§ 856. Conditions having for their purpose the maintenance of the highway in its original condition.

Another class of conditions frequently imposed is that which involves the exercise of an unquestionable right on the part of the state or municipality to require that the railroad authorized to occupy a highway shall first, in the construction of its roadbed, and second, in the maintenance and operation of it, pre
