he could mention. It was idle to speak of assizes, or of the sittings of such a court as the Court of Passage, which was open to suitors only once a quarter. He had inquired into this matter on the spot, and was convinced that the chief want was a competent resident judge, sitting constantly, always accessible, and exercising all the power required in law, equity, bankruptcy, &c. In a court of that kind a bar would always be found, and uniformity of decision would be maintained by the Central Appellate Court. The Chairman said that there was an unanimous opinion that every court, whether of law or equity, should do complete justice in every matter brought before it. But there was a corollary to this, that the court should have powers which would enable it to administer complete justice. The department then adjourned. The Chairman announced that Mr. Montague Cookson, Mr. William Barber, and Mr. Abram had been elected members of this society. The society had added to its list of vice-presidents Mr. Justice Hannen, and he (the Chairman) could not forbear, although it might be some trespass on the regularity of the proceedings, from expressing the great pleasure he felt-a pleasure no doubt shared by the whole Profession-at the selection of that gentleman to be one of her Majesty's judges. A more appropriate or more excellent appointment could not have been made. Mr. Charles Clarke was then elected treasurer, and Mr. Charles Hopwood secretary of the society; Mr. Vernon Lushington, Mr. H. M. Jackson, Mr. Vaughan Hawkins, Mr. James Hopwood, Mr. Alfred George Martin, and Mr. A. C. Humphreys, were elected members of the council; and Mr. Droop and Mr. W. W. Karslake were re-elected auditors. In accordance with a proposition made by the chairman in 1857, to the effect that the Lord Chancellor for the time being should be the president of the society, Lord Westbury was requested to offer that office to Lord Cairns. Lord Westbury observed that the present Lord Chancellor was a most accomplished lawyer, a most zealous legal reformer, and a legal scholar, if he might say so, desirous of promoting the study of jurisprudence, which was the object for which this society was established. At the weekly meeting of the above society, held gell in the chair, the following point was discussed on Tuesday evening, the 3rd inst., with Mr. PettinWill an advowson in gross pass by the word 'tenement ?" Mr. Watson sustained the affirmative, and Mr. Glover the negative. After an interesting discussion, in the course of which much information was gathered from the authorities quoted, the point was decided in the affirmative by a majority of five. The affirmative was ably argued by Mr. Sibree, and the negative by Mr. Pettingell, and after due consideration of the authorities quoted the point was decided in the affirmative. BUSINESS OF THE WEEK. THE MINNA. This was a cause of damage arising from a collision on the 28th March last, between the barge Moral, and the screw-steamer Minna, in the Thames. The Minna had on board a pilot by compulsion of law, the plaintiffs were the bailees, not the owners, of the barge.The Solicitor-Genenal, and Clarkson for the plaintiffs; Deane, Q. C. and Butt for the defendants.-The COURT decided that the Minna was solely to blame; that her master was to blame as well as the pilot. Usual decree with costs; damages not to be paid till the registrar be satisfied that the owners of the Minna will not be subjected to action by the owners of the large and her cargo. Thursday, March 5. THE EAGLE-This was a cause of damage. On the 8th Dec. the schooner Jane was moored alongside the quay in Dunkirk harbour, the brig Mary was moored alongside her, the Eagle was subsequently moored outside the Mary. The Jane got jammed against the quay, and injured according to the plaintiff's contention by the pressure of the Eagle against the Mary.-Dr. Deane, Q. C. and Butt for the plaintiffs; Milcard, Q. C. and Clarkson for defendants.-The COURT held that both vessels had been to blame. Decree accordingly. Saturday, March 7. THE LIZZIE. In this case the consignees of the cargo of the Lizzie disputed the validity of a bottomry bond given upon the ship, freight, and cargo at Key West, for repairs done to the vessel there on her way from Mexico to Falmouth. The ground on which the validity of the bond was disputed was that it had been given for an amoant greater than the whole value of the cargo, and that the master did not, though he could have done so, give notice to the owner of the cargo of his intention to borrow money on bottomry bond.-Miliard, Q.C. and Lushington for the plaintiffs; Butt and Benjamin for the defendants. BRICK-BURNING. For BRICK-BURNING has been long recognised as a nuisance, but it has not been determined under what circumstances it is such. This, indeed, is configuration of the country would much govern rather a question of fact than of law, for the the direction and range of the vapours. instance, a brick-field in a valley, between high hills, would taint the air far up and down the vale, while localities much nearer in distance, but lying on the other sides of the hills, would be free from the nuisance. In the case of Roberts v. Clarke (reported last week 18 L. T. Rep. N. S. 49), Vice-Chancellor Wood held that a distance of 240 yards is not an extreme limit for the extension of the noxious vapour. In the same case it was held that where a nuisance had been of more than twenty years' standing, but with temporary interruptions, the party asserting the right was bound to show that it had been exercised at least in the first and last year of the period of twenty years, in order to preserve it from being lost. Again, "It was not," said the Vice-Chancellor, "necessary to prove that any special sickness resulted to plaintiff or his family from the effluvia arising from brickburning, nor that the vapour was more than usually injurious or offensive. It has been held at law that brick-burning carried on in the ordinary way was a nuisance to the persons living within the limit affected by it." car SHERIFFS AND JUDGES. THE state and solemnity which, for so many centuries, attended the holding of an assize, have, during the last few years, unfortunately, become almost a mere matter of history, and we greatly fear that with their disappearance has likewise ceased much of that respect which was wont to be paid, and which is undoubtedly due to Her MAJESTY'S Judges when on circuit, as well as at all other times. The tenants of the sheriff, dressed in his livery, have been supplanted by the hired javelin-men, and the latter, in their turn have again been, in many instances, supplanted by the common police of the county; whilst the state riage has given way to the ordinary chariot, less pretending kind. Scarcely an assize now or even to a vehicle of a more nondescript but passes by without some complaint being made by one or more of the Judges, of the disrespect and discourtesy which are shown to them either by the sheriff himself, or by those to whom he which legally and properly belong to his office. has delegated the performance of those duties It is not long ago that on one of the circuits a common hired fly was sent to convey the Judge from the railway-station to his lodgings, or that on another he was compelled to seek for accomodation at an hotel, no other lodgings whatever having been provided for him; and only on Tuesday last, at Lewes, Lord Chief Justice COCKBURN was subjected to the grossest disrespect, both by the high sheriff himself and by his subordinates. In this latter case it appears that the court had adjourned for a short time for refreshment, and that when the Chief Justice again came into court only three of the jurymen had returned. His Lordship thereupon directed that the jury should be called, and one of the officers of the sheriff left the court for that purpose. Some time elapsed, but neither officer nor jurymen returned, nor was there either sheriff, under-sheriff, or a single officer of the sheriff in court, and the Lord Chief Justice then observed that he had never been treated with so much disrespect on any occasion since he had been on the bench. Some further time The late LORD CHANCELLOR some time ago directed an inquiry to be made into the duties and salaries of the officers of the Court of 400 Chancery. One result, we believe, will be the increase of the salary now paid to the chief clerks of the Master of the Rolls and the Vice-elapsed, and then some few of the jurors made Chancellors from 15007, the present amount, to 400 1800l. a-year. 400 | 400 |
