The Assembly returned the following entitled bills, with a message that they have concurred in the passage of the same:

"An act to amend chapter 596 of the Laws of 1898, entitled 'An act to organize and establish a police department for the city of Yonkers,' and the acts amendatory thereof." (No. 1011, Int. No. 839.)

"An act to amend chapter 397 of the Laws of 1881, entitled 'An act in relation to the public schools in the city of Yonkers."" (No. 261, Int. No. 256.)

Ordered, That the Clerk transmit said bills to the mayor of the:

city of Yonkers for a hearing, pursuant to the provisions of the Constitution.

"An act to amend section 518 of chapter 378 of the Laws of 1897, entitled 'An act to unite into one municipality, under the corporate name of the city of New York, the various communities lying in and about New York harbor, including the city and county of New York, the city of Brooklyn and county of Kings, the county of Richmond and part of the county of Queens, and to provide for the government thereof,' relating to the aqueduct commissioners." Ordered, That the Clerk transmit said bill to the mayor of the city of New York for a hearing, pursuant to the provisions of the Constitution.

The Assembly returned the following entitled bills:

"An act to amend the Town Law in relation to the licensing of hawkers and peddlers, as amended by chapter 538 of the Laws of 1898." (No. 691, Int. No. 404.)

"An act to authorize the board of supervisors in any county where proceedings have been instituted under the provisions of -chapter 493 of the Laws of 1862, entitled 'An act to provide for the construction of highways and bridges upon highways running through two or more towns of the same county,' to investigate the affairs and conduct of commissioners appointed under said act.” (No. 328, Int. No. 318.)

"An act to amend chapter 672 of the Laws of 1898 in relation to expenditures for the National Guard and Naval Militia." (No. 608, Int. No. 556.)

The Assembly returned the following entitled bills, with a message that they have concurred in the amendments of the Senate thereto :

"An act to confer jurisdiction upon the Court of Claims to hear, audit and determine the alleged claim of Abiel B. Parks against the State for damages alleged to have been sustained by him, and to render judgment therefor." (No. 227, Rec. No. 383; Senate reprint No. 1168.).

"An act making an appropriation for the Craig Colony for Epileptics." (No. 1315, Rec. No. 278; Senate reprint No. 1233.) Ordered, That the Clerk return said bills to the Assembly. The bill (No. 1088) entitled "An act to amend chapter 565 of the Laws of 1895, entitled 'An act to incorporate the city of Little Falls,' and the acts amendatory thereof" (Int. No. 249), was returned by the mayor of the city of Little Falls, with a certificate that a public hearing had been duly held on said bill in pursuance of law, and that the mayor and local legislative body had duly accepted. the same.

Ordered, That the Clerk deliver said bill to the Governor.

Mr. Malby, from the committee on codes, to which was referred the bill introduced by Mr. Armstrong (No. 1304), entitled "An act to amend subdivision 2 of section 636 of the Code of Civil Procedure, relative to warrants of attachment" (Int. No. 958), reported in favor of the passage of the same, which report was agreed to. On motion of Mr. Malby, and by unanimons consent, the rules. were suspended and said bill ordered to a third reading.

Mr. D. F. Davis, from the committee on military affairs, to which was referred the Assembly bill introduced by Mr. Henry, Rec. No. 271, entitled "An act to amend chapter 212 of the Laws of 1898, entitled 'An act in relation to the militia, constituting chapter 16 of the general laws'" (No. 1296), reported in favor of the

passage of the same, with some amendments, which report was agreed to..

On motion of Mr. G. A. Davis, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

The Assembly bill (No. 1872) entitled "An act to amend chapter 58 of the Laws of 1890, entitled 'An act to incorporate the city of Corning,' and the acts amendatory thereof and supplemental thereto" (Rec. No. 510), was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:
