The said commissioners shall render to the board of supervisors of Oneida county, at their annual meeting in the year one thousand eight hundred and fifty-three, an account of all moneys received, and all disbursements made in pursuance of this act, with the vouchers therefor; the accounts of such commissioner for his services, as provided by the third section of this act, shall be audited and paid by the board of supervisors of said county, at their annual meeting in the year one thousand eight hundred and fiftythree, in the same manner as other county charges are audited and paid.

$5. The sheriff of the county of Oneida is hereby authorized and required to take possession of the court-house named in this act, but is in no way to interfere with any contract heretofore or hereafter to be made for the completion and furnishing of the same.

AN ACT to amend an act entitled, "An act to incorporate the Syracuse City Water-Works Company," passed April 5, 1849.

Passed March 22, 1853.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

S1. It shall be lawful for the Syracuse City Water-Works Company to increase their capital stock from sixty thousand dollars to such amount as shall, in the judgment of the board of directors, be advisable, not exceeding one hundred and fifty thousand dollars, and such increase may be made from time to time as shall be deemed expedient.

S2. Such increased stocks shall be divided into shares of fifty dollars each, and shall be allotted to those persons who shall be shareholders at the time of such increase, in the ratio as nearly as may be of the shares held by them respectively, and if any of such shareholders shall decline to subscribe for such new shares, such shares may be taken by the other shareholders, or may be sold under the direction of the board. The instalments on such new shares may be called for in the manner provided by the original act, and may be collected, or the stock may be forfeited as therein prescribed.

$3. The powers conferred by the eighth, ninth, tenth, future exten- eleventh, twelfth and thirteenth sections of the original charlargement of ter, shall apply to any future extension or enlargement of the works of the said company, and they shall be subject, in reference thereto, to the restrictions contained in the original charter, except so far as the same have been modified by an act of the Legislature amending said charter, passed April eighth, one thousand eight hundred and fifty-one.

AN ACT to provide for certain expenses chargeable upon the canal fund.

Chap. 37.

AN ACT to authorize the Fredonia and Sinclearville Plank-Road Company to borrow money.

Passed March 22, 1853, three-fifths being present.

The People of the State of New York represented in Senate and Assembly, do enact as follows:

1. The Fredonia and Sinclearville Plank-Road Company is hereby authorized to borrow a sum of money, not to exceed ten thousand dollars, on the credit of said company, to be expended in the finishing the road belonging to said company, and paying contracts already made by said company.

$2. The secretary of said plank-road company is hereby authorized to give his official bond or bonds for an amount in the aggregate not exceeding the sum of ten thousand dollars, bearing an interest not exceeding seven per cent per annum, and payable at such time and times as the board of directors may determine, by a resolution of Isaid board to be entered in their minutes.

$3. The debt that may be contracted under this act shall be a lien upon the said plank-road, until the same shall be paid in full; and in case a judgment or judgments shall be obtained upon said bond or bonds or any of them, and an execution issued, and sale had of the property of said company, it is hereby declared that the corporate rights and franchises now held by and belonging to said company shall, by virtue of such sale, pass to the purchaser or purchasers of such corporate property, and the said corporation shall not be thereby dissolved.

4. This act shall take effect immediately.

AN ACT to authorize the town of South Hempstead to sell a part of their common lands, and for other
