SENATE JOURNAL.

TWELFTH SPECIAL SESSION.

SENATE CHAMBER,

Tuesday, December 5, 1876.

The twelfth session of the legislature of the State of Nebraska, met in obedience to the proclamation of his excellency, Silas Garber, governor, which is in words and as follows, to wit:.

PROCLAMATION

BY THE GOVERNOR, CONVENING THE STATE LEGISLATURE IN

SPECIAL SESSION.

WHEREAS, The constitution of the State of Nebraska provides that "the governor may on extraordinary occasions convene the legislature by proclamation, stating therein the purpose for which they are convened, and the legislature shall enter upon no business except that for which they were called together, and

WHEREAS, Section 57, chapter 20, of the general statutes provides that the votes cast for electors of the president and vice-president shall be canvassed in the same manner and by the same officers as required by law in the case of electing a representative in congress; and

WHEREAS, It appears from section 19, of chapter 20, of the general statutes, that the votes cast at any election for member of congress, shall be canvassed by the legislature in joint session;

Therefore, in accordance with the provisions of the constitution, and by virtue of the authority vested in me, I, Silas Garber, governor of the State of Nebraska, do call upon members of the legislature of said State to meet at the capitol in Lincoln, on the 5th day of December, A. D. 1876, at 10 o'clock A. M., for the purpose of canvassing the electoral vote.

The members of the senate of the State of Nebraska assembled in accordance with the foregoing proclamation, at 10 o'clock A. M. in the senate chamber.

The president of the senate being absent and his office vacated, the senate was called to order by the secretary, Daniel H. Wheeler. Mr. Lyon moved that the senate proceed to the election of a president.

The roll was called and there were present:

Messrs. Barton, Burr, Chapman, Fisher, Hoyt, Lamaster and Lyon-7.

Absent

Messrs. Abbott, Bear, Perky and Rustin-4.

A quorum being found present, the motion of Mr. Lyon was agreed to, and the senate proceeded to the election of a president. Mr. Chapman placed in nomination Mr. Barton.

Those voting for Mr. Barton were:

Messrs. Burr, Chapman, Fisher, Hoyt, Lamaster and Lyon-6.
Those voting for Mr. Lyon were:

Mr. Barton-1.

Absent

Messrs. Abbott, Bear, Perky and Rustin-4.

Mr. Barton having received a majority of all the votes of the members, was declared duly elected president of the senate.

On motion of Mr. Hoyt, a committee of two, consisting of Messrs. Hoyt and Lamaster, was appointed to wait upon the secretary of state and request his attendance for the purpose of administering the oath of office to the president elect.

The committee retired, and subsequently returned, accompanied by the secretary of state, who administered the oath of office to Mr. Barton, president elect of the senate.

The president read the proclamation of the governor convening the legislature, in special session.

On motion of Mr. Burr, Messrs. Burr, Lamaster and Lyon were appointed a committee to wait upon the house of representatives and notify that body that the senate was organized and ready to proceed to business.

A committee from the house, consisting of Messrs. Hastings, of Saline, Holmes and Somers, appeared and notified the senate that the house was ready to meet the senate in joint convention.

The following message was received from the house, by Mr. Brown, chief clerk.

Mr. President:

HOUSE OF REPRESENTATIVES,
December 5, 1876.

I am directed by the house to inform your honorable body that the house has appointed a committee, consisting of Messrs. Howe, Davidson and Clark to act with a like committee on part of senate to wait upon his excellency the governor, to inform him that the
