27. Live stock and grazing interests.

47. When an emergency is expressed in the preamble or body of an act, as a reason why such act should take effect from or after its passage, or some day less than three calender months after the adjournment of the session, the question shall be, "shall the bill pass?" and if decided affirmatively by a vote of two-thirds of all the members elected to the senate, then the bill shall be deemed passed, but if upon such vote a majority of less than two-thirds of said members vote affirmatively on said question then the vote on said bill shall be deemed reconsidered, and the bill subject to amendment by striking out such part thereof as expresses an emergency and the time of taking effect, and then said bill shall be under consideration upon its third reading, with the emergency clause and time of taking effect stricken out.

48. The hours of meeting of the senate shall be at 9 o'clock A. M. and 2 o'clock P. M. of each day, unless otherwise specially ordered by a vote of the senate.

On motion of Mr. Crawford,

The report was received and the committee discharged.

On motion of Mr. Crawford,

The words "And the question stated by the chair," were added to rule 9, after the word "seconded."

On motion of Mr. Crawford,

All of rule 24 preceding the word "no" in the second line of the rule, was stricken out.

Mr. North moved,

That rule 46 be amended by adding an additional standing committee, to be numbered 27 and called "Live Stock and Grazing interests,"

Which was agreed to..

On motion of Mr. Ambrose,

The report of the committee as amended was adopted.

Mr. Ambrose offered the following resolution and moved its adoption :

Resolved, That senators Chapman, North, Kennard, Birkhauser and Aten be and they are hereby appointed a committee for the purpose of reporting to this body the standing committees of the senate, and they are hereby instructed to report forthwith.

Mr. Calkins moved

To lay the resolution on the table.

A division being called for on the question "to lay on the table,"

Thirteen senators voted in the affirmative, and sixteen in the negative.

Thereupon the president declared the motion "to lay on the table," lost.

Mr. Carns moved

To amend the resolution by increasing the number of the committee to seven, by adding the names of Messrs. Knapp and Calkins.

Mr. Ambrose moved

That the amendment as offered by Mr. Carns, be laid upon the

Those voting in the affirmative were:

Messrs. Ambrose, Aten, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummel-17.

Those voting in the negative were:

Messrs. Baird, Blanchard, Brown, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox -13.

A majority of the senators voting therefor,

The motion to lay the amendment upon the table was agreed to.

Mr. Carns moved

To adjourn until to-morrow morning at 9 o'clock,

Which was not agreed to.

Mr. Van Wyck called for a division of the house.

Mr. Ambrose rose to a point of order, that the call for a division was too late, as the chair had announced the result of the vote. The temporary president decided that the point of order was well taken.

Mr. Calkins moved

To adjourn until to-morrow morning at 9 o'clock,

Which was not agreed to.

Mr. Colby moved

The previous question on the adoption of the resolution offered by Mr. Ambrose, which motion was seconded by sixteen senators, twelve senators refusing to second the motion.

Mr. Van Wyck called for the yeas and nays on the seconding of the previous question.

Mr. Ambrose arose to a point of order, that it was not in order for the yeas and nays to be ordered in seconding the call for the previous question.

The point of order was declared by the temporary president to be well taken.

Mr. Van Wyck appealed from the decision of the temporary president and demanded the yeas and nays,

Which demand was duly seconded,

And the yeas and nays were ordered.

The question being.

"Shall the decision of the temporary president stand as the will of the senate ?"

Those voting in the affirmative were:

Messrs. Ambrose, Aten, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummel-18.

Those voting in the negative were:

Messrs. Baird, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox-11.

A majority of the senators voting in the affirmative,

The decision of the temporary president was affirmed by the

senate.

Mr. Calkins moved

To adjourn until to-morrow morning at 9 o'clock,
Upon which motion the yeas and nays were demanded.

Those voting in the affirmative were:

Messrs. Aten, Baird, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton and Wilcox-12.

Those voting in the negative were:

Messrs. Ambrose, Blanchard, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummell-18.

Thereupon, the motion to adjourn was declared lost.

Mr. Dawes moved

To amend the resolution by adding the names of Messrs. Carns and Wilcox to the committee.

Mr. Ambrose rose to a point of order, and stated that the previous question having been ordered on the passage of the previous resolution, that it was not in order to entertain an amendment to the resolution.

The temporary president decided the point of order well taken, from which decision, Mr. Van Wyck appealed to the house and demanded the yeas and nays.

The question being,

"Shall the decision of the temporary president stand as the will of the house?"

Those voting in the affirmative were:

Messrs. Ambrose, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Gilham, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummel-18.

Voting in the negative:

Messrs. Aten, Baird, Calkins, Carns, Garfield, Knapp, Pepoon, Van Wyck, Walton and Wilcox-10.

Not voting, Mr. Dawes-1.

A majority of the senators voting in the affirmative the decision of the temporary president was sustained by the senate.

Mr. Van Wyck moved

To adjourn until to-morrow morning at 9 o'clock.

The temporary president decided the motion out of order, from which decision Mr. Van Wyck appealed to the senate and demanded the yeas and nays.

The question being,

"Shall the decision of the temporary president stand as the sense of the senate ?"

Those voting in the affirmative were :

Messrs. Ambrose, Brown, Bryant, Birkhauser, Chapman, Colby, Covell, Crawford, Ferguson, Hayes, Hinman, Holt, Howe, Kennard, North, Powers and Thummel-17.

Those voting in the negative were:

Messrs. Aten, Baird, Calkins, Carns, Dawes, Garfield, Gilham, Knapp, Pepoon, Van Wyck, Walton, Wilcox-12.

A majority of the senators voting in the affirmative,

The decision of the temporary president was sustained by the

senate.

Thereupon the previous question was ordered upon the main

question.
