GRAIN ELEVATORS

The only regular grain elevator in the port which is open to general public use is that operated by the Commission of Public Docks at Terminal No. 4. This elevator, of fireproof construction throughout, is equipped with modern electrically driven machinery, and is arranged for rapid, efficient, and economical operation. A full equipment of machinery for cleaning, smutting, sacking, etc., has been provided. The present storage capacity of the elevator is 2,053,800 bushels, of which 298,700 bushels is in the operating house, 755,100 bushels in the storage annex, and 1,000,000 bushels in extra storage bins constructed in 1930. The conveyor on the roof of the transit shed on Pier No. 1 is over 1,100 feet long and two vessels can be loaded with bulk grain at the same time. A conveyor also connects the workhouse with the transit shed for the handling of grain in sacks. Six cars can be unloaded in the workhouse at one time. The tracks serving the elevator have a capacity of 70 loaded and 90 empty cars.

The unloading capacity of the elevator is 120,000 bushels in eight hours from cars. Grain can be delivered in bulk to vessels under normal conditions at the rate of 25,000 bushels per hour, although at times a delivery of 30,000 bushels per hour has been attained.

The following regulations and rates quoted from the tariff of the Commission of Public Docks govern the handling of grain at the elevator and at Pier 1. Charges for wharfage, storage, loading or unloading, or handling here quoted to cover sacked grain are also applicable at Municipal Terminals Nos. 1 and 2.

Rates subject to change.-Rates for services involving labor are predicated upon current wages paid labor under ordinary traffic and labor conditions for straight time between 8 a. m. and 4.30 p. m., Sundays and holidays excepted, and account of labor demands for increased wages, labor strikes, congestions, or other conditions not reasonably within the control of the Commission of Public Docks which increase the cost of these services, are subject to change without notice or to basis of actual cost plus 15 per cent.

Insurance.-Rates named herein cover no insurance.

Weighing and inspection.—The grain facilities of the commission are operated as a class B grain warehouse and all services of weighing, sampling, and inspecting are performed by the grain inspection department of the State of Oregon. Fees for weighing, sampling, and inspecting, either on straight time or overtime basis, as fixed by the market agent of the State of Oregon, are in addition to the charges specified in this tariff and will be assessed direct against the owner of the grain by the grain inspection department.

Basis of charges.—All charges are based on weights furnished by the grain inspection department of the State of Oregon. On sacked grain received or unloaded at pier warehouses the gross in weight (inclusive of sack tare) shall be used as the basis for the assessment of wharfage, unloading, cutting in, and storage, the gross outturn weight (inclusive of sack tare) for the assessment of handling and loading. elevator, the gross in weight (exclusive of sack tare) shall be used as the basis for the assessment of elevation, smutting, cleaning, and storage (see note); the gross outturn weight of bulk grain for the assessment of handling, loading, and sacking out.

Right reserved to refuse grain.-The commission reserves the right to refuse any grain which is unmerchantable or in unfit condition for storage or handling, or grain for which space reservation has not been made in advance of arrival of the grain at Terminal No. 4.

Right reserved to terminate storage. The commission reserves the right to terminate storage and to order the removal of any grain which from its nature or otherwise may cause damage to other grain. Grain not removed by owner within the time specified in notice to remove may be removed by the commission at the expense of the owner.

Overtime.-Rates for services involving labor are predicated upon straight time wages. When such services are performed during other than the regular working hours between 8 a. m. and 4.30 p. m. or on Sundays and holidays, the difference between straight time and overtime wages paid labor, plus 15 per cent, will be assessed against party or parties authorizing the overtime. This charge will be in addition to regular tariff rates for services.

Stand-by and lost time.-In delivering (handling) bulk grain to vessels, any lost and/or stand-by time of employees of the commission incurred through inability or failure of vessel to receive grain at a minimum rate of 200 short tons per belt per hour will be assessed against the vessel at actual cost plus 15 per cent.

Right to perform services on overtime.-Whenever, in the judgment of the commission, it shall be deemed necessary to perform on overtime any services in connection with the unloading, handling, cleaning, or smutting of grain, right is reserved to perform such services and to order weighing, sampling, and inspecting by the grain inspection department of Oregon in the name of and at the expense of the owner of the grain.

Continuous loading by vessel.—The commission reserves the right in an emergency to require continuous loading of grain by vessel through 24 hours per day, with all overtime of labor incidental to continuous loading for the account of the vessel.

Binning. In the absence of specific instructions for special binning bulk grain will be stored in bins containing the same kind and grade of grain regardless of ownership.

Special binning.—When space in elevator permits, grain may be stored in special bins at an additional charge of 50 per cent of regular storage rates. Grain stored in special bins is at owner's risk for loss in weight or grade. Right is reserved to refuse special binning privileges when necessary to facilitate the handling of other grain or to prevent congestion.

Storage of smutty grain conditional.-Grain containing smut dockage, fixed by the grain inspection department, will only be received for storage in elevator subject to removal of smut at the convenience of the commission.

Smutting and cleaning.—All smutting and cleaning of grain is for the account of the owner and any resulting shrinkage or loss in weight of grain must be borne by the owner.

(a) Scouring: The scouring process will be used for the removal of smut unless specific request for washing is made by the owner at time of receipt of grain at elevator.

(b) Washing: The washing process will be used for the removal of smut only upon request of the owner. When grain is washed, the commission assumes no responsibility for condition of grain and it is at owner's risk for condition until

delivered from the elevator. Right is reserved, however, to aerate washed grain when necessary to prevent damage. The charge for aeration will be in addition to the charge for smutting and must be borne by the owner of the grain.

(c) Cleaning: Grain will be cleaned or separated when requested by owner. The service includes the sacking of the screenings separated from the grain, sacks to be furnished by the owner. Unless immediate delivery is taken of screenings, same will be transferred to pier warehouses and tariff charge for transferring assessed.

Free time period.-By "Free time period" is meant the specific number of days freight may occupy space in the facilities of the commission without being subject to assessment of storage. At the grain facilities at Municipal Terminal No. 4, grain will be allowed a free time period of 20 days, inclusive of Sundays and holidays, and beginning the first 7 a. m. occurring after the grain is received or unloaded into the facilities.

Storage. Storage begins the first 7 a. m. after the expiration of the free time period and rates named are per day or fraction thereof. The day grain is delivered or the days vessel is loading shall not be counted as storage days.

Transferring bin to bin.-Grain will be transferred from bin to bin whenever in the judgment of the commission such action is necessary to obtain the benefit of full storage capacity of elevator.

Demurrage on cars or vessels.-Demurrage on cars or vessels will not be assumed by the commission. Grain will be received, handled, or delivered within the hours of 8 a. m. and 4.30 p. m. except Sundays and holidays, but the commission does not undertake to receive, unload, load, handle, or deliver grain within any particular time. Cars will be ordered in and unloaded in regular turn of arrival except as provided. No responsibility for delay will be assumed by the Commission of Public Docks when delay is occasioned by conditions not reasonably within its control.

Switching between elevator and warehouses.-Cars of grain switched between elevator and pier warehouses to complete loading or unloading are subject to current rail tariff charge for service. (Present rate, $2.70 per car.)

Berthage.-(a) Unless special permit is granted at the time no vessel will be permitted to berth for the purpose of loading grain until a port surveyor's certificate is furnished to the effect that the vessel is in condition for the continuous loading of its full booking of grain.

(b) As provided in current Terminal Tariff vessels permitted to berth for loading grain shall be exempt from levy of berthage (dockage) for the interval between the berthing of the vessel and such time as the commission is prepared to begin delivery of grain.

(c) The commission reserves the right to refuse berth, to designate berth to be occupied, or to require vessel to vacate or change berth whenever in the judgment of the commission it is necessary.

Reconditioning sacked grain.—All sacks of grain unloaded at pier warehouses that have been noted as in bad order on State grain inspection department certificates will be reconditioned or resacked, as will all sacks of grain rejected by vessel account condition of sacks. Expense of reconditioning will be assessed owner at regular tariff rates.

Receipts for sacked grain.-All exceptions to the condition of sacked grain must be made on the part of the vessel, its owners, agents and/or officers, before the grain leaves the warehouse. By accepting grain on board, the vessel, its owners, agents and/or officers acknowledge receipt of grain and containers in apparently good condition and thereby agree to give a clean receipt for same to the commission.
