Also, Senate bill (No. 1005, Int. No. 832) entitled "An act to amend chapter two hundred and forty-three of the Laws of eighteen hundred and fifty-nine, entitled 'An act to amend the charter and several acts relating to the village of Waterford, and to incorporate the same into one act,' generally," with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said bills to the Governor. The Senate bill (No. 787, Int. No. 325) entitled "An act to amend the charter of the city of Sherrill, generally," was returned by the mayor of the city of Sherrill, with a certificate that a public hearing has been duly held on said bill in pursuance of law, and that the mayor and local legislative body have duly accepted the same.

Ordered, That the Clerk deliver said bill to the Governor.

At eleven o'clock and forty-five minutes, Mr. E. R. Brown moved that the Senate stand in recess until nine o'clock.

The Senate met pursuant to adjournment.

The journal of yesterday was read and approved.
Mr. Walters offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor, requesting the return to the Senate of the Senate bill (No. 1087, Int. No. 435) entitled "An act to amend the Election Law, generally, and to make special provision for the year nineteen hundred and eighteen," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Walters offered the following:

Resolved, That a respectful message be sent to the Assembly, requesting the return to the Senate of the Senate bill (No. 1422, Int. No. 1111) entitled "An act to amend the Education Law, in relation to the retirement from active service of employees of boards of education other than superintendents and teachers, in cities having a population of one hundred thousand or more," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above bill and resolution.

Mr. Robinson moved that the committtee of the whole be discharged from the consideration of Assembly bill (No. 840, Senate Reprint No. 1577, Rec. No. 191) entitled "An act to abolish the town of Wilmurt in the county of Herkimer and to provide for the annexation of its territory to the adjacent towns of Webb and Ohio."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

On motion of Mr. Robinson, and by unanimous consent, the rules were suspended and said bill ordered to a third reading. Said Assembly bill was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

Mr. Walton moved that the committee on the judiciary be discharged from the consideration of Senate bill (No. 908, Int. No. 785) entitled "An act to amend the Judiciary Law, in relation to official referees in the several judicial departments of the State."

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Ordered, That said bill be restored to its place on the order of third reading.

Mr. Sage offered the following:

Resolved, That a committee of two be appointed to wait upon the Assembly and inform that body that the Senate is ready to meet in joint session for the purpose of comparing nominations for the office of member of the Council of Farms and Markets.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

The President appointed as such committee Messrs. Sage and Cullen.
