Three flashing green lights so located as to be visible to approaching vessels, or

During daylight hours three cylinders or balls so located as to be visible to approaching vessels.

Draw cannot be opened immediately, or if open must be closed immediately:

A red light (or a red flag during daylight hours) swung to and fro horizontally in full sight of the vessel, or

During daylight hours one cylinder or ball so located as to be visible to approaching vessels.

By the vessel.-Vessels or other water craft having signaled for the opening of a draw and having received a signal that the draw cannot be opened immediately, or if open must be closed immediately, will acknowledge said signal by one long blast followed by a short blast or by swinging to and fro horizontally a red flag by day or a red light at night.

(e) A vessel approaching to pass two or more bridges less than 800 feet apart shall signal the first bridge as prescribed herein (see (d) above) and give the same signals for the second bridge after an interval of about 10 seconds, and so on, thus giving at intervals of about 10 seconds separate signals for each bridge to be passed. The operator of each bridge shall reply as prescribed herein. (See (d) above.)

(f) When two or more vessels are approaching to pass a drawbridge from opposite directions, the person in charge of each vessel shall signal for the opening of the draw as prescribed herein. The vessel running with the current shall have the right of way. At slack tide the vessel running in ebb current direction shall have right of way. The bridge operator shall reply as hereinbefore prescribed. (See (d) above.)

(g) When vessels are approaching a bridge span or a draw from the same direction, each vessel shall signal independently for the opening of the draw and shall be navigated in accordance with the pilot rule applicable to the waterway governing such vessels.

(h) Special supplemental regulations may be prescribed to provide for closed or open periods when land or water traffic predominates and to provide for intermittent attendance of bridge operators on bridges across streams where water traffic is minor or at times nonexistent. Owners of or the agency controlling bridges for which such special supplemental regulations are prescribed will be required to keep a copy thereof posted in a conspicuous place on both the upstream and downstream sides of the bridges.

(i) These regulations shall be in force on and after June 1, 1933, and shall supersede all general bridge regulations previously approved for these waters.

SPECIAL REGULATIONS

Pursuant to the provisions of Section 5 of the River and Harbor Act of August 18, 1894 (28 Stat. 362; 33 U. S. C. 499),10 the following special and supplemental regulations have been prescribed to govern the operation of certain drawbridges where particular local conditions

warrant.

203.556 Mississippi River and all its navigable tributaries and outlets; bridges where constant attendance of draw tenders is not required." (a) The owners of or agencies controlling the bridges listed below will not be required to keep draw tenders in constant attendance.

(b) Whenever a vessel, unable to pass under a closed bridge, desires to pass through the draw, advance notice, as specified, of the time the opening is required shall be given to the authorized representative of the owner of or agency controlling the bridge.

(c) Upon receipt of such advance notice, the authorized representative of the owner of or agency controlling the bridge, in compliance therewith, shall arrange for the prompt opening of the draw at the time specified in the notice for the passage of the vessel.

(d) The owners of or agencies controlling the bridges shall keep conspicuously posted on both the upstream and downstream sides thereof, in such manner that it can easily be read at any time, a copy of these regulations together with a notice stating exactly how the representative specified in (b) above may be reached.

(e) The operating machinery of the draws shall be maintained in a serviceable condition, and the draws shall be opened and closed at intervals frequent enough to make certain that the machinery is in proper order for satisfactory operation.

(f) The bridges to which these regulations apply, and the advance notice required in each case, are as follows:

Wisconsin River, Wis., all drawbridges.—(At least 48 hours' advance notice required.)

Black River, Wis., Chicago, Milwaukee, St. Paul & Pacific Railroad Co. bridge at La Crosse, Wis.-(At least 2 hours' advance notice required.)

Black River, Wis.; Wisconsin State Highway Commission bridge at North La Crosse, Wis.-(At least 24 hours' advance notice required.)

203.620 Quincy Bay at Quincy, Ill.; bridge (railroad) opposite Broadway Street.12-(a) The owner of or agency controlling the bridge will not be required to keep a draw tender in constant attendance at the above-named bridge.

(b) Whenever a vessel unable to pass under the closed bridge desires to pass through the draw, advance notice to that effect shall be given to the authorized representative of the owner of or agency controlling the bridge, as follows: Between the hours of 7:30 a. m. and 5:30 p. m. at least 30 minutes and between the hours of 5:30 p. m. and 7:30 a. m. at least 90 minutes.

(c) Upon receipt of such notice the authorized representative of the owner of or agency controlling the bridge, in compliance therewith, shall arrange for the prompt opening of the draw at the time specified in the notice for the passage of the vessel.

(d) The owner of or agency controlling the bridge shall keep conspicuously posted on both the upstream and downstream sides of the bridge, in such a manner that it can be easily read at any time, a copy

of these regulations, together with a notice stating exactly how the representative specified in (b) above may be reached.

(e) The operating machinery of the draw shall be maintained in serviceable condition and the draw opened and closed at least once each month to make certain that the machinery is in proper order for satisfactory operation.

(f) These special regulations, which shall take effect October 15, 1932, may be revoked upon 2 weeks' notice by the Secretary of the Army whenever, in his judgment, the interests of navigation so

warrant.

203.630 St. Croix River, Minn. and Wis.—(a) Bridge (highway) at Stillwater, Minn.13-(1) During any portion of the year when the river is open to navigation, the owner of, or agency controlling, this bridge will keep thereat a draw tender in constant attendance between 8 a. m. and 12 o'clock midnight on Saturdays, Sundays, and on Federal and State legal holidays. At all other times a draw tender will not be required in constant attendance at this bridge.

(2) Whenever a vessel unable to pass under the closed bridge desires to pass through the draw during the periods when a draw tender is not required to be in constant attendance, at least 2 hours' advance notice of the time the opening is required shall be given to the authorized representative of the owner of, or agency controlling the bridge.

(3) Upon receipt of such notice, the authorized representative of the owner of, or agency controlling, the bridge shall arrange for the prompt opening of the draw at the time specified in the notice for the passage of the vessel.

(4) The owner of, or agency controlling, the bridge shall keep conspicuously posted on both the upstream and downstream sides of the bridge and in a manner that it can be read at any time a sign giving the number of hours' advance notice provided for in these regulations and exact information stating how the representative specified in (2) above may be reached.

(5) The operating machinery of the draw shall be maintained in a serviceable condition, and the draw opened and closed at least once each quarter to make certain that the machinery is in proper order for satisfactory operation.

(6) The regulations approved June 1, 1938, applying to the abovenamed bridge are hereby revoked.

(b) Bridges of Minneapolis, St. Paul and Sault Ste. Marie Railway Co. south of Osceola, Wis., and the village of Osceola, Wis.14-(1) The owners of, or agencies controlling, the bridges will not be required to keep draw tenders in constant attendance at the above-mentioned bridges.

(2) Whenever a vessel unable to pass under a closed bridge desires to pass through the draw, at least 24 hours' advance notice of the time the opening is required shall be given to the authorized representative of the owner of, or agency controlling, the bridge.

(3) Upon receipt of such notice, the authorized representative of the owner of, or agency controlling, the bridge, in compliance therewith, shall arrange for the prompt opening of the draw at the time specified in the notice for the passage of the vessel.

(4) The owners of, or agencies controlling, the bridges shall keep conspiculously posted on both the upstream and downstream sides of the bridges in a manner that it can easily be read at any time a copy of these regulations, together with a notice stating exactly how the representatives specified in (2) above may be reached.

(5) The operating machinery of the draws shall be maintained in a serviceable condition, and the draws opened and closed at least once each quarter to make certain that the machinery is in proper order for satisfactory operation.

(6) These regulations shall take effect and be in force on and after April 29, 1938, and all regulations or parts of regulations applying to the above-named bridges in conflict therewith are hereby revoked to take effect on that date.

203.635 Minnesota River, Minn.; bridges between mouth of river and Le Sueur, Minn.15-(a) The owners of, or agencies controlling, the bridges will not be required to keep draw tenders in constant attendance at the above-mentioned bridges.

(b) Whenever a vessel unable to pass under a closed bridge desires to pass through the draw, at least 24 hours' advance notice of the time the opening is required shall be given to the authorized representative of the owner of, or agency controlling, the bridge.

(c) Upon receipt of such notice, the authorized representative of the owner of, or agency controlling the bridge, in compliance therewith, shall arrange for the prompt opening of the draw at the time specified in the notice for the passage of the vessel.

(d) The owners of, or agencies controlling the bridges, shall keep conspicuously posted on both the upstream and downstream sides of the bridges in a manner that it can easily be read at any time a copy of these regulations, together with notices stating exactly how the representatives specified in (b) above may be reached.

(e) The operating machinery of the draws shall be maintained in a serviceable condition, and the draws opened and closed at least once each quarter to make certain that the machinery is in proper order for satisfactory operation.

These regulations shall take effect and be in force on and after April 29, 1938, and shall supersede any provisions heretofore made to govern the operation of the above-named bridges.

(g) For the Minnesota River, Minn., at and above Le Sueur, Minn., no special or general regulations shall apply.

STATUTES RELATING TO THE NAVIGATION OF VESSELS ON THE RED RIVER OF THE NORTH AND RIVERS EMPTYING INTO THE GULF OF MEXICO AND THEIR TRIBUTARIES

SEC. 4233.16 The following rules for preventing collisions on the water shall be followed in the navigation of vessels of the Navy and of the mercantile marine of the United States. (33 U. S. C. 301.)

RULE SIX. River steamers navigating waters flowing into the Gulf of Mexico, and their tributaries, shall carry the following lights, namely: One red light on the

outboard side of the port smoke pipe, and one green light on the outboard side of the starboard smoke pipe. Such lights shall show both forward and abeam on their respective sides. (33 U. S. C. 315.)

Small vessels

RULE NINE. Whenever, as in case of small vessels during bad weather, the green and red lights cannot be fixed, these lights shall be kept on deck, on their respective sides of the vessel, ready for instant exhibition, and shall, on the approach of or to other vessels, be exhibited on their respective sides in sufficient time to prevent collision, in such manner as to make them most visible, and so that the green light shall not be seen on the port side, not the red light on the starboard side. To make the use of these portable lights more certain and easy, they shall each be painted outside with the color of the light they respectively contain, and shall be provided with suitable screens. (33 U. S. C. 318.)

RULE THIRTEEN. Open boats shall not be required to carry the side lights required for other vessels, but shall, if they do not carry such lights, carry a lantern having a green slide on one side and a red slide on the other side, and on the approach of or to other vessels such lantern shall be exhibited in sufficient time to prevent collision, and in such a manner that the green light shall not be seen on the port side, nor the red light on the starboard side. Open boats, when at anchor or stationary, shall exhibit a bright white light. They shall not, however, be prevented from using a flare-up in addition, if considered expedient. (33 U. S. C 322.)

Public vessels; exemptions

RULE FOURTEEN. The exhibition of any light on board of a vessel of war of the United States may be suspended whenever, in the opinion of the Secretary of the Navy, the commander in chief of a squadron or the commander of a vessel acting singly, the special character of the service may require it. The exhibition of any light on board of a revenue cutter of the United States may be suspended whenever, in the opinion of the commander of the vessel, the special character of the service may require it. (33 U. S. .C. 323.)

RULE TWENTY-SIX. Nothing in these rules shall exonerate any ship, or the owner, or master, or crew thereof, from the consequences of any neglect to carry lights or signals, or of any neglect to keep a proper lookout, or of the neglect of any precaution which may be required by the ordinary practice of seamen or by the special circumstances of the case. (33 U. S. C. 351.)

Order to helmsmen

RULE TWENTY-SEVEN. All orders to helmsmen shall be given as follows: "Right Rudder" to mean "Direct the vessel's head to starboard."

"Left Rudder" to mean "Direct the vessel's head to port." (33 U. S. C. 352.)

Passing regulations

SEC. 4412. The Board of Supervising Inspectors 17 shall establish such regulations to be observed by all steam vessels in passing each other, as they shall from time to time deem necessary for safety; two printed copies of such regulations, signed by them, shall be furnished to each of such vessels and shall at all times be kept posted up in conspicuous places in such vessels.
