REGULATION OF WATER CARRIERS

COMMITTEE OF THE MERCHANT MARINE AND FISHERIES, Washington, D. C. The committee met at 10 a. m., Hon. Schuyler O. Bland (chairman) presiding.

The CHAIRMAN. On March 15 and 16, 1937, the committee held hearings on H. R. 3615, a bill to amend the Interstate Commerce Act, as amended, by providing for the regulation of the transportation of passengers and property by water carriers operating in interstate and foreign commerce, and for other purposes. In the report of the Interstate Commerce Commission, submitted at those hearings by Mr. Joseph B. Eastman, as chairman of the legislative committee of the Commission, it was suggested that all provisions with reference to the regulation of wharfingers be deleted from H. R. 3615 and incorporated in a separate bill with a view to individual consideration of the regulation proposed for water carriers and for wharfingers. The bill H. R. 5527 was accordingly introduced and incorporates the provisions for regulation of wharfingers as proposed by the Commission. Separate consideration will be given this measure apart from these hearings.

In the transfer of jurisdiction over water carriers engaged in foreign commerce from the United States Maritime Commission to the Interstate Commerce Commission, as proposed by previous bills, certain modifications were proposed in the authority now granted to the Maritime Commission. The report of the Interstate Commerce Commission suggested that no change in existing authority should be made at this time, but rather that a transfer of existing jurisdiction, in precisely its present form, should be made.

These and other changes were set out during the previous hearings in what was known as a committee print of S. 1400; however, witnesses at these hearings stated that they had had no opportunity to study the changes proposed and requested additional time within which to ascertain the views of the organizations in whose behalf they spoke. For this reason, H. R. 5719, incorporating the exact provisions of the committee print of S. 1400, was introduced and the consideration of this measure by public hearings was postponed to the present time. H. R. 5719 will be incorporated in the record at this point:
