Preamble.

CHAPTER CV.

AN ACT to legalize ordinance numbered 63, passed by the Trustees of the town of Edinburg, in Johnson county, Indiana, on the 22d day of March 1879, defining the corporate limits and boundary of said town; and defining the number and boundaries of the wards of said town, and fixing the voting places therein; and to legalize the election held in the town of Edinburg aforesaid, held therein on the first Monday in May, in the year 1880; and to legalize the official acts of the Board of Trustees, and all other officers of said town, elected at said election at the time aforesaid, under “An act for the incorporation of towns, defining their powers, providing for the election of officers therefor, and defining their duties;" approved June 11, 1852. And to legalize all by-laws, ordinances, rules, regulations, tax levies and all other official acts and proceedings of said Board of Trustees, and other officers of said town adopted in pursuance thereof, ap. proved June 11, 1852, and declaring an emergency.

WHEREAS, Said town of Edinburg was duly and legally incorporated, under and by virtue of an act of the Legislature of the State of Indiana, authorizing the incorporation of towns and authorizing the election of officers, and prescribing their duties and powers, approved June 11, 1852. Excepting that the incorporators of said town failed to define the boundary and corporate limits of said town by any by-law, ordinance or other record; and,

WHEREAS, The trustees of said town of Edinburg, then acting, did, on the 22d day of March, in the year 1879, by an ordinance numbered 63, define the corporate limits and boundary of said town of Edinburg, and the number and boundaries of the wards of said town and the voting places therein; and,

WHEREAS, The Board of Trustees of said town of Edinburg, then acting, held their election on the first Monday in May, of the year 1880, for the election of Trustees, Marshal, Clerk and Treasurer for said town, for the term next thereafter; which said election was in all things regular and legal, with the exception that the inspectors of said election failed to file a certificate over their signatures with the Clerk of the Johnson Circuit Court, within ten days next after such election, showing who were elected to fill the various offices of said town; and,

WHEREAS, The Trustees and other officers of said town so elected at said election, were, at the proper time, duly

qualified as such, and, at the proper time, they, as well as all the other officers of said town, took possession of, and have ever since been fulfilling the duties of their said offices respectively; and,

WHEREAS, The Trustees of said town of Edinburg, acting as such by virtue of said election for the year 1880, as aforesaid, have appointed their Attorney, five Wardens, Street Commissioners, and other subordinate officers, and have accepted and approved the bonds of their Marshal, Attorney and Treasurer, and levied taxes for town and school purposes, and from time to time have passed ordinances and orders for the improvement of streets and sidewalks, and have made orders allowing claims for improvements and other corporate purposes, including the payment of school house bonds, and the interest thereon, and have caused orders to be drawn on the Treasurer of said town, and the money to be paid on such orders therefor, and have caused the tax duplicate to be made out for the collection of the taxes levied for the year 1880, and they have elected a School Trustee for the school town of Edinburg;

SECTION 1. Now, therefore, be it enacted by the General Legalizing or Assembly of the State of Indiana, That ordinance numbered nance, elec63, ordained and passed by the trustees of the town of Edin- of officers. burg, in Johnson county, Indiana, on the 22d day of March, 1879, defining the boundary and corporate limits of the town of Edinburg, and the wards and numbers thereof, as well as the municipal election held in said town of Edinburg, in Johnson county, in the State of Indiana, in the year 1880, as aforesaid, is hereby legalized and made valid, and all ordinances, orders, elections, appointments, and all other official acts ordained, made, done, and passed and performed by said Board of Trustees, and other officers of said town, elected or appointed during the year aforesaid, including all laws, ordinances, and assessments of taxes for school, school-house and all other purposes, as well as any and all orders passed therefor, and the payment of all claims and demands against said town; and the election of School Trustees therefor, and their official acts as such, are hereby legalized and made valid to all intents and purposes: And provided further: That all ordinances, by-laws, rules and regulations of said Trustees, of said town, passed, ordained, and done by said Board of Trustees during said year 1880, as well as said ordinance numbered 63, as aforesaid, shall be received and admitted as competent evidence in all Courts, for all purposes whatsoever for which they may be

required, and in regard to the official acts of all the officers of said town, elected or appointed during the year 1880, and the same are hereby legalized.

SEC. 2. And there is an emergency declared for the immediate taking effect of this act, and it is hereby declared that the same shall be in full force and effect from and after its passage.

NOTE. This bill was presented to the Governor March 24, 1881, and not having been returned by him to the House of Representatives, in which it originated, within three days, Sunday excepted, after it was presented to him, it has become a law without his signature.

CHAPTER CVI.

AN ACT to legalize the incorporation of the town of Geneva, in the county of Adams, and the State of Indiana, and to legalize the official acts of the Board of Trustees of said town of Geneva.

[APPROVED APRIL 7, 1881.]

SECTION 1. Be it enacted by the General Assembly of the ters connected State of Indiana, That all irregularities in the matter of the incorporation of the town of Geneva, in the county of Adams, and State of Indiana, and in relation to the original acts in the incorporation of said town, the surveys, the taking of the census, the application for the incorporation, the verification of the census, surveys and all matters connected therewith, the notice of the meeting, the submission of the question to the voters, the election of the officers, and all other matters connected with the incorporation of said town of Geneva, be and the same are hereby legalized.

SEC. 2. That all acts and parts of acts and all ordinances concerning streets, sidewalks, alleys, grading, and improvement thereof, and all other acts and ordinances of the Board of Trustees of said town of Geneva, of whatsoever nature, are hereby legalized and made valid as fully and completely as though the records, plats and all things pertaining to the original incorporation were properly and legally made and done at the time of said incorporation, and that all levies and assessments of taxes heretofore made by the Board of Trustees at any time since the incorporation of said town, or other officers of said town for school and corporation purposes, are hereby legalized.

SEC. 3. SEC. 4. SEC. 5. Whereas, there is great doubt as to the legality Emergency. of the aforesaid incorporation of said town of Geneva, and to the official acts of her officers, and all public improvements are delayed and officers becoming liable for the enforcement of ordinances, an emergency exists for the immediate taking effect of this act, therefore this to be in force from and after its passage.

CHAPTER CVII.

AN ACT to legalize the incorporation of the town of Argos, in Marshall county, in the State of Indiana, and to legalize the official acts of the several Boards of Trustees of said town, and of the official acts of each and every officer of said town, defining their powers and declaring their duties under act approved June 11, 1852, and all ordinances and proceedings adopted in pursuance thereof, and declaring an emergency.

WHEREAS, the town of Argos, in Marshall county, In- Preamble.

and all the by-laws, rules, regulations and proceedings
adopted in pursuance thereof; and

WHEREAS, certain portions of the records of the incorpor-
ation of said town have been lost or destroyed, the
same causing some doubt as to the legality of said in-
corporation and of the proceedings of the several Boards
of Trustees and other officers of said town; and

WHEREAS, the several Boards of Trustees, have from time to time, levied taxes in pursuance of said acts, for school and other purposes, a portion having been applied to the purchase of lands and the building of school houses thereon, and have from time to time passed ordinances regulating the grading, graveling and draining the streets in said town, and the improvement of sidewalks, the validity of which is in doubt on the acccunt, as before stated, therefore,

SECTION 1. Be it enacted by the General Assembly of the State of Indiana, That all acts and parts of acts for the incorporation of the town of Argos, in Marshall county, State of Indiana, are hereby legalized and rendered valid, and that all ordinances and other proceedings for the purchase of lands and the building of school houses thereon, or for the improvement of school property, and all ordinances for the improvement of streets, side walks, or alleys, or for the assessment and collection of taxes, and all of the official acts of the several Boards of Trustees, and other officers of said town of Argos, are hereby legalized and rendered valid.

SEC. 2. An emergency exists for the immediate taking effect of this act, and it shall, therefore, take effect and be in force from and after its passage.

CHAPTER CVIII.

AN ACT to extend the terms of office of Town Trustees in all incorporated towns, designating the manner in which they shall be chosen at the next ensuing May election and thereafter, and prescribing some of their duties.

[APPROVED MARCH 25, 1881.]

SECTION 1. Be it enacted by the General Assembly of the State of Indiana, That at the next ensuing May election to be held for the election of town officers, as now provided by law, the Town Trustees shall be chosen in the following manner, to hold their offices for the time herein set forth. In a town where there are three Trustees to be elected, the person receiving the greatest number of votes shall hold his office for two years from and after said election, and the two other persons receiving the next greatest number of
