RULES

OF THE

COURT OF COMMON PLEAS.

JULY TERM, AT CASTINE, 1824.

ORDERED, That the following RULES and ORDERS be ordained and established as the Rules regulating the conducting of the business of this Court.

I.

Time of calling the Docket of continued actions-Order of trials by the Jury-New Entries-Postponing of actions.

At the commencement of each Term, after the Juries shall be empannelled, &c. the list of continued actions will be called, non-suits and defaults entered, and the actions for trial ascertained. After which all civil actions for trial by the Jury will be heard and tried in the order in which they stand on the docket without delay. When the actions for trial by the Jury on the continued list are disposed of, or at some convenient time, the New Entries will be called, non-suits and defaults entered, and actions for trial ascertained, which will then be heard and tried in their order in the same manner as the continued actions. But the Court may, on proof that a party in an action is not ready, by reason of inevitable accident, and by consent of the adverse party, postpone such action; in which case it shall be transferred to the end of the old or new
