voiced their opposition. More than 300 law professors and deans joined

together in a statement opposing the amendment. Grass-roots communications in opposition to the proposal swelled to equal those in favor.

On November 8 the petition to discharge the Judiciary Committee from further consideration of H.J. Res. 191 was adopted by the House, 242-156. By voice vote the House then adopted an amendment offered by Rep. Buchanan (D.-Ala.) substituting the word "voluntary" for "nondenominational" and adding "meditation" as a permissible activity--an amendment that its sponsors thought would answer the primary arguments against the resolution and would eliminate the danger that a State might prescribe religious activity. On final passage, however, the House voted in favor, 240-162--twenty eight votes short of the 35/ necessary two-thirds majority of the 402 members voting.

No further votes have occurred in either the House or the Senate

on proposals to overturn the decisions in Engel and Abington. In 1974 Sen. Helms (R.-N. Car.) introduced an alternate means of addressing the issue, namely, a bill to remove jurisdiction over the issue from the Federal courts. This approach would not directly render State-sponsored prayer in the public schools constitutional but would simply leave decisions as to its constitutionality in the State courts rather than the Federal courts. No floor votes or committee hearings have been had on this proposal since its introduction.
