Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the Assembly bill entitled "An act to amend an act authorizing the election of a police justice in the village of Peekskill, and for other purposes," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the Assembly bill entitled "An act to authorize the trustees of the village of Newburgh, to open North street, and to assess and collect the damages and expenses for laying out, opening and grading said street," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the petition of trustees of the village of Cazenovia, for the passage of an act to consolidate and amend, &c., reported a bill entitled "An act to consolidate, amend the several acts relating to the village of Cazenovia, to alter the bounds and to enlarge the powers of the corporation of said village," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

A message from the Assembly was received and read informing that they had concurred in the amendments of the Senate to the bill entitled as follows:

“An act in relation to the Oneida county poor house.”

Ordered, That the Clerk return said bill to the Assembly.

In pursuance of previous notice, Mr. Halsted asked and obtained leave to introduce a bill entitled "An act in relation to embezzlement by public officers," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

In pursuance of previous notice, Mr. Diyen asked and obtained leave to introduce a bill entitled "An act to prevent the unnecessary expenditure of money on the Chemung canal," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on canals.

The Senate then resolved itself into a committee of the whole,

and proceeded to the consideration of the general orders, being the bills entitled as follows:

"An act to increase the powers and duties of public administrators."

"An act to relieve Peter Lorillard and John David Wolfe from an excessive tax, and to provide for the settlement of their claims against the county and town of Westchester."

"An act for the relief of the receiver of the Farmers' Insurance Company of Oneida county."

And after some time spent therein, Mr. Smith, from said committee, reported progress on said first and second mentioned bills, and asked and obtained leave to sit again.

Mr. Smith, from said committee, reported that they had stricken out the enacting clause of said third mentioned bill.

Mr. Hubbell moved the question on agreeing to the report of the committee of the whole, be laid on the table.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative, as follows:

"An act to confirm the proceedings of the board of supervisors of the county of Franklin, in the erection of the town of Brighton, in said county."

"An act exempting the firemen of the village of Malone, in the county of Franklin, from serving on juries and in the militia, and from poll taxes."

"An act to make valid the proceedings had before Edgar A. Keeler, as a justice of the peace of the town of Chateaugay, in the county of Franklin."

And after some time spent therein, Mr. O. B. Wheeler, from said committee, reported in favor of the passage of said bills, which report was agreed to, and said bills ordered engrossed for a third reading.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of the general orders, being the bills entitled as follows:

Assembly bill, "An act authorizing the Baptist Society of Sweden and Bergen to sell their parsonagǝ."

"An act to amend an act entitled 'An act to incorporate the

Genesee Camp Ground Association, passed April 6th, 1857,' being chapter 252, of the Session Laws of 1857."

"An act to incorporate the Fire Department of the village of Elmira."

And after some time spent therein, Mr. Pratt, from said committee, reported in favor of the passage of said bills, which report was agreed to, and said bills ordered engrossed for a third readieg. On motion of Mr. Halsted, the Senate adjourned.

TUESDAY, FEBRUARY 8, 1859.

The Senate met pursuant to adjournment. Prayer by the Rev. Mr. Miller.

The journals of Saturday and Monday were read and approved. Mr. Hubbell presented a petition of the Common Council of the city of Utica, for an amendment to their city charter, which was read and referred to the committee on the incorporation of cities and villages.

Mr. Ames presented two remonstrances against the increase of the number of justices of the peace in the city of Oswego, which were read and referred to the committee on the incorporation of cities and villages.

Mr. Pratt, from the committee on engrossed bills, reported as correctly engrossed, the bills entitled as follows:

"An act to confirm the proceedings of the board of supervisors of the county of Franklin, in the erection of the town of Brighton, in said county."

"An act to make valid the proceedings before Edgar A. Keeler, a justice of the peace of the town of Chateaugay, in the county of Franklin."

"An act exempting the firemen of Malone, in the county of Franklin, from serving on juries and in the militia, and from poll taxes.” "An act to amend chap. 522, of the Laws of 1857, entitled 'An act to incorporate the Genesee Camp Ground Association.""

Mr. Loveland, from the committee on public printing, to whom was referred the bill entitled "An act to amend chap. 280, of the Laws of 1845, entitled 'An act for the publication of the Session Laws, &c.," reported adversely to the passage of said bill, which report was agreed to.

Mr. Halsted, from the committee on the incorporation of cities and villages, to which was referred the bill entitled "An act in relation to the village of Whitehall," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Loveland, from the committee on public printing, to whom was referred the resolution to print extra copies of the annual report of the Comptroller on Insurance Companies, reported the following resolution:

Resolved, That there be printed ten extra copies for each member and officer of the Senate, of the annual report of the Comptroller on Insurance Companies.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Halsted, from the committee on the incorporation of cities and villages, to ..hich was referred the petition of citizens of the village of Hamilton, for an act to repeal chapter 626, &c., reported a bill entitled "An act to repeal chapter 626, of the Laws of 1853, and chap. 495, of the Laws of 1855, so far as applicable to the village of Hamilton, and to amend section 1, of chap. 129, of the Laws of 1854," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Truman, from the committee on charitable and religious societies, to which was referred the Assembly bill, entitled "An act changing the name of the ministers, elders and deacons of the Protestant Reformed Dutch Church, of Duanesburgh, to the First Presbyterian church, of Duanesburgh," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Laflin, from the committee on literature, to which was referred the petition of citizens of Sherburne village, for the incorporation of the Philomathian Society, in said village, reported a bill entitled "An act to incorporate the Philomathian Society for mutual improvement in the village of Sherburne, in the county of Chenango," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Prosser, from the committee on canals, to which was referred the petition of Squire Whipple for compensation for the use of his patent truss bridge, reported, for the consideration of the Senate, a bill entitled "An act to authorize the Canal Board to examine and determine the claim of Squire Whipple for the use of his iron truss bridge, upon the State canals," which was read the first time, and by unanimous consent was also read the second time, and commit ted to the committee of the whole.

A message from the Assembly was received and read, requesting the concurrence of the Senate to the following entitled bills :

"An act to provide for the payment to John A. King, the amount paid by him for the troops stationed at Quarantine, Staten Island," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

"An act to authorize the stockholders of the Buffalo City Bank, to reduce the capital stock of the said bank," which was read the

first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

"An act to incorporate the Board of Domestic Missions of the Second Reformed Protestant Dutch Church, of Tarrytown, New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

Mr. Ames gave notice that he would, at an early day, ask leave to introduce a bill, entitled "An act to authorize the town of Oswego to raise money for the purchase of lands and the erection of buildings thereon, for the support of the poor in said town."

Mr. Laflin gave notice that he would, at an early day, ask leave to introduce a bill entitled "An act to amend the charter of the village of Herkimer;" also, a bill entitled "An act to extend the time for the collection of taxes in the county of Herkimer."

Mr. W. A. Wheeler gave notice that he would at an early day ask leave to introduce a bill, entitled "An act enlarging the powers of the Board of Education, in the village of Ogdensburgh."

In pursuance of previous notice, Mr. Scott asked and obtained leave to introduce a bill entitled "An act in relation to the auditing of accounts by the board of supervisors of the county of Montgomery, and the duties of certain officers of said county in connection therewith," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

By unanimous consent, Mr. Pratt asked and obtained leave to introduce a bill entitled "An act to extend to all of the counties in this State, the provisions of chap. 139, Laws of 1858, relative to the counties of Oneida and Montgomery," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties.

In pursuance of previous notice, Mr.W. A. Wheeler asked and obtained leave to introduce a bill entitled "An act to authorize the Potsdam and Watertown Railroad Company, to increase its rates of fare for the transportation of passengers," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

In pursuance of previous notice, Mr. Prosser asked and obtained leave to introduce a bill entitled "An act concerning the navigation. of the canals, and the collection of tolls," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on canals.

The bill, entitled "An act to amend an act entitled 'An act revising, amending and consolidating the several acts in relation to the village of Kingston,' passed April 10th, 1854," was read a third time

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:
