Mr. President:

STATE OF NEW JERSEY,
ASSEMBLY CHAMBER,

March 10th, 1897.

I am directed by the House of Assembly to inform the Senate that the House of Assembly has passed the following concurrent resolution:

WHEREAS, by an act entitled "An act to authorize a new publication of the public acts of the legislature of this state and a subscription therefor on the part of the state," approved April fourth, one thousand eight hundred and ninety-four, the state treasurer was authorized to subscribe for one thousand sets of the public acts of the legislature of this state, to be compiled and edited by Garret D. W. Vroom and William M. Lanning;

Resolved (the Senate concurring), That the state treasurer, in addition to the persons named in section four of said act, shall also deliver to each of the members of the present legislature, one set of said work; provided, however, that by virtue of this resolution, no member of the present legislature shall be entitled to receive more than the one set of said work by reason of his also having been a member of the legislature of the year one thousand eight hundred and ninety-four, or one thousand eight hundred and ninety-six.

In which the concurrence of the Senate is requested.

Senate Bill No. 176, entitled "An act to amend an act entitled 'An act to more fully carry out and put in force the true intent and purposes of the supplement to an act of congress of August thirtieth, one thousand eight hundred and ninety, and the acts of the legislature of New Jersey of March twenty-fourth, one thousand eight hundred and eighty-one, and the Manual Training act of one thousand eight hundred and eighty-eight, passed May twenty-fifth, one thousand eight hundred and ninety-four,"

Were severally taken up, read a second time, considered by sections, agreed to, ordered to be engrossed, and to have a third reading.

Assembly Bill No. 175, entitled "An act to amend an act entitled 'An act to provide for the establishment of libraries of professional books in the several counties of this state for the use of teachers of the public schools therein," approved March ninth, one thousand eight hundred and ninety-one,

Assembly Bill No. 28, entitled "An act supplemental to an act entitled 'An act relative to the supreme court and circuit courts,' approved March twenty-seventh, one thousand eight hundred and seventy-four, and the supplement to such act approved March ninth, one thousand eight hundred and ninety-three, and also an act to regulate the practice of courts of law on trial of issues in the supreme courts referred and tried by a judge of the circuit court,"

Assembly Bill No. 31, entitled "An act to incorporate patriotic societies,"

And

Assembly Bill No. 60, entitled "An act to provide a uniform procedure for the enforcement of all laws relating to fish, game and birds, and for the recovery of penalties for violations thereof,"

Were severally taken up, read a second time, considered by sections, agreed to, and ordered to have a third reading.

Mr. Ketcham, on leave, introduced

Senate Bill No. 210, entitled "An act to amend an act entitled 'An act authorizing any town, township or borough or part thereof, containing a population exceeding five thousand inhabitants, to be incorporated as a city, after a vote of the people, and providing for the government and powers of such cities,' approved March twentysecond, one thousand eight hundred and ninety-five, making the same applicable to cities incorporated since January first, one thousand eight hundred and ninety-seven, and to such cities already incorporated as desire to avail themselves of its provisions,"

Which was read for the first time by its title, ordered to have a second reading, and referred to the Committee on Boroughs and Borough Commissions.

The same Senator, on leave, introduced

Senate Bill No. 211, entitled "A supplement to an act entitled 'An act authorizing any town, township or borough or part thereof, containing a population exceeding five thousand inhabitants to be incorporated as a city after a vote of the people, and providing for the government and powers of such cities,'" approved March twentysecond, one thousand eight hundred and ninety-five, making the same applicable to districts including more than one municipality,

Which was read for the first time by its title, ordered to have a second reading, and referred to the Committee on Boroughs and Borough Commissions.

Mr. Skirm moved to recommit

Senate Bill No. 50, entitled "An act authorizing corporations created by special charters, or otherwise, to remove their principal office from the place designated in their charters to such other place in New Jersey as may be deemed best by the corporations,"

To the Committee on Corporations,

Which was agreed to.

Mr. Voorhees, on leave, introduced

Senate Bill No. 212, entitled "A supplement to an act entitled ‘An act respecting the orphans' court and relating to the powers and duties of the ordinary and the orphans' court and surrogates,"" approved March twenty-seventh, one thousand eight hundred and seventy-four (General Statutes, page two thousand three hundred and fifty-three, Revision of one thousand eight hundred and seventy-seven, page seven hundred and fifty-one),

Mr. Voorhees moved that the rules be suspended and that

Senate Bill No. 212, entitled "A supplement to an act entitled 'An act respecting the orphans' court and relating to the powers and duties of the ordinary and the orphans' court and surrogates,'" approved March twenty-seventh, one thousand eight hundred and seventy-four (General Statutes, page two thousand three hundred and fifty-three, Revision of one thousand eight, hundred and seventy-seven, page seven hundred and fifty-one),

Be placed on second reading without reference,

Which was agreed to.

Said bill was then taken up, read a second time, considered by sections, agreed to, ordered to be engrossed and to have a third reading.

Mr. Parry, for Mr. Engle, Chairman of the Committee on Game and Fisheries, reported

Senate Bill No. 165, entitled "An act for the better protection and preservation of the oyster industry in the creeks and rivers along the shores of Delaware bay and Maurice river cove,"

With amendment,

Which was read and adopted.

Was taken up on second reading.

Mr. Ross moved to amend

Senate Bill No. 165, entitled "An act for the better protection and preservation of the oyster industry in the creeks and rivers along the shores of Delaware bay and Maurice river cove,"

As follows:

Amend Senate 165, section 2, line 4, by striking out the word "and", changing the comma after the word Newport to a semicolon, and inserting after the word "Newport" and before the word "be" the following, "Burton Howell, of Dias creek, and Reeves Douglass of Dias creek."

Amend Senate No. 165, section 15, by adding at the close of section, the following: "Provided, that the provisions of this act shall in no wise affect or impair any rights, privileges or property which previous to the passage of this act have been acquired under an act entitled "An act for the preservation of clams and oysters," passed the fourteenth day of April, one thousand eight hundred and forty-six, which said supplement was approved March ninth, one thousaud eight hundred and fifty-five.

Amend Senate 165, section 10, line 4, by inserting between the word "act" and the word "for" the words, "excepting upon the beds at the mouth of and in Maurice river."

Which amendments were adopted.

Senate Bill No. 165, entitled "An act for the better protection and preservation of the oyster industry in the creeks and rivers along the shores of Delaware bay and Maurice river cove,"

Was then taken up, read a second time, considered by sections, agreed to, ordered to be engrossed, and to have a third reading.

Mr. Daly moved that said bill be reprinted with the amendments, Which motion was non-concurred in.

The Senate then adjourned.

At 10:45 o'clock A. M. the Senate met.

The session was opened by prayer by the Rev. A. M. Palmer, Newark.

Senate Bill No. 192, entitled "A further supplement to an act entitled 'A further supplement to an act entitled "An act concerning cities of the first class in this state, and constituting municipal boards of street and water commissioners therein and defining the powers and duties of such municipal boards, and relating to municipal affairs and departments of such cities placed under the control and management of such boards and providing for the maintenance of the same,' approved March twenty-eighth, one thousand eight hundred and ninety-one, passed May twenty-fifth, one thousand eight hundred and ninety-four,

Senate Bill No. 195, entitled "An act to enable cities of this state, under certain circumstances, to vacate portions of streets and alleys which have not been opened to public use,"

And

Senate Bill No. 194, entitled "An act relating to outstanding bonds in cities of this state, where the board or body issuing the same has been abolished and no provision is made by law for the transfer and registry of bonds issued by such former board or body of such city," Without amendment;
