4, 9, 12, 15, 19, 31 and 45 be suspended for the purpose of reading, passing and transmitting to the Assembly the Assembly bill (No. 1114) entitled "An act to authorize the construction of a bridge over the East river, in the city of New York, and to provide for the use thereof by railroad companies, bicyclists, trucks, carriages and foot passengers." (Rec. No. 302.)

The President put the question whether the Senate would agree to said resolution, and it was decided in the negative, as follows:

The Clerk furnished a list of absentees to the Sergeant-atArms, who appeared in due time before the bar of the Senate with Mr. D. F. Davis, who, upon giving satisfactory explanation for being absent, was excused.

Mr. Marshall moved that all further proceedings under the call of the Senate be suspended.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Marshall offered the following:

Resolved, That pursuant to the notice heretofore given, rules 1, 4, 9, 12, 15, 19, 31 and 45 be suspended for the purpose of reading, passing and transmitting to the Assembly the Senate bill (No. 138) entitled "An act to amend chapter 378 of the Laws of 1897, being the Greater New York charter.'" (Int. No. 138.)

The President put the question whether the Senate would agree to said resolution, and it was decided in the negative, as follows:

Mr. Raines offered the following:

Resolved, That the committee of the whole be discharged from the further consideration of the bill (No. 676) entitled "An act to amend chapter 909 of the Laws of 1896, entitled 'An act in relation to the elections, constituting chapter 6 of the general laws,' and the several acts amendatory thereof " (Int. No. 608), be ordered to a third reading for amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. Raines moved that said bill be recommitted to the committee on the judiciary, with instructions to said committee to report the same forthwith amended as follows:

Page 1, line 4, after the word "thirty-five" insert the words "of the."

Page 3, line 21, after the word "disqualification" insert the words "resignation, declaration or withdrawal of the saine by the person or persons submitting the same."

Page 4, line 1, prefix the words "or other person."

Same page, line 9, change the word "officers" to "officer.” Same page, line 10, insert the word "of" before the word "any."

Page 5, line 1, strike out the word "act" and insert the word "list."

Mr. Brackett, from the committee on the judiciary, reported said bill amended as directed, and the same was ordered reprinted and recommitted to the committee of the whole.

Mr. Brown offered the following:

Resolved, That the committee of the whole be discharged from the further consideration of Assembly bill (No. 1782) entitled "An act to amend the Fisheries, Game and Forest Law, and the acts amendatory thereof, relative to fishing in Lake Ontario in Oswego county" (Rec. No. 436), and that the same be ordered recommitted to the committee on forest, fish and game laws for a rehearing.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. White gave notice that at some future day he will move to suspend Senate rules Nos. 1, 4, 9, 12, 15, 19, 31 and 45 for the purpose of reading, passing and transmitting to the Assembly out of its order Senate bill No. 1156, entitled "An act to amend subdivision 3 of section 32 of chapter 909 of the Laws of 1896, known as the Election Law, as amended by section 8 of chapter 379 of the Laws of 1897, relating to the printing of lists of registered persons."

The Senate bill (No. 68) entitled "An act to ratify the opening of Wadsworth avenue, from Kingsbridge road, near One Hundred and Seventy-third street, to Eleventh avenue, in the Twelfth ward of the city of New York, borough of Manhattan, and to provide for the cancellation and refunding a part of the assessments for acquiring title thereto" (Int. No. 68), was returned by the mayor of the city of New York with a certificate that a public hearing had been duly held on said bill in pursuance of law, and that the mayor had not accepted the same.

Ordered, That said bill and accompanying message be laid upon the table.

Mr. Rice offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor requesting the return to the Senate of Senate bill No. 800, entitled "An act to authorize the board of trustees of the village of Catskill to issue bonds and sell the

same, and with the proceeds to purchase land and erect thereon a building or buildings for the use of said village" (Int. No. 700), for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative Ordered, That the Clerk deliver said resolution to the Assembly, and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Mr. Ambler offered the following:

Resolved, That the committee of the whole be discharged from the further consideration of Assembly bill, No. 1536, entitled "An act to amend chapter 955, Laws of 1896, relating to the protection and education of farmers and manufacturers in the purchase and sale of fertilizers" (Rec. No. 316), and that the same be ordered recommitted to the committee on agriculture for a hearing.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative. Mr. Ellsworth moved that the Senate take a recess until 4.30 o'clock p. m.

Mr. Ford introduced a bill entitled "An act conferring upon the Board of Claims jurisdiction to hear, audit and determine the claim of Henri D. Dickinson against the State and to make an award therefor " (Int. No. 961), which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Ford, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading and printed and referred to the committee on the judiciary, retaining its place on the order of third reading.

Mr. Grady introduced a bill entitled "An act to amend the General Corporation Law in relation to the salaries of officers (Int. No. 962), which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Grady, and by unanimous consent, the rules were suspended, and said bill ordered to a third reading and printed and referred to the committee on the judiciary, retaining its place on the order of third reading.

Mr. White introduced a bill entitled "An act to confer jurisdiction upon the Court of Claims to hear, audit and determine the claim of John Moore against the State for extra work performed and extra materials furnished in the construction of State building, and ratifying the employment of said John Moore in relation thereto (Int. No. 963), which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. White, and by unanimous consent the rules were suspended, and said bill ordered to a third reading and printed and referred to the committee on the judiciary, retaining its place on the order of third reading.

Also, a bill entitled "An act to reappropriate the unexpended balance of the appropriation for the drainage and sewerage system and the stream mains and conduits and the water system at Bedford" (Int. No. 964), which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. White, and by unanimous consent the rules were suspended, and said bill ordered to a third reading and printed and referred to the committee on finance, retaining its place on the order of third reading.

Mr. Elsberg introduced a bill entitled "An act regarding the title of purchasers or incumbrances of real property sold to guardians in socage under judgments in actions for the partition of such property" (Int. No. 965), which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on codes.

The Assembly sent for concurrence the following entitled bills: "An act to amend the State Charities Law, in relation to the powers of the State Board of Charities" (No. 1914, Rec. No. 507),
