PER CURIAM. Guilty as charged. Sentence, $250 fine and 10 days' imprisonment, and costs of suit, and to stand committed until fine and costs are paid.

DAVIS and SHAUCK, JJ., are of opinion that the term of imprisonment is too short, in view of the gravity of the offense, and that, in view of the doctrine of Hale v. State, 55 Ohio St. 210, 45 N. E. 199, 36 L. R. A. 254, 60 Am. St. Rep. 691, the power of the court in that regard is not restricted by any valid statute. SPEAR, J., absent.

PER CURIAM. This was an action on the case against the appellee for damages alleged to have been sustained by the plaintiffs by the elevation of the tracks of appellee's railroad, adjoining appellants' said premises in the city of Chicago. The right of way of the company and the premises of appellants are parts of the same 80-acre tract, and the facts are in substance the same as were involved in Kotz v. Railroad Co., 188 Ill. 578, 59 N. E. 240. The same questions involved here were fully considered and decided in that case. That decision, and the reasons given for it, must control the decision of this case, and the judgment appealed from will therefore be affirmed. Judg ment affirmed.
