Thereupon the question being,
"Shall the resolution pass?"

The yeas and nays were demanded.

Those voting in the affirmative were:

Messrs. Ambrose, Blanchard, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummel-18.

Those voting in the negative were:

Messrs. Aten, Baird, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox-12.

Thereupon the resolution was declared adopted.

Mr. Wilcox moved

To adjourn until 9 o'clock to-morrow morning.

A division being called for, twelve senators voted in the affirmative, and seventeen in the negative, and the motion to adjourn was not agreed to.

Mr. Wilcox moved

To adjourn until 10 o'clock to-morrow morning.

A division being called for, eleven senators voted in the affirmative, and sixteen in the negative.

The motion was not agreed to.

The special committee on standing committees of the senate thereupon submitted the following report, which was read by the secretary in full:

Mr. Knapp moved

That the senate resolve itself into the committee of the whole house upon the report of the committee.

Mr. Kennard moved

To amend the motion of Mr. Knapp, by receiving the report of the committee.

Mr. Calkins arose to a point of order, that the amendment offered by Mr. Kennard was not germain to the motion sought to be amended.

The temporary president decided that the point of order. was not well taken, and that the motion to go into the committee of the whole house on the report of the committee, was out of order, as the report had not been received by the senate.

Mr. Holt moved

That the report of the committee be received,
Which was agreed to.

Mr. Calkins moved

To adjourn until 9 o'clock to-morrow morning.

Upon which motion the yeas and nays were demanded.

Those voting in the affirmative were:

Messrs. Aten, Baird, Calkins, Carns, Dawes, Garfield, Gilham,

Pepoon, Van Wyck and Walton-10.

Those voting in the negative were:

Messrs. Ambrose, Blanchard, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, Knapp, North, Powers, Thummel and Wilcox-20.

A majority of the senators not voting in the affirmative,

The motion to adjourn was not agreed to.

Mr. Colby moved

To adopt the report of the committee.

Mr. Calkins arose to a point of order, viz: that the report must lie over one day, under a standing rule of the senate.

The temporary president decided the point of order well

taken.

Mr. Ambrose appealed from the decision of the temporary president.

The question being,

"Shall the decision of the temporary president stand as the judgment of the senate?"

Those voting in the affirmative were:

Messrs. Aten, Baird, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox-12.

Those voting in the negative were:

Messrs. Ambrose, Brown, Bryant, Birkhauser, Chapman, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummel-17.

A majority of the senators voting in the negative, the decision. of the temporary president was not sustained.

A committee from the house of representatives, consisting of Messrs. Bear, Meyers and Fitch patrick, appeared and informed the senate that the house was organized and ready to proceed to busi

ness.

Mr. Colby moved the previous question, which was duly seconded by the following named senators:

Messrs. Ambrose, Brown, Bryant, Birkhauser, Calkins, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, Knapp, North, Powers, Thummel and Van Wyck -20.

The following senators refusing to second the previous question :

Messrs. Aten, Baird, Carns, Dawes, Garfield, Gilham, Pepoon, Walton and Wilcox-9.

Thereupon, the previous question was ordered.

Mr. Van Wyck moved

To reconsider the seconding of the previous question.

Mr. Ambrose arose to a point of order that the motion to reconsider had not been stated by the president, and that the gentleman was out of order in speaking upon the question.

The temporary president decided that the point of order was well taken.

The temporary president thereupon stated the question and Mr. Van Wyck proceeded to speak thereon.

Mr. Van Wyck having yielded the floor to Messrs. Calkins and Pepoon, for the third time commenced speaking to the question.

Mr. Colby arose to a point of order that under the standing rules of the senate the member could not speak more than twice upon the same subject the same day except by unanimous consent of the senate.

The temporary president decided the point of order well taken.
Thereupon Mr. Van Wyck resumed his seat.

Mr. Chapman called for a vote upon the question of adopting the report of the committee.

Mr. Colby moved

To lay the motion to reconsider the vote seconding the previous. question on the table.

On which motion the yeas and nays were demanded.

Those voting in the affirmative were:

Messrs. Ambrose, Brown, Bryant, Birkhauser, Calkins, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, Knapp, North, Powers and Thummel-19.

Those voting in the negative were:

Messrs. Aten, Baird, Carns, Dawes, Garfield, Gilham, Pepoon, Van Wyck, Walton and Wilcox-10.
