Ten o'clock A. M.

The senate met pursuant to adjournment, and was called to order by the president.

The roll was called and there were present:

Messrs. Ambrose, Aten, Brown, Bryant, Birkhauser, Calkins, Carns, Colby, Ferguson, Garfield, Gilham, Hayes, Holt, Howe, Kennard, Knapp, North, Pepoon, Powers, and Walton-20.

Absent with leave:

Messrs. Covell, Dawes, Hinman, Thummel, Van Wyck and Crawford-6.

Absent without leave:

Messrs. Baird and Wilcox-2.

Messrs. Blanchard and Chapman were excused until 2 o'clock this afternoon.

Prayer by the chaplain.

Journal read and approved.

Mr. Bryant presented the claim of C. S. Copp, of Saunders County, for services rendered as immigration agent.

Referred to the committee on claims, and delivered to Mr. Crawford, chairman.

The committee on engrossed and enrolled bills submitted the following report:

Your committee on engrossed and enrolled bills would respectfully report that they have carefully examined and compared Senate File No. 5,

A bill for an act entitled an act to repeal an act entitled an act to create and provide for a state board of immigration.

Senate File No. 14,

A bill for an act to repeal an act to authorize the election of county assessors in certain counties.

Senate File No. 32,

A bill for an act entitled an act to dispose of surplus sinking and other funds.

Senate File No. 34,

A bill for an act to give power to boards of county commissioners to strike from the tax list illegally assessed real estate, and to regulate proceedings therein.

Senate File No. 36,

A bill for an act to amend an act entitled "Roads," approved February 25, 1875.

Senate File No. 40,

A bill for an act to repeal an act entitled an act to create the office of delinquent tax collector, and to define his duties.

Senate File No. 41,

A bill for an act concerning the competency of jurors in certain cases.

Senate File No. 74,

A bill for an act to amend an act entitled an act concerning the sale of land for the non-payment of taxes, approved February 25, 1875, and to regulate the reduction of taxes on lands and lots. Senate File No. 78,

A bill for an act to legalize the incorporation of the city of

Columbus, Nebraska.

And find the same correctly engrossed.

The committee on finance, ways and means submitted the following report:

Mr. President:

Your committee of finance, ways and means, having had under consideration

House Roll No. 63,

Beg leave to report the same back with amendments, viz: Strike out of the first line of section 2 the words, "state auditor," and insert "auditor of public accounts."

Insert after the word "employed," at the close of section 2, the following:

"And ten cents for every mile actually traveled in going to and returning from the capital on the most usual public route; provided that employees elected or appointed at or during said twelfth and thirteenth sessions shall only receive per diem; provided, further, that before warrants shall be drawn for any of the purposes mentioned in this act, the accounts and claims therefor shall be examined and adjusted by the said auditor and approved by the secretary of State."

And we recommend that said bill as amended do pass.

The following reports from the standing committees, which were reported on Friday and Saturday and were laid over, under the rules, were called up:

A bill for an act to provide stenographic reporters for the district court, and to repeal an act entitled an act to provide shorthand reporters in the district courts,

Having had said bill under consideration report the same back, with the following amendments:

Add to section 3 of said bill the following: "This shall not include arguments to the jury."

Strike out of section 5 of said bill the word "fifteen," and insert in lieu thereof the word "ten,"

And recommend that the bill pass, as amended.

Also, that

Senate File No. 3,

A bill for an act to amend sections 1, 2 and 3, of an act of the legislature of the State of Nebraska, entitled an act to provide for short hand reporters for the district courts,

And report the same back with the recommendation that the bill be indefinitely postponed.

A bill for an act to amend section 11, chapter 13, entitled, "Counties, and county officers,"

And report the same back with the following amendments:
Amend title of bill by substituting the following:

"A bill for an act to amend section 11 of an act entitled an act concerning counties and county officers," approved February 27, 1873.

Also,

Strike out of first line in section 1 the following words "of chapter 13," and further amend section 1 by striking out the words "caused by his death," in the 21st and 22d lines of said section.

Your committee would also recommend that section 2 be amended so as to read as follows:

"Section 2 of said section 11 is hereby repealed,"

And recommend the same do pass as amended.
