates or courts of special sessions of the peace, in the town of Waterford, in the county of Saratoga, and sentenced to imprisonment in the county jail at hard labor, to be transported directly to the Albany Penitentiary:"

Assembly bill, "An act to appropriate the proceeds of the State tax for the support of schools."

"An act to provide for the performance of certain duties imposed upon a Canal Commissioner in cases where he may be disqualified from acting."

And after some time spent therein, Mr. John D. Willard, from said committee, reported in favor of the passage of said first and second mentioned bills, which report was agreed to, and said bills ordered to a third reading.

Mr. John D. Willard, from said committee, reported progress on said third mentioned bill, and asked and obtained leave to sit again. The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to amend an act passed February 17th, 1857, entitled 'An act to enable Peter Cooper to found a Scientific Institution in the City of New York;"" and also to amend the act passed March 21st, 1857, entitled "An act to amend the act entitled 'An act to enable Peter Cooper to found a Scientific Institution in the City of New York,' passed February 17th, 1857.”

"An act to amend chapter 458, of the Laws of 1857, entitled 'An act to authorize the payment of money to Geo. Guenther, for work done on the Erie canal.'”

"An act in relation to the town Insurance Company of the town of Brunswick."

And after some time spent therein, Mr. Loveland, from said committee, reported progress on said first mentioned bill, and asked leave to sit again.

On motion of Mr. Ely, and by unanimous consent, the committee of the whole were discharged from the further consideration of said bill, and it was.referred to the committee on the incorporation of cities and villages, with power to report complete.

Mr. Loveland, from said committee, reported in favor of the passage of said second and third mentioned bills, which report was agreed to, and said bills ordered engrossed for a third reading.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to amend the act entitled 'An act to prevent the issue of false receipts, and to punish fraudulent transfers of property by warehousemen, wharfingers and others,' passed April 17th, 1858."

Assembly bill, "An act to authorize the Board of Directors of the Sennett and Auburn Plankroad Company, to assess the stockholders of said company for the payment of the debts thereof, and to make the same into a gravel road."

"An act for the relief of James A. Storey, Caleb M. Pierce and Charles Amsden."

And after some time spent therein, Mr. Laflin, from said committee, reported in favor of the passage of said bills, which report was agreed to, and said bills ordered engrossed for a third reading.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

Assembly bill, "An act to incorporate the Oswego City Savings Bank, in the City of Oswego."

“An act in relation to the village of Whitehall."

"An act to consolidate and amend the several acts relating to the village of Cazenovia, to alter the bounds and to enlarge the powers of the corporation of said village."

And after some time spent therein, Mr. Paterson, from said committee, reported in favor of the passage of said first and second mentioned bills, with amendments, which report was agreed to, and said bills ordered engrossed for a third reading.

'Mr. Paterson, from said committee, reported progress on said third mentioned bill, and asked leave to sit again.

On motion of Mr. Foote, and by unanimous consent, the rules were suspended, and said bill was ordered recommitted to the committee on the incorporation of cities and villages, to report complete.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

66 'An act to amend an act entitled 'An act to amend an act to establish regulations for the port of New York,' passed April 15, 1858."

"An act to repeal chapter 626, of the Laws of 1853, and chapter 495, of the Laws of 1855, so far as applicable to the village of Hamilton, and to amend section 1, of chapter 129, of the Laws of 1854."

"An act to incorporate the Philomathian Society for mutual improvement, in the village of Sherburne, in the county of Chenango."

And after some time spent therein, Mr. Prosser, from said committee, reported progress on said first mentioned bill, and asked and obtained leave to sit again.

On motion of Mr. Ely, said bill was ordered printed as amended. Mr. Prosser, from said committee, reported in favor of the passage of said second mentioned bill, which report was agreed to, and said bill ordered engrossed for a third reading.

Mr. Prosser, from said committee, reported in favor of the passage of said third mentioned bill.

Mr. Truman moved to recommit said bill to the committee on literature.

Mr. Paterson moved to lay that motion on the table.

The President put the question whether the Senate would agree to the said motion of Mr. Paterson, and it was decided in the affirmative.

The Assembly returned the resolution for adjournment, with a message that they had concurred in the passage of the same, with the following amendments: Strike out "Thursday evening, 17th," and insert "Friday, 18th;" also, strike out "Thursday evening, 24th," and insert "Wednesday evening, 23d."

Mr. Halsted moved that the Senate concur in the amendments. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

On motion of Mr. Spinola, the Senate adjourned.
