osts in this action of ejectment.-Pollock, Q. C. and M. White, in support of the rule, maintained that the C. L. P. A. 852, sect. 174, had altered the old practice as to the liaility of each defendant for all the costs of the plaintiff. Cur. ade. vult.

HANSON V. ROYDEN.-A rule nisi had been granted, in ursuance of leave reserved by the late Assessor of the iverpool Court of Passage.-Potter now showed cause for he deft, on the ground that a mariner cannot claim reauneration beyond what was provided by the articles, rhatever duties he may undertake.-C. Russell supported he rule, and maintained that under the circumstances of his case a right of action for extra pay existed in the laintiff, who was shipped as an able seaman, and was ppointed second mate to supply a death vacancy.

Rule absolute. VICKERS. DUBLIN TRUNK CONNECTING RAILWAY.-The COURT granted rules nisi upon amended affidavits in those cases applied for by Holl on Nov. 8.

DIXON v. WILSON.-Holker moved on behalf of the deendant for a prohibition to restrain an attachment from ssuing from the Lord Mayor's Court against the garishee in this case. Rule refused.

Re MARY PARKS.-Henry James moved for leave to disbense with a husband's consent to a devise of freeholds inder the Fines and Recoveries Act. As, however, the Affidavit failed to show that the applicant received no ncome from her husband, and also that she had made iny inquiries about him since 1861, when he left her, the COURT postponed the application in order to amend the iffidavit.

SPECIAL PAPER.

THE ENGLISH AND FOREIGN CREDIT COMPANY (LIMITED) 2. ARDESIN AND OTHERS.-This was a special case.-Mellish, Q. C. (with Littler) for the plaintiffs; and J. Browne, Q. C. (with . White) for the defendants.

Stands over to be amended. SINGER. THE GREAT EASTERN RAILWAY COMPANY. — No counsel appeared on either side, and the case was accordingly Struck out. MARTIN V. THE GREAT INDIAN PENINSULAR RAILWAY COMPANY. The plaintiff in this action was an officer in the travelling with his regiment upon the defendants' line army, of railway from Budnairah to Bombay, and in the course of the journey the baggage, including plaintiff's personal luggage, was burnt. Plaintiff sued the company for damages, the first count of the declaration charging them, as common carriers, for not safely carrying the plaintiff's luggage; and the second count alleging that they had been guilty of gross negligence. The defendants pleaded several pleas, raising the following defences: first, that plaintiff and his luggage were carried under a contract with the Government, by which defendants were freed from all liability with respect to the luggage: secondly, that the loss was caused by the mutinous conduct of the troops under the command of the plaintiff and other officers; thirdly, that the contract under which the plaintiff and his luggage were carried was a contract with the Government only, and not with the plaintiff, and that their liability, if at all, was to the Government and not to the plaintiff. The plaintiff's replication set out the alleged contract in totidem verbis, by which it appeared that, in the case of troops travelling by rail, the baggage was to remain in charge of a guard of soldiers, the company accepting no responsibility." There were cross-demurrers to the pleas, and also to the replication, which now came on to be argued by Keane, Q.C. (with Lumley Smith) for the plaintiff, in support of the demurrer to the plens, and by M. White, contra, for the defendants, in support of the demurrers to the replications.-The COURT, after argument, were of opinion that the contract set out in the replication did not free the defendants from responsibility in respect of loss occurring from their own negligence, but that the plea setting up the mutinous acts of the troops was substantially an informal traverse of their own negligence. On the whole the Court gave

Judgment for the plaintiff on the demurrers to the replica tions and to the 11th plea, and judment for the defendants on the demurrers to the 6th, 9th, and 10th pleas. STILLARD. HINGLEY.-This was a demurrer to pleas and to replication.-Gray, Q.C. (with Macnamara) argued for the plaintiff and Mellish, Q.C. (with whom was II. Matthews) for the defendant: (Blackett v. Bradley, 1 B. & S. 940; 5 L. T. Rep. N. S. 832; and Bateson v. Green, 5 T. R. 411 were cited. Judgment for plaintiff on plea 5, and for defendant on replication to pleas 6 and 7.

RE THE TITHE COMMUTATION ACT AND THE REV. HAILSHAM-Manisty, QC. (with him H. Tindal Atkinson) moved, on behalf of the owners of certain lands in Lazenby, Cumberland, to set aside a writ of hab. fac. pos, issued under the Act in default of a sufficient distress for tithes. The Act enables the titheowner, in default of sufficient distress being found on the land to satisfy his tithe rentcharge, to obtain possession of the land itself. In this case a crop of growing grass was upon the land, which the titheowner had not distrained, and alleged to be insufficient to satisfy the amount due. The landowners disputed its insufficiency, and contended that the titheowner was bound to distrain, and realise the value of the distress, and so ascertain that it was, in fact, insufficient, before he could obtain possession of the land itself under the Act. It was secondly contended, on the part of the landowners that, no demand of the exact amount due having been made, the titheowner had no right to have the writ issued; and, thirdly, that the writ could not legally be issued until the titheowner had distrained upon all other lands in the occupation of the same tenant within the parish for the amount due.-The COURT granted a rule on all points. Rule nisi.

THE UNION BANK OF MANCHESTER (Limited) r. WILLIAM ABRAHAMS.- Baylis applied to set aside the judgment signed

in this action against the defendant, and also to set aside the service of the writ and order upon which it was made, or that the defendant should be allowed to come in and defend the action. The defendant, it appeared, was a person of weak mind, deaf and dumb, and quite incapable of understanding business matters, and the action was upon two promissory notes given to secure the banking account of his brother John, who had died in difficulties, and with whom he had lived previously to his death. Upon the death of his brother the defendant had gons to live with another brother, named Robert. The process server had endeavoured to serve the writ at the house where defendant had lived with his deceased brother, but not being able to effect personal service, an order at Chambers had been obtained for service at defendant's residence within three days. This, too, was served at the same place, and the proceedings had never come to the knowledge of defendant or his attorney, or his brother.-The COURT granted a rule.

RE ROBINSON-Field, Q.C. (with him Shepherd), moved to set aside an order of Martin, B., referring an attorney's bill for taxation on the ground that more than twelve months had expired since its delivery, and that no special circumstances existed enabling the judges to refer it. Some of the items contained in the bill were, in the opinion of the COURT, prima facie, and, in the absence of special circumstances, excessive, and that that fact was sufficient to give the judge jurisdiction to order taxation, even after the twelve months. They therefore refused the rule. Rule refused.

SALAMAN. Howe.-This was an action tried before Martin, B. when the verdict was for the plaintiff.-M. Chambers, Q. C. now moved, pursuant to leave reserved, to enter it for the defendant, or to reduce the damages.-The COURT granted the rule as to the reduction of damages.

ALLAN . BUCKLEY.-This was an action, tried before Martin, B. on the 7th Nov., when the verdict was for the defendant.- Nasmith now moved for a new trial on the

ground that the verdict was against the evidence.-The COURT refused to grant a rule. Rule refused.

PLATT. HIGGINS. The hearing of the argument in this case was fixed for the second day of next term.

METCHIM V. THE SIDMOUTH RAILWAY AND HARBOUR COMPANY-WILLIAMS . THE SAME.-Barratt Jacques moved for rules calling upon certain shareholders in the defendant's company to show cause why writs of sci. fa. should not issue against them; in some cases the rules were to be absolute in the first instance by consent. Rules accordingly. WOODHOUSE. DICKER-Coleridge, Q.C. and Francis showed cause; C. Pollock, Q. C., H. James, and Merewether supported the rule for a new trial. The action was for maliciously, and without reasonable and probable cause, endorsing a writ of ca. sa. for a larger amount than was due, and causing the plaintiff to be arrested upon the writ for such amcunt.

PHILLIPS. THE METROPOLITAN RAILWAY COMPANY.

Atkinson, Serjt. and Thomas showed cause; and Garth,
Q. C. and Harrison supported the rule.-The CourT made
the rule absolute for a new trial.

FOX AND OTHERS . THE MIDLAND RAILWAY COMPANY. — Horace Lloyd (with him Lopes) showed cause; Field, Q. C. (with him Wills) supported the rules to enter a verdict for the defendant. The question turned upon the construction of a consignment note. Rule discharged.

Friday, Nov. 15.

NEW TRIAL PAPER. RYDER . WOMBWELL-This was an action by a jeweller, against the defendant, to recover the sum of 671, 16s. for goods supplied by the plaintiff to him, to which the defendant pleaded, except as to 67. 18., never indebted. The articles in question were a pair of crystal ruby and diamond solitaire wrist studs, 251.; a white glass union smellingbottle, silver gilt, corals, pearls, and turquoises, horse-shoe, 67. 10s; a silver-gilt antique goblet, 157, 158.; a pair of fine coral and engraved crossbar earrings, 18. 13s; gold studs, 67. 10% and repairs, 8. The jury found a verdict for the plaintiff for 407 158, being the amount of the solitaire wrist-studs and the goblet) in addition to the 67. IS. paid into court for the studs and repairs, leave being reserved to the defendant to move, in pursuance of which Bulwer, Q C. in this term obtained a rule to set aside the plaintiff's verdict, and to enter a nonsuit, or to reduce the damages by 254, or 15, 15s., or both these sums, or for a new trial on the ground that the Lord Chief Baron should have directed the jury that the goods were not "necossaries," and also for an improper rejection of evidence.-Coleridge, Q. C. and Pyke showed couse: Keane, Q C. and Mayi for

the defendant, supported their rule-The COURT (Kelly, C. B, Bramwell, Channell, and Pigott, BB) after a long argument, and many cases cited, reserved their judgment.

ROLPH r. CROUCH. This was an action to recover damages from the defendant under the following circumstances: The defendant had granted a lease to plaintiff of a piece of ground for seventeen years, and upon the plaintiff's taking possession of it, and building a conservatory thereon, one Cook had brought an action of trespass against him, alleging that the ground in question was in his (Cook's) occupation under a prior demise to him from the defendant, in which action the verdict was found for Cook, with 40s, damages. Plaintiff having paid the costs of that action, now sued the present defendant, and at the trial, before Kelly, C. B. and a special jury, at the sittings in London, after Trinity Term last, the jury found a verdict for the plaintiff for 2447. 118 Gd., calculated as follows, viz., Cook's costs in the action against plaintiff, 571. 11s. 6d. ; plaintiff's own costs therein (to be taxed), 70%; the costs of erecting and pulling down the conservatory, 15; and the value of the ground at 4. a year for seventeen years with the profit that plaintiff might have made of it in his trade as a florist, 1027. making in all, 2447. 11s. 6d. A rule nisi having been obtained in this term, on the part of the defendant, to reduce those damages to 1s. by striking off all the above sums, or to such other sum as the court might think fit, on the ground that such sums were not recoverable-Kenealy and Pearce Q. C. and Philbrick for the defendant, supported it, confor the plaintiff, now showed cause against, and Jones, tending that the damages were too remote, and drawing a distinction between the defendant's liability under a covenant for quiet enjoyment, and a covenant of indemnity as it should have been, to render him liable to defendant for the action of trespass by Cook.-The COURT, however, (Kelly, C. B., Brainwell, Channell, and Pigott, BB.) were of opinion that the jury had rightly found a verdict for the

various heads of damage, and discharged the defendant's rule accordingly. Rule discharged.

LEDGER . THE LONDON, CHATHAM, AND DOVER RAILWAY COMPANY. In this case, in which a rule was obtained by Sir G. Honyman, Q. C. on the 4th inst. for the defendants, to reduce the damages found for the plaintiff at the trial of the action before Bramwell, B., at the Guildhall, in July last, from 157. 14s. to 9. 178., on the ground that there was no evidence for the jury, the question being whether the circumstances under which the plaintiff's goods, which were being carried on the defendants' line of railway were lost, were or not evidence of a felony on the part of the servants of the company, Bramwell, B. having, at the trial, reserved leave to the defendants to move-M. White (with whom was Brett, Q. C.), for the plaintiff, now showed cause, citing The Great Northern Railway v. Rimmell, in the Ex. Ch., 18 C. B 575, and Metcalfe v. The London, Brighton, and South Coast Railway Company, 4 C. B., N. S., 307, and contending that the verdict was right; Sir G. Honyman contra for the defendants, to be heard on Tuesday.

SPECIAL PAPER. FERGUSON . THE WASHOE CONSOLIDATED GOLD AND SILVER MINING COMPANY (LIMITED).—This was an action by the plaintiff against the defendants for a breach of contract to allot to the plaintiff certain shares, and also to recover money lent, in which, at the trial at Guildhall, at the sittings after last Hilary Term, before Kelly, C. B., a verdict was found for the plaintiff for the amount court of Ex., upon a special case. The plaintiff had lent claimed by the declaration, subject to the opinion of the tion, dated 15th June 1864: "In consideration of A. or B. 5007. to the company, on the terms of the following resolumaking an advance of money for two months, to enable the company to continue their operations at the mine, it is agreed that the same shall at any time after the expiration of the said two months, on the application of the said A. or B., be repaid out of any funds of the company in hand, with interest at 61. per cent., with option to the said A. or B. either to receive the amount in money or to accept shares fully or partly paid up, or a deposit receipt of 1. per share on 500 shares, while the said advance or any part of it remains unpaid, at his, A. or B.'s discretion" Plaintiff advanced 500l. to defendants on the terms of this resolution, and now claimed to exercise his option in the mode of repayment, and sued the company as above mentioned, the question turning on the construction of the above-mentioned resolution; the defendants had pleaded payment -Hannen, for the plaintiff, contended that while plaintiff remained unpaid. he was plied for payment, defendants could not pay him off, and entitled to the exercise of the option, and that till he apthat a cheque which defendants had sent to him, but which he had at once refused and returned was neither payment nor equivalent to it. Had defendants pleaded an offer to pay, and a refusal by plaintiff to accept it, it might contra, for defendants, declined to accede to a suggestion have been a different matter.-Keane, Q. C. (with T. Salter) of the court to amend his plea, and elected to abide their decision on the case as the pleadings stood at present.-The COURT were of opinion that the plea was no answer to plaintiff's clain, and that while the plaintiff's debt remained unpaid he had the right of option, and therefore was entitled to judgment for 15001, being the amount of the 500 shares, with 27 premium on each of them, their market value on the 17th Nov.

Judgment for the plaintiff accordingly. CHADWICK T. HOLDSWORTH AND HOLDSWORTH . CHADWICK, -These were cross actions involving the construction of covenants on both the lessor's and the lessee's part, contained in a lease from Chadwick to Holdsworth in 1856 of a "Mill, factory, sheds, warehouse, and other mill buildings, together with steam-engines, boilers, gearings. shaftings, &c. in or upon the same premises," in each of which a special case had been stated by order of Nisi Prins, and the question turned upon whether the use by the lessee Holdsworth of certain boilers" used for steampower in the mill, and which the lessor, Chadwick, had used by the lessee in “a proper and workmanlike manner covenanted to replace when worn out, had or not been and according to the usual and ordinary speed" according Jones, Q. C.) for the lessor. Chadwick, in both cases, and to the terms of his covenant.-J. A. Russell (with him Holker (with him C. R. Fisher) for the lessee.-The COURT gave judgment for the defendant in each case.

Judgment for each defendant accordingly. JOHNSON r. LEITE AND ANOTHER.-Special case - Raising the question of the plaintiff's title to 400 bags of cotton shipped on board the ship Emily to which the defendant laid claim under forged hills of lading.-Brett, Q. C. (with him C. P. Butt) for plaintiff was stopped, and Cohen, for the defendants, was called on by the court, and urged that by the contract of sale to the defendants in Feb., which was prior to that to the plaintiff in April, and the forged bill of lading, the property in the goods passed to the defendants, citing in support of that proposition Blackbura on Contract of Sale, p. 126 and Gurney v. Behrens 3 E. & B 672-The Cornr, however, thought it was a accordingly. clear case in favour of the plaintiff, and gave judgment Judgment for the plaintiff.

ATTFIELD . THE LLANELLY DOCK COMPANY.-This case was called on but no one appearing on either side, it was struck out of the paper. No paper books having been Struck out.

WILLIAMS AND OTHERS v. Rose-This was a case of demurrer to a plea and to a replication, raising the question whether the certificate of the Court of Bankruptcy, under the hand of the deputy chief registrar of the court, of the due registration of a deed of composition, dated 23rd Oct. 1866, between a debtor and his creditor, within the meaning of sect. 198 of the B. A. 1861, was or was not a protection to the debtor from arrest, on a ca, sa, issned on a judgment obtained, and on a debt accrued due after the date of the said deed and certificate respectively, and whether or not the sheriff, on production of such certiflcate, was or was not bound at once to discharge the debtor from custody, and whether the sheriff was liable, in an action at the suit of the plaintiff, the creditor, for discharging the debtor on production of the certificate without further inquiry -H. James, for the plaintiff, contended that the sheriff acted at his own peril, and if wrong, as he was, he was liable.-Raymond, coutra, for the defendant, contended that the sheriff was bound, and had no option but to act on the certificate, and discharge the debtor at once: (Grace r. Bishop, 11 Ex. 424; Phillips v. Poland, 13 L. T. Rep. N. S. 712, C. P.; Lloyd v. Harrison, 14 L. T.

Rep. N. S. 799, Q. B., and Wallinger v. Gurney, 5 L. T. Rep. N. S. 311, were cited, and sets, 112 and 113 B. A. 1849, and sect. 498 of the B. A. 1861, were referred to.)-The COURT thought that the certificate was no protection from the arrest under the circumstances, and accordingly gave judgment for the plaintiff.

SMITH. MERCER-Action for goods sold and delivered to recover the price of fifty bales of cotton, in which the pleas were never indebted and payment, and a plea of satisfaction by a bill of exchange, and there was a demurrer to the plea.-C. Hutton for plaintiff. Adjourned. Tuesday, Nor. 19.

ASHBURNER v. TOOMER.-The COURT, which had taken time to consider in the case, now refused to grant a rule. Rule refused

SALAMAN r. HowE-In this case Montagu Chambers, Q.C. had obtained a rule nisi to reduce the damages-Murphy now moved that the case might be struck out of the new trial paper, on the ground that the defendant had died before the rule was obtained, and that his attorney hud no instructions from his executors. It was arranged that the matter should stand over for a month, and if within

that time the executors did not give instructions with respect to the matter, the rule should be deemed to be rescinded. To stand over accordingly.

LEDGER v. THE LONDON, CHATHAM, AND DOVER RAILWAY COMPANY.-Honyman, Q.C. and Watkin Williams now supported their rule.-This was an action against the defendants for the loss of certain jewellery contained in luggage which had been intrusted to their charge. The defendants had pleaded the Carriers Act, and the plaintiffs had replied that the loss was occasioned by the felony of the defendants' servants. The jury found in favour of the plaintiffs, and the question now was whether there was any evidence to be left to them of the replication.-The COURT thought that the evidence was as consistent with the felony having been committed by some other person, as with its having been committed by the company's servants, and therefore that there was no evidence which

should have been left to the jury, and that a nonsuit ought to have been directed. They therefore made the rule absolute. Rule absolute.

GUYON . THE FRONTINO AND BOLIVIA SOUTH AMERICAN GOLD MINING COMPANY (LIMITED) -T. Jones, Q. C. showed cause; Horace Lloyd and Rosher supported the rule.-This was an action by an engineer for salary, and the defendants pleaded a set-off in respect of calls due upon shares held by the plaintiff. There was also a cross-action for calls. The question was whether the plaintiff's liability to pay calls had ever accrued, inasmuch as he had only verbal notice of the calls, and that at a period subsequent to the time appointed for the payment of them. The question depended upon the construction to be put upon the articles of association, which required twenty-one days' notice to be given of the time and place for payment-The COURT, being of opinion that the only question was whether the calls could be set-off in these actions, and that ultimately the plaintiff would be liable to pay them, strongly recommended that these actions and all matters in difference should be referred. The case accordingly stood over in order that the parties might see if they could come to an arrangement to that effect. Stands over accordingly.

EAST GLOUCESTERSHIRE RAILWAY COMPANY P. BARTHO

Dr. Deane, QC. and Clarkson for the Calabar.—The COURT decided that the pilot of the Calabar was solely to blame for the collision.

THE DARING.-Dr Tristram moved that a sum of 201. should be paid to the master, the plaintiff in a wages suit, out of freight in court Motion granted.

THE SYLPH.-The arguments in this case, which had been part heard last motion day, were concluded. Cur, ade, vult.

THE PALM TREE-V. Lushington on the part of a defendant, a mortgagee, moved for an unlivery of the cargo of this vessel, which had been six months under arrest, in a suit for necessaries. Motion granted

THE UNDERWRITER-Two suits were brought against this vessel for repairs, &c.; both were unopposed -The COURT made the usual decree, reserving all questions of priority.

THE SYREN-Butt moved in this case to reform or dismiss the petition; also that an affidavit which had been filed should be struck off the file. The facts had been agreed on, but, it was contended, were not stated fairly in the petition; and that the fling of affidavits in a case of demurrer was irregular.- Lushington appeared for the plaintiffs.-The COURT ordered the petition to be reformed, by striking out articles from 11 to 16 inclusive; the affidavit to remain for the present on the file, and all questions of costs to be reserved.

THE NINA.-V. Lushington for plaintiffs applied for time to answer affidavits. - This is a question of Portuguese law: the ship is under arrest at the suit of the master, and the defendants seek to be dismissed from the suit with costs, the Portuguese Consul. as juris peritus, having made an affidavit that the plaintiff, a Portuguese, cannot support his case under Portuguese law.

Time giren until Frid ty. THE ECLIPSE-This was a motion to order a sum of 2321, 68. 6d. to be paid out in a cause of damage.

The application was ordered to stand over.

THE CATHCART-In this case Murray moved that the register of the ship should be made over to the registrar of the Court of Bankruptcy. No one appeared to oppose the motion. Application granted.

THE CARLOS, -Clarkson moved that an original bottomry bond should be delivered out. Motion refused.

THE JANE-Clarkson applied on part of plaintiff to file a reply, also for a commission to examine witnesses in Capetown.-V. Lushington, contra, for one defendant, did not obiect to the reply or commission. As the laches of plaintiffs had led to the necessity of these motions. they should suffer the penalty of costs; and as to the commission, it should not issue till the pleadings had been concluded-Butt, for another defendant, did not object, but contended, as the plaintiffs were in default, that they should not have leave generally to reply, but should first state the specifle nature of the reply they intended to make.-The Cornr ordered that leave should be given to plaintiffs to reply generally on payment of the costs incurred by the other side: a commission to issue when the pleadings have been concluded.

and Watkin Williams showed cause. In this case the question was whether the defendants were liable for calls in respect of shares in the company. It was contended on the part of the defendants that they were not: first on account of the defective state of the register which did not specify the number of the shares which they held as required by the Companies Clauses Act; and secondly, on account of a proviso in the company's special Act, which provided that no share should vest until payment of a fifth of the amount of it. It was contended by the plaintiffs that the defendants having signed the subscription contract, and there being another book which specifled the numbers of the shares, the defendants were shareholders notwithstanding the fact that the number of the shares did not appear in the register of shareholders: and secondly, that the provisions of the special Act did not prevent calls being recoverable on the shares, but merely were aimed at preventing speculative dealing with the shares before anything had been paid-up upon them. THE ALBERT EDWARD.-This was a collision cause. plaintiffs are the owners of the late packet Patsie: the Watermen's Steam Packet Company are the owners of the steamer Albert Edward; the collision occurred in the Thames on the 27th of June last, when the Patsie was sunk.-Aspinall, Q.C. and Clarkson for plaintiffs; Brett, Q.C. and Butt for defendants.-The COURT held the Albert Edward solely to blame. Decree accordingly.

HOUSE OF LORDS.-Since the prorogation of Parliament the "bar" of the House of Lords has been brought forward 43 feet. This will be of immense advantage to parties engaged in appeals before their Lordships, as not only will it afford additional space below the bar, but counsel, while speaking, being so much nearer their Lordships now than formerly, it is anticipated that their Lordships' obvservations will be heard distinctly at the bar, both by counsel and agents which hitherto they have not always been. In addition to this it will afford more room during debates for members of the House of Commons who wish to be present below the bar, as well as when the "Commons" are summoned to the bar. THE KREY WOGGERSIN.-This was a cause of damage arising from a collision, which occurred on the 8th of April last, at the mouth of the Avon, between the brig Eliezer, of Tonsberg, Norway, and the barque Krey Wog-nary sessional cleaning.-Globe. gersin, of Rostock. The latter had on board a duly licensed pilot-Dr. Diane, Q.C. and Dr. Tristram were for the plaintiffs, and Clarkson for the defendants.-The CoURT held that the pilot of the Krey Woggersin was solely to The suit therefore dismissed, but without costs. Monday, Nov. 18. THE CALABAR-This case, which had occupied part of Friday and Saturday, was concluded. It was a cause of damage, arising from a collision which took place on the 2nd of January last in the Mersey, between the Royal African Mail steamer Calabar and the screw steamer Rosetta. The Calabar was in charge of a duly licensed pilot within a district of compulsory pilotage. A second cause was instituted by the owners of the cargo lately on board the Rosetta, and it was agreed that the same pleadings and evidence should be used, and the same decision bind both cases.-Brett, Q.C. and Butt were for the Rosetta;

TELEGRAPHS.-Respecting the proposed transfer of the telegraphic lines to the Post office, the Times says:-"We believe that the Government, at the last Cabinet, held on the 12th inst., decided on entering into arrangements with the principal telegraphic companies of the United Kingdom, with the view of placing the various lines under the management of the Post-office department. This scheme, when carried into effect, will, of course, involve a thorough revision of the present tariff and system of management hitherto used by the private companies. The details of the plan will be under the superintendence of Mr. F. J. Scudamore, the assistant-secretary of the Post-office, with whom the notion originated."

"A SOLICITOR AND SUBSCRIBER," writing upon the question of advocacy in the County Courts, is referred to our articles on the new rules. His letter is in type, and shall be inserted if he wishes. The article in question was written by a frequent contributor, and inserted by us as a matter of course, we only agreeing with the proposition he mentioned to us, namely, that he advocated the adoption in County Courts of the rule which prevails at Quarter Sessions, which is this, that when four barristers are present, the Bar shall have exclusive audience. As this could only be in the very largest towns in the kingdom, we were decidedly of opinion that the rule would operate beneficially for the Profession generally, as elevating the County Courts into species of Superior Courts. The discussion of the proposition, however, proves that it is not to be further entertained, and the rules regulating practice in these courts will

remain as hitherto.

220 THE Owl tells us that a vacancy on the Bench is "expected shortly," and that Mr. BRETT will fill it. This is no news to the legal profession. Our sagacious contemporary also avers that it is the opinion of several of the Judges that the new County Courts Act will diminish the common jury business at Westminster and on circuit by one-half. This also we have heard before, and long since expressed the same opinion.

NEW RULES FOR DESPATCH OF BUSINESS IN CHAMBERS. THE Judges have just published some new rules 76 for the better despatch of business in chambers. They are to be found in the page devoted to the 77 Court Papers. They assign to the Masters a vast quantity of the more formal business hitherto transacted before the Judge in person, requiring, however, that the Masters shall refer to the Chamber Judge any case that may require a better authority. Appeals from the Masters' decisions are to be by summons to be taken out within four days or such further time as may 78 be allowed. An appeal is to be no stay unless so ordered, and the costs of the appeal are to be in the discretion of the Judge. All summonses are to be issued by a Judge as heretofore, but orders by the Masters are to be made in their

ORDER IN COUNCIL ON THE NEW COUNTY COURTS ACT. SINCE the passing of this Act an Order in Council has extended to the County Courts those sections of the Common Law Procedure Act 1854 which relate to 66 "Discovery," "Equitable Defences," and the "Attachment of Debts." It is unnecessary to point out to our readers that these are most important additions to the jurisdiction of the County Courts.

THE NEW COUNTY COURT RULES. WE understand that a draft of the rules which are to be issued under the new Act has been circulated amongst the County Court judges for the purpose of eliciting suggestions which may be incorporated in the rules before they are finally published. We believe we are right in stating that this final publication will take place before the Christmas holidays.

In the mean time the Profession will be glad to learn that the scale of costs is liberally framed. A great deal of unnecessary irritation has been caused by an article which we published upon the subject of the employment of barristers in the County Courts, but as we have subsequently contended, in reply to correspondents, it will be rules to employ counsel than to act themselves. more profitable to attorneys under the new This will appear when we state, we believe accurately, that whilst the fee to counsel may be as high as five guineas and one guinea conference, the attorney will be allowed, attending court on trial with counsel one guinea, drawing brief for counsel 1s. per folio, and appointing and attending conference with counsel 13s. 4d. According to our calculation, the fees to the attorney when instructing counsel would amount to nearly 47.; whilst the highest fee which he is allowed alone is two guineas. Where a case is adjourned 13s. 4d. will be allowed for preparing brief to counsel to argue case; for attending counsel with brief 3s. 4d., and attending court with counsel 10s. 6d. On the other hand, where counsel is not employed, the attorney is allowed one guinea only.

In arbitration cases 17. each sitting is to be allowed to the attorney where counsel does not attend; 15s. where he does; the fee to counsel

two guineas. But costs of counsel and attorney, not be allowed without the order of a Judge; or of an attorney on attending reference, will allowed without the order of the Judge. nor will the costs of more than one sitting be

On appeal, the sum allowed for preparing deposit on appeal, including service and notice notice will be 10s.; paying money into court as thereof, 5s.; notice of nature and particulars of proposed security, including copies se vice, 5s.; notice of Court to which appeal to be made, 5s. ; preparing case, including copies, 15s.; attending Judge to sign, 7s.; ditto in case of difference to settle, 15s. ; transmitting copies of case, including depositing the same, 5s.; transmitting case and copies, including notice and service thereof, 7s.; application to Judge for leave to proceed on the judgment, 7s.; and depositing order of court of appeal, including notice and service thereof, 4s.

There has been a rumour that the new rules would be consolidated with the rules previously existing, and one set issued applicable to all the County Court Acts. We have as yet heard of nothing, however, to lead us to believe that there is any foundation for such a rumour.

As to the rules generally, we learn that they are principally devoted to the subject of ejectment, the greater portion of the sections relating thereto in the Common Law Procedure Act being incorporated. The rules of Chancery affecting relief to trustees are also adapted mutatis nutandis. As a whole, we believe, the rules as framed in draft will not undergo substantial modification, and that they will ultimately receive the approval of the public and the Profession.

ATTORNEY'S LIEN FOR COSTS. VICE-CHANCELLOR STUART has decided (Re Bank of Hindustan, China, and Japan, 17 L. T. Rep. N. S. 193, reports of the week) that the solicitor of a contributory of a company has no lien for the costs of an action unsuccessfully brought by the company against the contributory, if the contributory is, at the same time indebted to the company in a sum for calls larger than the
