Mr. Brackett moved that the Senate concur in said amendment. The President put the question whether the Senate would concur in said amendments, said bill having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present as follows:

The bill (No. 1379) entitled "An act to amend chapter 908 of the Laws of 1896, entitled 'An act in relation to taxation,' constituting chapter 24 of the general laws" (Int. No. 116), having been announced for a third reading,

Mr. Krum moved that said bill be recommitted to the committee on taxation and retrenchment, retaining its place on the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. A message from the Assembly was received and read in the words following:

IN ASSEMBLY, April 18, 1899.

Pursuant to concurrent resolution of the Senate and Assembly, the Governor returned the Assembly bill (No. 2280) entitled "An act for the relief of the village of Pleasantville, in the county of Westchester." (Rec. No. 81.)

The vote upon the final passage of said bill having been reconsidered, on motion of Mr. Apgar, said bill was recommitted to the

committee on affairs of villages, with instructions to report the same forthwith, amended as follows:

"Section 1. The supervisor of the town of Mount Pleasant, in the county of Westchester, is hereby authorized and directed to pay to the village treasurer of the village of Pleasantville in the county of Westchester, out of the taxes, fines and penalties received by the said supervisor, after the passage of this act, under the liquor tax law, from the county treasurer of the county of Westchester, the sum of five hundred dollars in payment of moneys received by the said town of Mount Pleasant for highway taxes imposed upon the property in the corporate limits of the village of Pleasantville, for the year eighteen hundred and ninetysix, and not used upon the highways of said village, such moneys. to be held by the said village treasurer and used by him for the repair and maintenance of the highways in the said village, subject to the order of the board of trustees of said village. "§ 2. This act shall take effect immediately."

Said bill, as amended, was read the third time and passed, having been printed and upon the desks of the members in its final form at least three calendar legislative days prior to its final passage.

A communication from the Governor, was received and read, in the words following:

I hereby nominate as members of the board of general managers of the exhibit of the State of New York at the Pan-American Exposition of 1901, pursuant to the provisions of chapter 36 of the Laws of 1899: Daniel T. Lockwood, of Buffalo, who is also hereby designated as president of said board of general managers; Jacob Amos, of Syracuse; Gaius C. Bolin, of Poughkeepsie; Nicholas V. V. Franchot, of Olean; William H. Gelshenen, of New York city; Frederick Greiner, of Buffalo; John T. Mott, of Oswego; Leopold Stern, of New York city, and George E. Vost, of Theresa.

Ordered, That said communication be referred to the committee on finance.

The Assembly returned the bill (No. 1401, Senate reprint No. 1267) entitled "An act to amend 'The Greater New York Charter,' relative to costs and charges of commissioners" (Rec. No. 228), with a message that they have non-concurred in the amendments of the Senate thereto, and request the appointment of a committee of conference thereon.

Mr. Mitchell moved that a committee of conference be appointed on the part of the Senate.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The President appointed as such committee, on the part of the Senate, Messrs. Stranahan, Elsberg and Mitchell.

Ordered, That the Clerk return said bill to the Assembly, with a message that the Senate have agreed to an appointment of a committee of conference thereon.

Mr. Ellsworth gave notice that at some future day he would move to suspend Senate Rules Nos. 1, 4, 9, 12, 15, 19, 31 and 45 for the purpose of reading, passing and transmitting to the Assembly, out of its order, Senate bill No. 1414, entitled “An act to create and establish a uniform police system for cities of the first and second class throughout the State." (Int. No. 999.)

Mr. Goodsell, from the committee on affairs of villages, to which was referred the Assembly bill introduced by Mr. Henderson, Rec. No. 617, entitled "An act to amend chapter 818 of the Laws of 1868, entitled 'An act to incorporate the village of Port Chester'" (No. 2197), reported in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Goodsell, from the committee on affairs of villages, to which was referred the bill introduced by Mr. Brackett, Int. No. 1003, entitled "An act to amend chapter 220 of the Laws of 1866, entitled 'An act to amend the charter of the village of Saratoga Springs and the several acts amendatory thereof,' passed March 26, 1866" (No. 1421), reported in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Goodsell, from the committee on affairs of villages, to which was referred the Assembly bill introduced by Mr. Henderson, Rec. No. 566, entitled "An act to authorize the paving or macadamizing of streets, avenues, highways and public places in the village of Port Chester, Westchester county, and to provide for the payment of the expense of the same " (No. 2118), reported in favor of the passage of, the same, which report was agreed to.

On motion of Mr. Graney, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Mr. Stranahan, from the committee on affairs of cities, to which was referred the Assembly bill introduced by Mr. DeGraw, Rec. No. 136, Senate reprint No. 1350, entitled "An act for the relief of certain former clerks and attendants of the County Court of Kings county; for compensation in defending their title, etc." (No. 684), reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. D. F. Davis, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Mr. Stranahan, from the committee on affairs of cities, to which was referred the Assembly bill introduced by Mr. Murphy, Rec. No. 281, entitled "An act to create a board of police commissioners for the city of Amsterdam" (No. 1367), reported in favor of the passage of the same, with some amendments, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Stranahan, from the committee on affairs of cities, to which was referred the Assembly bill introduced by Mr. Sabine, Rec. No. 502, entitled "An act to authorize the city of Syracuse to provide for an investigation of the sources of heat and light supply for said city for public, mechanical and domestic uses, and the expediency of owning and controlling its heat and light supply" (No. 1843), reported in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Stranahan, from the committee on affairs of cities, to which was referred the Assembly bill introduced by Mr. Dillon, Rec. No. 73, entitled "An act reducing the tax payable by the Manhattan East Side Mission of the city of New York, for the year 1895" (No. 423), reported in favor of the passage of the same, which report was agreed to.

On motion of Mr. Grady, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.
