To the Legislature:

ALBANY, February 25, 1918.

On February 20th, Senate bill (Int. No. 411, Printed No. 445) was reported to the Senate by the committee on the city of New York and passed; on February 21st the bill passed the Assembly; and on February 22d it was transmitted to the mayor. am informed that the bill passed both Houses unanimously, no objection being made.

It appears that in line thirteen of page four of the printed bill, the last word of the line should be "or" instead of "of ". of ". I am also informed that the corporation counsel of the city of New York is in doubt as to how the court would construe this provision of the bill and requests that a bill be passed in corrected form. If this act is not passed before March 1st a great burden will be placed upon the taxpayers of Queens county.

Therefore, In accordance with the provisions of section fifteen of article three of the Constitution and by virtue of the authority thereby conferred upon me, I do hereby certify to the necessity of the immediate passage of Senate bill (Int. No. 411) entitled "An act to amend the Greater New York charter, in relation to payment of cost of public improvements," as amended.

Given under my hand and the Privy Seal of the State at the Capitol in the City of Albany this twenty-fifth [L. S.] day of February in the year of our Lord one thousand nine hundred and eighteen.

A message from the Governor, at the hands of his secretary, was received and read in the words following:

STATE OF NEW YORK-EXECUTIVE CHAMBER,

To the Senate:

ALBANY, February 25, 1918.

Since the beginning of the war, I have done my utmost for the cause of food production and food conservation in the State. To that end I appointed a Council of Farms and Markets which I believed would work in harmony with the merged governmental agencies, both Federal and State, designed to produce and conserve food. Criticism has been made at the meetings of various agricultural bodies of the personnel of the Council of Farms and Markets.

The members of the Council believe that the best interests of both the State and the Nation at this time require that the Council should have the confidence and cooperation of all the farmers and producers of food as well as consumers, and have asked that their names be withdrawn for further consideration.

In the same spirit I hereby withdraw the nominations heretofore transmitted on the twenty-second day of January, designating

the members of the Council of Farms and Markets on the ground that no personal consideration of any nature shall be an obstacle. to the great purpose of producing and conserving food for our State, our Nation and our Allies.

I shall transmit to Your Honorable Body in the very near future nominations to the Council of Farms and Markets.

Wieting, of Cobleskill; Lyman M. Wright, of Hartford; Frank W. Howe, of Syracuse; Floyd M. Shoemaker, of Elmira; Frank M. Jones, of Webster; Ira T. Gleason, of Buffalo, and John Y. Gerow, of Washingtonville, as members of the Council of Farms and Markets, reported the same to the Senate to be returned to the Governor, the said nominations having been withdrawn.

Mr. Sage moved that the said nominations be returned to the Governor.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Ordered, That the Clerk return said nominations to the Governor.
