The motion was agreed to and the journal was approved.

Mr. Van Wyck offered the following resolution:

Resolved, That a committee of three be appointed by the president to wait upon the lieutenant-governor to notify him that the senate is in session, and conduct him to the chair.

Mr. Kennard moved the adoption of the resolution.

Mr. Calkins moved to lay the resolution on the table until two o'clock this afternoon,

Which motion was agreed to.

Mr. Kennard offered the following resolution, which was adopted:

Resolved, That the representatives of the press be and they are hereby allowed the privileges of the floor of the senate, and that the sergeant-at-arms be required to furnish seats and tables for their convenience, under the direction of the lieutenant-governor and temporary president.

Mr. Ferguson offered the following resolution,

Which was, upon motion, laid over until two o'clock this afternoon :

WHEREAS, It is deemed advisable and proper that the people throughout the various portions of the state be furnished with information of the proceedings of the legislative body; therefore, be it

Resolved, That the secretary of state be and he is hereby instructed to furnish each member of the senate with copies of the daily papers, not exceeding ten in number, to be selected by each

senator.

Mr. Holt offered the following resolution, which was adopted : Resolved, That the secretary of the senate be and he is hereby directed to procure, for the use of the members of this body, 150

copies of a legislative manual, containing the standing rules for the government of this senate, the joint rules for the government of the two houses, a list of the members of the standing committees of the senate and house of representatives, names of members of the senate and house of representatives, and the officers of the respective houses, etc.

Mr. Chapman asked unanimous consent to allow the following explanation of senator Bryant to be placed upon the journal:

Resolved, That the following explanation of senator Bryant be placed upon the journal, viz: "I have not sought the chaplaincy of this senate, and I hope that senator Ambrose will withdraw his motion."

Mr. Ambrose demanded the previous question.

Mr. Calkins arose to a point of order,

That the motion was not properly before the senate, as no motion had been made to adopt the resolution.

The temporary president decided that the point of order was well taken.

Mr. Ambrose moved

That the resolution be adopted, and called for the previous question,

Which was seconded by a majority of the senators.

The question being upon the adoption of the resolution,
The yeas and nays being demanded,

Those voting in the affirmative were:

Messrs. Ambrose, Aten, Baird, Blanchard, Birkhauser, Chapman, Colby, Covell, Crawford, Dawes, Garfield, Gilham, Hayes, Hinman, Holt, Howe, Kennard, Powers, Thummel, Van Wyck, Walton and Wilcox-22.

Those voting in the negative were:

Messrs. Brown, Calkins, Carns, Ferguson, Knapp, North and Pepoon-7.

Not voting, Mr. Bryant--1.

A majority of the senators voting in the affirmative

The resolution was adopted.

On motion,

The senate took a recess until two o'clock P. M.

AFTER RECESS.

2 o'clock P. M.

The senate was called to order by the temporary president. The roll was called and there were present all of the senators. Mr. Crawford introduced the following resolution and moved its adoption:

Resolved, That the president of the senate appoint a committee of three senators to wait upon the house of representatives and inform that body that the senate is now organized and ready to meet the house in joint convention for the purpose of canvassing the vote for State officers, in accordance with section 4 of article 5 of the constitution.

The yeas and nays being demanded,

Those voting in the affirmative were:

Messrs. Ambrose, Brown, Birkhauser, Calkins, Covell, Crawford, Ferguson, Hinman, Holt, Howe, North-11.

Those voting in the negative were :

Messrs. Aten, Baird, Blanchard, Bryant, Carns, Colby, Dawes, Ferguson, Garfield, Gilham, Hayes, Kennard, Knapp, Pepoon, Powers, Thummel, Van Wyck, Walton, Wilcox-19.

A majority of the senators voting in the negative,

The resolution was not adopted.

Mr. Howe offered the following resolution, which was adopted: Resolved, That the temporary president be and he is hereby requested to appoint a doorkeeper for the gallery of the senate, and that he be requested to instruct such appointee to not permit more persons in said gallery than can be seated with convenience.

Thereupon the temporary president appointed as such doorkeeper, Charles Dundas.

Mr. Colby moved

To take from the table the following resolution,

Which was agreed to:

Resolved, That a committee of three be appointed to wait upon the lieutenant-governor to notify him that the senate is in session, and conduct him to the chair.

Mr. Kennard moved

The adoption of the resolution,

Upon which the yeas and nays were demanded.

Those voting in the affirmative were:

Messrs. Aten, Baird, Blanchard, Bryant, Birkhauser, Carns, Chapman, Colby, Dawes, Garfield, Gilham, Hayes, Kennard, Knapp, Pepoon, Powers, Thummel, Van Wyck, Walton and Wilcox-20.

Those voting in the negative were:

Messrs. Ambrose, Brown, Calkins, Covell, Crawford, Ferguson, Hinman, Holt, Howe and North-10.

A majority of the senators voting in the affirmative,

The resolution was adopted.

The temporary president appointed as such committee,
Messrs. Van Wyck, Brown and Kennard.

The committee retired and subsequently appeared in the senate. chamber, escorting the Hon. Othman A. Abbott, lieutenant-governor, and introduced him to the senate.

The lieutenant-governor made a few remarks, and

Thereupon assumed his duties as president of the senate.

Mr. Ambrose offered the following resolution, and moved its adoption :

Resolved, That the following standing committees be and they are hereby empowered to appoint a clerk, the name of said clerk to be reported to the president of this body, viz:

Committee on judiciary.

Committee on finance, ways and means.

Committee on enrolled and engrossed bills.

Committee on public lands and buildings, and

Committee on Constitutional amendments.

Under the rule, the resolution was laid on the table until tomorrow morning.

Mr. Ferguson moved

To take from the table the following resolution:

Mr. Covell offered the following as an amendment :

Strike out the word ten and insert in lieu thereof the word

twenty,"

And moved its adoption.

Mr. Ambrose moved

To strike out the word "twenty " and insert the word "three" in lieu thereof.

Mr. Brown moved

To lay the whole subject matter upon the table,

Which was not agreed to.
