The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative. Ordered, That the Clerk deliver said-resolution to the Assembly, and request their concurrence therein..

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

The Assembly sent for concurrence a resolution, in the words following:

Resolved (if the Senate concur), That a respectful message be sent to the Governor, requesting the return to the Assembly of Assembly bill No. 647, entitled "An act for the relief of the Isabella Heimath" (Rec. No. 548), for the purpose of transmitting to the mayor of the city of New York.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative. Ordered, That the Clerk return said resolution to the Assembly, with a message that the Senate have concurred in the pas sage of the same.

The Assembly returned the following entitled bills, with a message that they have concurred in the passage of the same:

"An act to amend chapter 378 of the Laws of 1897, entitled 'An act to unite into one municipality, under the corporate name of the city of New York, the various communities lying in and about New York harbor, including the city and county of New York, the city of Brooklyn and the county of Kings, the county of Richmond and part of the county of Queens, and to provide for the government thereof,' relative to the department of education." (No. 1367, Int. No. 914.)

Ordered, That the Clerk transmit said bill to the mayor of the city of New York, for a hearing pursuant to the provisions of the Constitution.

"An act to authorize the city of Buffalo to issue bonds for the purpose of abating all nuisance existing in the Main and Hamburg street canal, and to fill the prism of said canal with solid material." (No. 1354, Int. No. 977.)

"An act to amend subdivision 7 of section 17 of chapter 105 of the Laws of 1891, entitled 'An act to revise the charter of the

city of Buffalo,' relating to licensing stationary engineers." (No. 1369, Int. No. 875.)

“An act to authorize the city of Buffalo to sell and convey the Main and Hamburg, street canal and the lands and premises included therein and connected therewith, or any part or parts. thereof." (No. 1353, Int. No. 976.)

Ordered, That the Clerk transmit said bills to the mayor of the city of Buffalo, for a hearing pursuant to the provisions of the Constitution.

“An act to amend section 894 of chapter 378 of the Laws of 1897, commonly known as the Greater New York Charter, relative to taxation on personal property." (No. 1382, Int. No. 989.)

Ordered, That the Clerk deliver said bills to the Governor. The Assembly returned the concurrent resolution (No. 631) entitled "Concurrent resolution of the Senate and Assembly pro

posing an amendment to article 8, section 10 of the Constitution, in relation to counties, cities, towns and villages, giving or loaning money or credit and limitation of their indebtedness" (Int. No. 357), in the words following, with a message that they have concurred in the passage of the same:

Whereas, the legislature at its regular session in eighteen hundred and ninety-seven, duly adopted a resolution providing for an amendment to the constitution, in relation to counties, cities, towns and villages giving or loaning money or credit and limitation of their indebtedness; and which resolution was referred to the legislature to be chosen at the next general election of senators, and directed to be published in accordance with section one of article fourteen of the constitution; and

Whereas, such resolutions have been duly published in accordance with law and the constitution and referred to this legis lature for action; therefore,

Section 1. Resolved, (if the assembly concur), that section ten, article eight, of the constitution be amended so as to read as follows:

§ 10. Counties, cities and towns not to give or loan money or credit; limitation of indebtedness.-No county, city, town or village shall hereafter give any money or property, or loan its money or credit to or in aid of any individual, association or corporation, or become directly or indirectly the owner of stock in. or bonds of, any association or corporation; nor shall any such county, city, town or village be allowed to incur any indebtedness except for county, city, town or village purposes. This section shall not prevent such county, city, town or village from making such provision for the aid or support of its poor as may be authorized by law. No county or city shall be allowed to become indebted for any purpose or in any manner to an amount which, including existing indebtedness, shall exceed ten per centum of the assessed valuation of the real estate of such county or city subject to taxation, as it appeared by the assessment-rolls of said county or city on the last assessment for state or county taxes prior to the incurring of such indebtedness; and all indebtedness in excess of such limitation, except such as may now exist, shall be absolutely void, except as herein otherwise provided. No county or city whose present indebtedness exceeds ten per centum of the assessed valuation of its real estate subject to taxation, shall be allowed to become indebted in any further amount until such indebtedness shall be reduced within such limit. This section shall not be construed to prevent the issuing of certificates of indebtedness or revenue bonds issued in anticipation of the collection of taxes for amounts actually contained, or to be contained in the taxes for
