Also, a bill (No. 625, Rec. No. 437) entitled "An act to amend the Conservation Law, in relation to lands, forests and public parks," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on conservation.

Also, a bill (No. 1029, Rec. No. 438) entitled "An act authorizing the town board of the town of Southampton, in Suffolk county to contract for replacing or reconstructing the tide gates in the Shinnecock and Peconic canal in such town and to expend for such purpose money heretofore appropriated by the State, and to provide for the excess of expense, if any, by the issue of certificates of indebtedness of such town," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. G. L. Thompson, and by unanimous consent, said bill was substituted for Senate bill (No. 939, Int. No. 534), now on the order of third reading.

Also, a bill (No. 1623, Rec. No. 439) entitled "An act to amend the Public Health Law, in relation to the cold storage of foods and reports of warehousemen thereon," which was read the first time and by unanimous consent was also read the second time.

On motion of Mr. Wicks, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Also, a bill (No. 1333, Rec. No. 440) entitled "An act to amend the Judiciary Law, in relation to the compensation of the clerks of the Appellate Division, third and fourth departments, and the deputy clerk, third department," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on the judiciary.

Also, a bill (No. 975, Rec. No. 441) entitled "An act to provide for certain work by the State Highway Department in Tonawanda creek, to prevent damage by floods to a certain street and highway, and making an appropriation therefor," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on finance.

Also, a bill (No. 1563, Rec. No. 442) entitled "An act to amend the Military Law, relative to the military training of boys," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on military affairs.

Also, a bill (No. 1648, Rec. No. 443) entitled "An act to amend the Lien Law, in relation to liens of truckmen and draymen," which was read the first time, and by unanimous consent was also read the second time.

No. 444) entitled "Concurrent resolution of the Senate and Assembly proposing an amendment to section seven of article seven of the Constitution, in relation to the use of lands and timber in the forest preserve for fuel for domestic purposes and for roads and trails," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Emerson, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Also, a bill (No. 1662, Rec. No. 445) entitled “An act to provide for the appointment of a commission to investigate the matter of titles to lands claimed adversely to the State in counties containing portions of the forest preserve, and to report its proceedings together with its recommendations in relation thereto to the Legislature," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Emerson, and by unanimous consent, said bill was substituted for Senate bill (No. 150, Int. No. 149), now on the order of third reading.

The Assembly returned the Assembly bill (No. 1693, Senate Reprint No. 1708, Rec. No. 382) entitled "An act in relation to city local option elections in the year nineteen hundred and eighteen," with a message that they have concurred in the amend ments of the Senate thereto.

Ordered, That the Clerk return said bill to the Assembly. The Assembly sent for concurrence a resolution, in the words. following:

Resolved (if the Senate concur), That Assembly bill (No. 942, Rec. No. 194) entitled "An act to amend the Stock Corporation Law, in relation to election of directors," be returned to the Governor.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly, with a message that the Senate has concurred in the passage of the same.

Mr. Koenig offered the following:

Resolved, That a respectful message be sent to the Assembly, requesting the return to the Senate of the Senate bill (No. 1643, Int. No. 557) entitled "An act to amend the Penal Law, in relation to permitting fishing upon the first day of the week," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above bill and resolution.
Mr. Walker offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor, requesting the return to the Senate of the Senate bill (No. 956, Int. No. 808) entitled "An act to release to Eugenia Quinlan all the right, title and interest of the people of the State of New York in and to the property of Francis J. Quinlan, deceased," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Newton, from the committee on codes, to which was referred the Assembly bill introduced by Mr. E. A. Johnson (No. 1557, Rec. No. 395), entitled "An act to amend the Penal Law, in relation to protecting civil and public rights," reported

in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Newton, from the committee on codes, to which was referred the Assembly bill introduced by Mr. G. T. Davis (No. 1507, Rec. No. 314), entitled "An act to amend the Code of Civil Procedure, in relation to the presumption of death," reported in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Cromwell, from the committee on affairs of the city of New York, to which was referred the Assembly bill introduced by Mr. Link (No. 342, Rec. No. 343), entitled "An act authorizing the police commissioner of the city of New York to rehear the charges upon which Elmer W. Heartt, formerly a patrolman in the police department of the said city, was dismissed from said department in the year nineteen hundred and two and to reinstate him in the position formerly held by him," reported in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. Hewitt, from the committee on internal affairs of towns, counties and public highways, to which was referred the Senate bill introduced by Mr. Walters (No. 1392, Int. No. 1227), entitled "An act authoriz ing any new corporation constituted by the consolidation of Cliff Electrical Distributing Company, The Niagara Falls Power Company and Hydraulic Power Company of Niagara Falls, efficiently to utilize any water by it lawfully diverted from the Niagara river," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. E. R. Brown, from the committee on war measures, to which was referred the Senate bill introduced by Mr. G. F. Thompson (No. 1630, Int. No. 1228), entitled "An act to authorize the consolidation of Cliff Electrical Distributing Company, The Niagara Falls Power Company and Hydraulic Power Company of Niagara Falls," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill restored to its place on the order of third reading.

Mr. G. F. Thompson, from the committee on public service, to which was referred the Assembly bill introduced by Mr. Pierce (No. 933, Rec. No. 241), entitled "An act to establish a ferry from and to Gravely Point, Cumberland Head, in the town of Plattsburgh, county of Clinton, and State of New York, to and from Grand Isle in the State of Vermont," reported in favor of the passage of the same, which report was agreed to, and said bill restored to its place on the order of third reading.
