Mr. Calkins moved

To amend by striking out 9 o'clock and inserting 10 o'clock, upon which motion the yeas and nays were demanded.

Messrs. Aten, Baird, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox-12.

Those voting in the negative were:

Messrs. Ambrose, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, North, Powers and Thummel-16.

Not voting, Mr. Kennard-1.

Mr. Chapman moved

That the main question be now put, and the yeas and nays were demanded.

After the secretary had commenced the call of the senate, Messrs. Calkins and Knapp asked to be excused from voting.

The temporary president directed the secretary to complete the

call of the senate, after which Mr. Chapman moved that the senators be excused.

Mr. Van Wyck moved that the question be divided.

The temporary president decided the motion out of order, as there was but one point in the motion made by Mr. Chapman,

From which decision of the temporary president Mr. Van Wyck appealed to the senate, and demanded the yeas and nays. The question being,

"Shall the decision of the chair stand as the will of the senate ?"

Those voting in the affirmative were :

Messrs. Ambrose, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers, Thummel—17.

Those voting in the negative were:

Messrs. Aten, Baird, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton, Wilcox-12.

A majority of the senators voting in the affirmative, the decision of the chair was affirmed by the senate.

The question recurring upon the motion to excuse Messrs. Calkins and Knapp from voting,

The yeas and nays were demanded.

Those voting in the affirmative were:

Not voting, Messrs. Calkins and Knapp-2.

The motion was agreed to, and Messrs. Calkins and Knapp were excused from voting.

Thereupon Mr. Baird moved

To adjourn until 9 o'clock to-morrow morning.

The temporary president decided that the motion was out of order, and directed the secretary to announce the vote upon the question of adopting the report of the special committee which resulted as follows:

Those voting in the affirmative were:

Messrs. Ambrose, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummel-16.

Those voting in the negative were:

Messrs. Aten, Baird, Brown, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox-13. A majority of the senators voting in the affirmative, The report of the committee was adopted.

Mr. Calkins arose to a point of order, that the adoption of this report virtually suspended the rules that required reports to lie over one day, and that to suspend said rule, it required a two-thirds vote of the senate.

The temporary president decided that the point of order was not well taken, as the report had been already adopted, and there was nothing before the senate.

On motion of Mr. Ambrose,

The senate adjourned until to-morrow morning at 9 o'clock.

Thursday, January 4, 1877.

9 o'clock, A. M.

Senate met pursuant to adjournment, and was called to order

by the temporary president.

The roll was called, and there were present:

Messrs. Ambrose, Aten, Baird, Blanchard, Brown, Bryant, Birkhauser, Calkins, Carns, Chapman, Colby, Covell, Crawford, Dawes, Ferguson, Garfield, Gilham, Hayes, Holt, Kennard, Knapp, North, Pepoon, Powers, Thummel, Van Wyck, Walton and Wilcox-28.

Absent without leave:

Messrs. Hinman and Howe-2.

Prayer by the chaplain.

Journal read by the secretary.

Mr. Knapp arose to make a correction thereof:

He thought the vote was not taken on the excuse of Messrs. Calkins and Knapp;

And also called for the reading of the rules-especially rule 25.

Mr. Chapman moved

That the journal be approved as read.

Mr. Calkins arose to a point of order,

That the journal had not been read in full, and that the rules reported by the committee had not been read by the secretary.

The temporary president ruled that the proper time for objections was when that portion of the journal was passed, and that the point of order was not well taken.

Mr. Calkins appealed from the decision of the temporary president.

Mr. Knapp demanded the yeas and nays,

Which demand was duly seconded,

And the yeas and nays were ordered.

The question being,

"Shall the decision of the president stand as the will of the senate ?"

Those voting in the affirmative were:

Messrs. Ambrose, Brown, Bryant, Birkhauser, Chapman, Colby, Crawford, Furguson, Gilham, Hayes, Holt, Kennard, North, Powers, Thummel and Wilcox-16.

Those voting in the negative were:

Messrs. Aten, Baird, Calkins, Carns, Covell, Dawes, Garfield, Knapp, Pepoon, Van Wyck and Walton-11.

Absent or not voting:

Messrs. Blanchard, Hinman and Howe-3.

A majority of the senators voting in the affirmative,

The decision of the temporary president was affirmed by the

senate.

Mr. Colby called for the reading of the rules.
The rules were read in full by the secretary.
Mr. Chapman moved,

That the journal stand approved as read.

Mr. Knapp moved as an amendment that the portion stating that the vote was taken on the motion to excuse Messrs. Calkins and Knapp from voting be stricken out.

The yeas and nays were demanded upon the motion of Mr. Knapp.

Those voting in the affirmative were:

Messrs. Aten, Baird, Brown, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox-13. Those voting in the negative were:

Messrs. Ambrose, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Hayes, Holt, Howe, Kennard, North, Powers and Thummel-14.

Absent or not voting were:

Messrs. Blanchard, Ferguson and Hinman-3.
