Mr. A. J. Kennedy presented a petition relative to the appointment of a commission to inquire into the adoption and construction of the 5th Article of the Constitution of the United States. Ordered, That said petition be laid upon the table.

No. 1466) entitled “An act to authorize the Commissioners of the Palisades Interstate Park to exchange certain lands in the Palisades Interstate park for certain other lands in Orange county now owned by E. Roland Harriman, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Mr. Burkard introduced a bill (Int. No. 1467) entitled "An act to empower the city of New York to acquire certain portions of the Long Island railroad in Queens county, together with all appurtenances, rolling stock, stations, power houses, bridges, storage yards, easements and intangible assets along the right of way of such railroad; to issue stock, bonds or tax notes to pay for the cost thereof; providing for the payment of all obligations of the city issued therefor; and providing for the lease or operation of such railroad as a public utility," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public service.

Also, a bill (No. 1332, Rec. No. 317) entitled "An act confering jurisdiction on the Court of Claims to hear, audit and determine the claim of John I. La Bagh against the State for alleged damages to an automobile alleged to have been caused by the State's negligence in its maintenance of a highway in the town of Covert, Seneca county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on general laws.

Also, a bill (No. 2009, Rec. No. 318) entitled "An act to amend

the Conservation Law, in relation to open season for taking muskrat by trapping in Allegany and Jefferson counties," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on conservation.

Also, a bill (No. 1932, Rec. No. 319) entitled "An act to authorize the city of New York to acquire by condemnation the right to remove the elevated railroad structure from Fulton street and other streets and avenues in the borough of Brooklyn of said city, and to extinguish all rights in said structure or to maintain the same or to operate cars or trains thereon or thereover, and to provide compensation for the loss of such rights, and to assess the cost and expense thereof upon property benefited thereby," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on public service.

Also, a bill (No. 1554, Rec. No. 321) entitled "An act to confer jurisdiction on the Court of Claims to hear, try and determine the claim of William H. Wells, of Fulton, New York, against the State for damages to wood and timber land alleged to have been sustained by raising of the dam at Oswego Falls, and to render judgment therefor, ," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on general laws.

Also, a bill (No. 1828, Rec. No. 322) entitled "An act to amend the Banking Law, in relation to investment companies," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks.

Also, a bill (No. 1652, Rec. No. 323) entitled "An act to legalize certain bonds of union free school district number one in the town of Schroon, Essex county, and of its successor the central rural school district number one, issued for the construction of an addition to present school building and facilities, and to provide for the payment of such bonds, ," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Brereton, and by unanimous consent, said bill was substituted for Senate bill (No. 1047, Int. No. 944), now on the order of third reading.

Also, the bill (No. 1150, Rec. No. 324) entitled "An act to amend the Tax Law, in relation to property owned by a public district or by the property owners therein and used for the purposes of the district," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Mastick, and by unanimous consent, said bill was substituted for Senate bill (No. 722, Int. No. 665), now on the order of third reading.
