The bill (No. 3) entitled "An act to amend the Tax Law, in relation to the taxation of public franchises as real property" (Int. No. 1), was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the necessity for the immediate passage of the same having been certified by the Governor pursuant to the provisions of section 15 of article 3 of the Constitution, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

No. 3) entitled "An act making an appropriation for the state board of tax commissioners. for the compensation of needed assistants in its office and for other expenses."

ALBANY, May 25, 1899.

I recommend for your consideration an amendment of section 37 of the State Finance Law, as added by chapter 580 of the Laws of 1899, changing the date of the payment to the State Treasurer of the moneys therein specified, and also providing that the section shall not apply to the manufacturing fund of the State prisons. known as the capital fund.

Mr. Higgins, from the committee on finance, reported a bill entitled "An act to amend the State Finance Law, in relation to the manufacturing funds of the state prisons" (Int. No. 4), and recommended the passage of the same, which report was agreed to.

On motion of Mr. Higgins, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

A message from the Governor, at the hands of his secretary, was received and read in the words following:

Mr. Raines offered the following:

Resolved (if the Assembly concur), That a joint committee of the Senate and Assembly be appointed, to consist of two Senators to be designated by the President of the Senate, and three members of Assembly to be designated by the Speaker thereof, whose duty it shall be to confer and co-operate with the Governor, with reference to arrangments for the proposed celebration in the city of New York in honor of Admiral Dewey, and the participation therein by the State of New York.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, as follows:

Ordered, That the Clerk deliver said resolution to the Assembly,

and request their concurrence therein.

Mr. Raines moved that the Senate stand in recess until 4 o'clock p. m.

Mr. Thornton moved to amend by striking out "4" and inserting "5," in lieu thereof.

The President put the question whether the Senate would agree to said amendment, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to said motion as amended, and it was decided in the affirmative.

FIVE O'CLOCK P. M.

The Senate again met.

The Assembly returned the concurrent resolution for the appointment of a joint committee to confer with the Governor with reference to arrangements for celebration of the return of Admiral Dewey, with a message that they have concurred in the passage of
