On motion of Mr. Newton, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Mr. Cotillo introduced a bill (Int. No. 1264) entitled "An act to amend the Public Health Law, in relation to examination of nurses during the period of the present war," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Cotillo, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on public health, retaining its place in the order of third reading.

Mr. Wicks introduced a bill (Int. No. 1265) entitled "An act to legalize the election held in the village of Whitesboro on April second, nineteen hundred and eighteen, pursuant to article thirteen of the Village Law, to determine the question of reincorporation thereunder," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Wicks, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Mr. Slater introduced a bill (Int. No. 1266) entitled "An act making appropriation for deficiencies in appropriations heretofore made for the salary of special deputy excise commissioner of the county of Westchester," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Slater, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on finance, retaining its place in the order of third reading.

Mr. E. R. Brown moved a call of the Senate.

The President put the question whether the Senate would agree

to said motion, and it was decided in the affirmative.

By direction of the President, the Clerk called the roll, when the following Senators responded:

The Clerk furnished a list of the absentees to the sergeant-atarms, who appeared in due time before the bar of the Senate with Messrs. Burlingame, Cotillo, Gilchrist, Gibbs, Hewitt, Lockwood, Robinson, Stivers, Walters and Lawson, each of whom was excused.

Mr. E. R. Brown moved that all further proceeding under the call of the Senate be suspended.

The President put the question whether the Senate would agree to said motion, and it was determined in the affirmative.

The President announced that pursuant to law and agreeable to a resolution heretofore adopted the Senate would proceed to nominate a candidate for the office of members of the Council of Farms and Markets in the place of Lewis L. Morrell of the village of Kinderhook, county of Columbia, Third Judicial District, whose term of office expired April 1, 1918.

Whereupon the following Senators when their names were called arose in their place and nominated as follows:

A quorum having voted, and a majority having nominated Lewis L. Morrell, the President announced that Lewis L. Morrell of the village of Kinderhook, county of Columbia, Third Judicial District, has been duly nominated as member of the Council of Farms and Markets, for a term of ten years from April 1, 1918.

The Assembly sent for concurrence the bill (No. 1551, Rec. No. 383) entitled "An act to amend chapter five hundred and thirty-five of the Laws of nineteen hundred and fifteen, entitled 'An act to consolidate and revise the several acts relative to the city of Olean,' in relation to a hydrant tax," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Fowler, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Also, a bill (No. 951, Rec. No. 384) entitled "An act to confer jurisdiction on the Court of Claims to hear, audit and determine the alleged claim of Helen Lewis and Eleanor Lewis, respectively the widow and daughter of Julius Lewis, deceased, or of the administrator of his estate, in their behalf, against the State, for damages for the death of said deceased, alleged to have been caused by personal injuries alleged to have been sustained by him at work as an enlisted member of the Twenty-first Company Coast Artillery Corps of the National Guard, New York, in the armory of the Ninth Coast Defense Command, in the city and county of New York, and to render judgment therefor," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Ottinger and by unanimous consent the rules were suspended and said bill ordered to a third reading.

Also, a bill (No. 1493, Rec. No. 385) "An act to regulate the solicitation of funds and other property for purposes of war aid and war charity during the duration of the war in which the United States is now engaged," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. Ottinger, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on war measures, retaining its place in the order of third reading.

Also, a bill (No. 1378, Rec. No. 386) entitled "An act to amend the Labor Law, in relation to the salaries of factory and mercantile inspectors," which was read the first time, and by unanimous consent was also read the second time.

On motion of Mr. G. F. Thompson, and by unanimous consent, the rules were suspended and said bill ordered to a third reading and referred to the committee on finance, retaining its place in the order of third reading.

Also, a bill (No. 1552, Rec. No. 387) entitled "An act to amend the Penal Law, in relation to the sale of tickets for admission to places of amusement," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on codes.

No. 388) entitled "An act to amend chapter five hundred and sixty-four of the Laws of nineteen hundred and ten, entitled 'An act to provide for county roads in certain counties adjoining cities of the first class,' in relation to the county road system and the construction and maintenance of county roads," which was read the first time, and by unanimous. consent was also read the second time.

On motion of Mr. G. L. Thompson, and by unanimous consent, said bill was substituted for Senate bill (No. 1146, Int. No. 940), now on the order of third reading.

Also, a bill (No. 1547, Rec. No. 389) entitled "An act to amend the Public Service Commissions Law, in relation to water companies, or persons engaged in furnishing water outside of the city of New York," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on public service.

Also, a bill (No. 864, Rec. No. 390) entitled "An act to amend the Highway Law, in relation to amount to be raised by a town for highway machinery," which was read the first time, and by unanimous consent was also read the second time.
