There is published below for your information and guidance Treasury Department Order No. 165-9 dated August 13, 1958. It will be noted that the Order shall be effective January 1, 1959.

TREASURY DEPARTMENT ORDER NO. 165-9

Transfer and delegation to the Commissioner of Customs of authority to allow drawback of internal revenue tax on domestic alcohol under section 313(d) of the Tariff Act of 1930, as amended

Treasury Department,

Washington, D. C., August 13, 1958.

By virtue of the authority vested in me by Reorganization Plan No. 26 of 1950 (3 CFR, 1950 Supp., Ch. III) there is hereby transferred from the Commissioner of Internal Revenue and delegated to the Commissioner of Customs the function, authorized by section 313(d) of the Tariff Act of 1930, as amended (19 U.S.C. 1313(d)), of allowing the drawback of an amount equal to the internal revenue tax found to have been paid on domestic alcohol used in the manufacture or production in the United States of flavoring extracts and medicinal or toilet preparations (including perfumery) that have been exported.

The function herein transferred and delegated may be delegated by the Commissioner of Customs to other officers or employees of the Customs Service in such manner as the Commissioner shall direct.

This Order shall be effective January 1, 1959.

Delegation to the Commissioner of Customs of function of publishing notice in the Federal Register required by section 201(b) of the Antidumping Act, 1921, as amended

III), there is hereby transferred to the Commissioner of Customs the function of publishing the notice in the Federal Register which is required by section 201(b) of the Antidumping Act, 1921, as amended by the Act of August 14, 1958, Public Law 85-630 (19 U.S.C. 160(b)). Delegation to the Commissioner of Customs of certain collection functions relating to imported tobacco materials, tobacco products, and cigarette papers and tubes, heretofore delegated to the Commissioner of Internal Revenue

By virtue of the authority vested in the Secretary of the Treasury by Reorganization Plan No. 26 of 1950 (3 CFR, 1950 Supp., Ch. III), and pursuant to authorization given to me by Treasury Department Order No. 190 (26 F.R. 7019), there are transferred from the Commissioner of Internal Revenue and delegated to the Commissioner of Customs the functions of collecting the taxes imposed on tobacco materials, tobacco products, and cigarette papers and tubes imported or brought into the United States on which internal-revenue taxes under section 5701 and section 7652 of the Internal Revenue Code, as amended, are due and payable at the time of release from customs custody in accordance with the method prescribed by regulations of the Internal Revenue Service.

It is hereby ordered that the provisions of Treasury Department Order No. 165-2 (18 F.R. 7177) and Amendment 1 thereof (24 F.R. 1991) are applicable to refunds of such collections.

The functions herein delegated to the Commissioner of Customs may be delegated by him to subordinates in such manner as he shall direct. This order shall be effective October 1, 1961. (26 FR 8400)

By virtue of the authority vested in me as Secretary of the Treasury, there are hereby established in the Bureau of Customs new offices designated as Deputy Commissioner of Customs, as follows:

Establishment of certain new offices and redesignation of existing offices in the

Bureau of Customs

Treasury Department,

Washington, D.C., September 18, 1964.

By virtue of the authority vested in me as Secretary of the Treasury, there are hereby established in the Bureau of Customs new offices designated as follows: Office of Regulations and Rulings

Office of Operations

Office of Administration

Office of Investigations

There is also established a Division of Collectors' Operations.

To the extent that the Commissioner of Customs determines feasible, the functions of the present Divisions of the Bureau of Customs are assigned as follows:

Divisions of Classification and Drawback; Entry, Value and Penal-
ties; and Marine Administration to the Office of Regulations and
Rulings.

Divisions of Appraisement Administration; Technical Services; and
Collectors' Operations to the Office of Operations.

Division of Management and Controls to the Office of Administration.
Division of Investigations and Enforcement to the Office of Inves-
tigations.

The Divisions of Management and Controls and Investigations and Enforcement are abolished on the establishment of the new offices.

Nothing in this Order is to be interpreted to preclude the Commissioner of Customs from assigning to any of the appropriate offices any of the functions or activities of any division which he determines is necessary or desirable.

Each of the above offices and divisions will be headed by a Deputy Commissioner of Customs.

This Order shall become effective on October 1, 1964. (29 F.R. 13351)

Treasury Department Order No. 165-16

ACTING COMMISSIONER OF CUSTOMS

Designation

By virtue of the authority vested in me as Secretary of the Treasury, including the authority in Reorganization Plan No. 26 of 1950, Assistant Commissioner of Customs Lester D. Johnson is designated, effective upon the resignation of Philip Nichols, Jr., as Commissioner of Customs, to serve as Acting Commissioner of Customs with authority to perform all functions, without limitation, now authorized to be performed by the Commissioner of Customs. Mr. Johnson will continue to serve in this capacity until a new Commissioner of Customs has been appointed and assumes the duties of the office.

Note: The resignation of Philip Nichols, Jr., as Commissioner of Customs took effect on October 1, 1964, at 6:00 p.m. The designation of Lester D. Johnson as Acting Commissioner of Customs therefore became effective at that time. Dated: September 30, 1964.

Reorganization of the Customs field service

Pursuant to Reorganization Plan No. 1 of 1965 (30 F.R. 7035), Reorganization Plan No. 26 of 1950 (3 CFR Ch III), section 1 of the Act of August 1, 1914, as amended, 38 Stat. 623 (19 U.S.C. 2), and Executive Order No. 10289, September 17, 1951 (3 CFR Ch II), it is hereby ordered that:

Customs regions, customs districts in said regions, offices of regional Com- TD 66-25. missioner of Customs for said regions, and offices of district director of customs for said districts are created, existing customs-collection districts are abolished, and the effective dates of abolition by Reorganization Plan No. 1 of 1965 of the offices of collector of customs, comptroller of customs, surveyor of customs, and appraiser of merchandise to which appointments are required to be made by the President by and with the advice and consent of the Senate are specified, as follows:
