ground that complainant had failed to conform to the formula for determining reparation set forth in the report herein, 168 I.C.C. 449, 498 to 503, inclusive, such as showing circuity of routes, whether the shipments were transited, and whether they were specially routed by the shipper. A witness for complainant testified that all of the shipments were included in the original complaint; that they were all routed by the shipper; and that they all moved over routes which exceeded the shortest route by more than 15 percent. The prepaid freight bills clearly indicate that the shipments moved from and to the considered points without transit. The first-class rate prescribed in the southwestern revision between these points is $2.10. Under the above-mentioned fomula the resultant rate is 81 cents per 100 pounds on all of these shipments.

Defendants contend that all shipments covered by assignments are barred in such cases, where the assignments were not executed within the statutory period. The assignments in the instant case were executed within the statutory period.

Since filing of complaint, complainant's corporate name has been changed to Sinclair-Prairie Oil Company by amendment to its charter.

Upon further hearing, we find that the Sinclair-Prairie Oil Company, successor in interest to the Sinclair Oil & Gas Company, assignee, is entitled to reparation, with interest, in amounts and from defendants shown in the table below:
