TITLE XV-DELEGATE

DISTRICT DELEGATE

5 SEC. 1501. (a) Until a constitutional amendment and 6 subsequent congressional action otherwise provide, the people 7 of the District shall be represented in the House of Repre8 sentatives of the United States by a Delegate, to be known 9 as the "Delegate from the District of Columbia", who shall 10 be elected as provided in this Act. The Delegate shall have 11 a seat in the House of Representatives, with the right to de12 bate, but not of voting. The Delegate shall be a member 13 of the House Committee on the District of Columbia and shall 14 possess in such committee the same powers and privileges as he has in the House of Representatives, and may make 16 any motion except to reconsider. His term of office shall be

17 for two years.

(b) No person shall hold the office of District Delegate 19 unless he (1) is a qualified voter, (2) is at least twenty20 five years old, (3) holds no other public office, and (4) is 21 domiciled and resides in the District and during the three 22 years next preceding his nomination (a) has been resident 23 in and domiciled in the District and (b) has not voted in 24 any election (other than in the District) for any candidate

1 for public office. He shall forfeit his office upon failure to 2 maintain the qualifications required by this subsection.

3 (c) (1) Subsection (a) of section 601 of the Legislative 4 Reorganization Act of 1946, as amended, is hereby amended 5 by striking out "from the Territories".

6 (2) Clause (b) of section 1 of the Civil Service Retire7 ment Act of May 29, 1930, as amended (70 Stat. 743), is 8 hereby amended by striking out "from a Territory". 9 (3) The second paragraph under the heading "House of 10 Representatives" in the Act of July 16, 1914 (2 U.S.C. 11 37), is hereby amended by striking out "from Territories". 12 (4) Paragraph (i) of section 302 of the Federal Cor13 rupt Practices Act, 1929, as amended (2 U.S.C. 241), is 14 hereby amended by inserting after "United States" the fol15 lowing: "and the District of Columbia".

16 · (5) Section 591 of title 18, United States Code, is 17 hereby amended by inserting "and the District of Columbia" 18 before the period at the end thereof. Section 594 of such 19 title is hereby amended by inserting after "Territories and 20 Possessions" the following: "or the District of Columbia". 21 The first paragraph of section 595 of such title is hereby 22 amended by inserting after "from any Territory or posses23 sion" the following: "or the District of Columbia”.

TITLE XVI-TITLE OF ACT

SEC. 1601. This Act, divided into titles and sections

3 according to table of contents, and including the declaration

4 of congressional policy which is a part of such Act, may be 5 cited as the "District of Columbia Charter Act".

A BILL

To provide for the District of Columbia an elected mayor, city council, board of education, and for other purposes.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That, subject to the retention by Congress of the ultimate 4 legislative authority over the Nation's Capital which is 5 granted by the Constitution, it is the intent of Congress to 6 restore to the inhabitants of the District of Columbia the

powers of local self-government which are a basic privilege 8 of all American citizens; to reaffirm through such action 9 the confidence of the American people in the strengthened

10 validity of principles of local self-government by the elective

11

process; to promote among the inhabitants of the District the

1 sense of responsibility for the development and well-being of 2 their community which will result from the enjoyment of 3 such powers of self-government; to provide for the more 4 effective participation in the development of the District and 5 in the solution of its local problems by those persons who are 6 most closely concerned; and to relieve the National Legisla7 ture of the burden of legislating upon purely local District 8 matters. It is the further intention of Congress to exercise its 9 retained ultimate legislative authority over the District only 10 insofar as such action shall be necessary or desirable in the 11 interest of the Nation.
