SEPTEMBER 27.

SEPTLMBER 26. Plymouth, Sept. 23. Yesterday, at four o'clock, the Amphion frigate of 32 guns, captain Ifrael Pellew, lafhed alongfide the Princeffa hulk, blew up with a dreadful explosion. The fhock felt was like an earthquake. In a moment the fore part of the thip was fcattered in 10000 fhivers, and nothing but wreck to be feen. There were near 300 men, women, and children on board when this fhocking accident happened. The returns this morn. ing are, captain Pellew, one lieutenant, one purfer, one midshipman, one mate, one boatswain and mate, and 33 feamen and marines faved: feveral of thefe badly wounded. The reft, fhocking to relate, configned to eternity! About 4.2 bodies were picked up, and carried to the bonehoufe of the royal hofpital, and placed in coffins, among which are fix young women. How this accident happened, is as yet unknown. Captain Pellew, captain Swaffield, of the Overyffel of 64 guns, and a lieutenant of the Amphion, were dining together; hearing fome bustle, captain Pellew and the lieutenant ran into the quarter-gallery, and the ship inftantly On Friday the 16th, John Sellers, Eliblew up forward. Captain Pellew was fabeth Jones, and Richard Footner, were blown on the hulk, and the lieutenant into tried for the wilful murder of Thomas the water. Both were faved. Captain Yates. The question on which the whole Pellew wounded in the face, and the lieute-trial, with refpect to Sellers, turned, was,nant in the leg. Poor captain Swaffield, a Mr. Spry, jun. upholder, of Dock, and his fon, were all funk with the wreck. A ferjeant of the North Devon was alfo blown up, with feveral other perfons vifiting their friends, it being the anniversary of his majesty's coronation. The matter, gunner, carpenter, and mates, lieutenant Campbell, of the marines (nephew of colonel Campbell) are among the unfortunate fufferers.

On Wednesday, the 14th inft. at the Old Bailey, Thomas Brown and Matthias Parke, were indicted for forging and uttering a promiffory note for five guineas, dated Rydone, in Shropshire, April 23, 1796, figned Thomas Brown, for Self and Co. payable in London. After a long trial, they found the prifoners guilty-fubject to the opinion of the judges upon a point of law referved.

but guilty of manflaughter; and Elisabeth
Jones and Richard Footner not guilty.

ticularly with respect to the evidence on
which the event of the trial turned, we

it appears as published by authority, when
we shall give an accurate account of it.]

On Saturday, Sept. 17, William Clerk
was indicted for the wilful murder of
Michael Connor, a boy of ten years of
age, by driving over him the Newmarket
mail coach. It appeared in evidence, that
on the 16th of Auguft, the duke of York's
birth-day, a great concourfe of people

Michael Kerley, John Lacey, Benjamin ftreet, and this mail coach came driving

Several witneffes were called to prove that fufficient warning had not been given of the approach of the mail coach; but it was not dearly afcertained whether the noife of the perfons affembled had not

prevented the blowing of the horn from being heard. Several witneffes proved the general good character, fobriety, and good nature of the prifoner. He did not know of the accident having taken place till he was ten miles out of town, and had expreffed much forrow upon the occafion. Mr. Bolton, coachmafter, bore teftimony to the prifoner's character, and likewife faid, that the contractors for the mailcoaches were obliged to reach the place of their destination in a given time, which made it neceffary to drive with great rapidity. Similar teftimony was given by other perfons. The jury withdrew, and were out of court upward of two hours. When they returned, they pronounced the prifoner, not guilty; but the foreman, in the name of them all, faid, they thought that any party driving at the rate at which this coach was driven, would be highly reprehenfible; they fubmitted that opinion to the learned judge, and wifhed to hear a declaration upon that fubject from the bench; for it was a fubject in which a great part of the public was deeply interested. Mr. baron Thompson faid, it was the judgment of the jury to acquit this man. He could not make a stronger obfervation upon the impropriety of this furious driving than had already been made by the jury. The prifoner had been very fortunate, indeeed, in this acquittal. He hoped he would never drive again with the fame fury in the streets. He hoped alfo, that this would be a leffon to others, by which they would be taught to be careful. There was no excufe for fuch driving. The contracts of, individuals were not to fet at defiance the law of the land; nor were the lives of mankind to be put in danger in order to fulfil any contracts. He hoped that in future all mail-coachmen, as well as others, would be cautious how they drive in the public ftreets. The prifoner was then difcharged.

On Monday the 19th, David Scott was found guilty of a rape on Mary Holmwood, a child of twelve years old, on the 26th of May lalt.

This day, the feffions ended, when five capital convicts received fentence of death; 29 were ordered to be tranfported beyond the feas for the term of feven years; 24 to be imprisoned in Newgate; 11 to be imprisoned in the house of correction for the county of Middlefex at Clerken well, four to be fined 1s. each and difcharged; and three to be publicly whipped.

Petty, Robert Simmons, William Chadwich, Michael Robinson, John White, Anthony Chandler, Jofeph Salmon, Alexander Colesworth, John Saunders, James Hardwick alias Auftin, William Miller, William Collins, James Vandercum, James Abbott, John Sharp, John Jacques, Richard Appletree, and Thomas Smith, prifoners who have been capitally convicted, but their judgments respited by his majefty during his royal pleafure, received fentence to be tranfported to the Eastern coast of New South Wales, or fome one or other of the islands adjacent, for the term of their natural lives.

Among the prifoners ordered to be imprifoned in Newgate, is John Sellers, whofe fentence is to be imprifoned fix months, and fined is. The recorder faid, that the prifoner had been tried for the wilful murder of Thomas Yates. That he had been found guilty of manflaughter. The jury had found him a trespasser, who had been guilty of negligence; and very grofs negligence, in the use of a most dangerous weapon. It was much to be lamented that by the indifcretion of any man, fo dangerous a weapon fhould have been fent to a houfe filled with ftrife, the occupiers of which were fo much at variance, and had fhewn a disposition which led to the disturbance of the public peace. To that indifcretion which could not be too much reprobated was to be attributed the crime for which the prifoner had to anfwer. If he had a proper fenfe of his fault, he would never be guilty of a like, offence in future; and he should remember, that if he should commit another manflaughter, the punishment of the law for that offence would be death.

The feflions being ended, the fame was adjourned until Wednefday, the 26th of October.

This day the feffion of parliament was opened by a coinmiffion from his majesty, but no bufinefs, further than fwearing in the members, and choofing a speaker, will be done this week. On Monday evening next, the king's fpeech will be read at the Cockpit, Whitehall, and on Tuesday, his majefty will deliver it from the Throne.
