IN THE MATTER OF THE PROPOSAL OF THE NORTHERN STATES POWER COMPANY TO EXTEND ITS LINES IN THE TOWN OF BRUNSWICK, EAU CLAIRE COUNTY

Decided June 28, 1937

NORTHERN STATES POWER COMPANY authorized to operate as a public electric utility in the town of Brunswick, Eau Claire County, and to extend its rural electric-distribution system therein, as proposed.

OPINION AND ORDER

The Commission received on June 1, 1937, an application from Northern States Power Company for authority to extend its rural electric-distribution system into the town of Brunswick, Eau Claire County. The application was dated May 29.

Under provisions of General Order 2-U-965 (13 P.S.C. of W. 539), the Commission notified the Rural Electrification Coordination of the application. The co-ordination on June 7 filed waiver of objection.

Since the company does not render service in the town, the Commission on June 9 issued a notice of a hearing which was considered desirable under Section 196.49 (1), Statutes, and General Order 2-U-20 (6 P.S.C. of W. 484). The only appearance at the hearing, held June 14 at Madison, was the company, represented by Bailey Ramsdell, Eau Claire, attorney.

Plans of the company are to build 3.18 miles of line south from near the Eau Claire city limits to serve 12 rural customers who have contracted for company service. An estimate of the cost indicates that the average per customer will be $360, and that the total cost will be $4,320. Consequently, the extension can be made under the company's standard extension rules which provide for an investment of up to $400 of company funds per customer.

As Exhibit 2 shows, if the line is authorized, it will later be extended 9 miles to serve the communities of Rock Falls and Caryville and about 35 additional rural customers.

No public utility now renders electric service in the town.

THE COMMISSION THEREFORE FINDS AND DETERMINES, in view of the foregoing facts and considerations:

1. That public convenience and necessity require that Northern States Power Company be granted a certificate of authority under Section 196.49 (1), Statutes, and General Order 2-U-20 to operate as a public electric utility in the town of Brunswick, Eau Claire County, Wisconsin.

2. That public convenience and necessity require that the company be granted authority under Section 196.49, Statutes, and General Orders 2-U-20 and 2-U-965 to extend its rural electric-distribution system in sections 35 and 36, township 27 north, range 10 west, and sections 1, 2, and 3, township 26 north, range 10 west, all in the town of Brunswick, Eau Claire County, Wisconsin.

3. That completion of the above-described project will not provide facilities unreasonably in excess of probable future requirements, and will not, when placed in operation, add to the cost of service without proportionately increasing the value or available quantity thereof.

IT IS THEREFORE ORDERED, That Northern States Power Company be and hereby is granted a certificate of authority to operate as a public electric utility as described in Finding No. 1.

IT IS FURTHER ORDERED, That the company be and hereby is granted authority to extend its rural electric-distribution system in accordance with Finding No. 2.

IN THE MATTER OF THE APPLICATION OF THE TOWN OF ALLOUEZ FOR AUTHORITY TO CONSTRUCT A WELL

IN THE MATTER OF THE APPLICATION OF THE TOWN OF ALLOUEZ TO CONSTRUCT AN AUXILIARY PUMP HOUSE AND RESERVOIR

PREVIOUS ORDER in CA-270 authorizing petitioner to make certain improvements in its waterworks system, amended, to allow an additional expenditure of $10,000 for this purpose.

BY THE COMMISSION:

On May 13, 1937, the Commission was notified by Mr. L. D. Jaseph, attorney for the town of Allouez, that while the town had received authority in its application for the expenditure of approximately $10,000 in the construction of a new well, pump house, pumping equipment, etc., the cost of this construction would amount to $20,000, and the consent of the Commission was asked for the authorization of this additional expenditure. At approximately the same time a letter was received from Mr. Clarence C. Linck, clerk of the town of Allouez, asking authority to construct a pump house, reservoir, and to install pumping equipment at a cost of approximately $10,000; and this matter was set for investigation and hearing under CA-473.

At the hearing on CA-473 at Madison on June 15, 1937, there were the following appearances:

Town of Allouez, by Mr. L. D. Jaseph, attorney, Green Bay, Wisconsin; Mr. John Vanden Heuvel, chairman of the water commission, and Mr. William Van Frachem, superintendent of the waterworks.

The evidence given at this hearing corroborated the testimony given at the original hearing held under CA-270 as to the necessity of the equipment.

THE COMMISSION FINDS, therefore, that the additional investment of $10,000 for the equipment included in the original application in this proceeding is in the public interest. (See, 14 P.S.C. of W. 112)

IT IS THEREFORE ORDERED, That order CA-270 be and the same is hereby amended to allow an additional expenditure of $10,000 by the town of Allouez for the improvements in the waterworks system as included under the original application.

IT IS FURTHER ORDERED, That the application under CA473 for authority to construct an auxiliary pump house and reservoir be and the same is hereby dismissed.

IN THE MATTER OF THE APPLICATION OF THE ELK CREEK POWER COMPANY FOR A CERTIFICATE OF AUTHORITY TO TRANSACT BUSINESS AS A PUBLIC UTILITY IN THE TOWNS OF SPRING BROOK, DUNN COUNTY, AND UNION, EAU CLAIRE COUNTY

Decided June 28, 1937

ELK CREEK POWER COMPANY authorized to transact business as a public utility in sections of the towns of Spring Brook, Dunn County, and Union, Eau Claire County, designated.

Under date of February 29, 1932 (1 P.S.C. of W. 825), the Commission issued its certificate of convenience and necessity to Elk Creek Lake, Inc., to render electrical service in certain portions of Eau Claire and Dunn Counties. It subsequently appeared that the Elk Creek Power Company, a public utility, was in reality rendering service for which the certificate of convenience and necessity had been granted Elk Creek Lake, Inc.

The matter was reopened and hearing held at Madison on September 8, 1936. Elk Creek Lake, Inc., appeared by Alvin M. Anderson, Eau Claire, and the Elk Creek Power Company by S. J. Rauchwarter, of Elk Mound.

It appears that in lieu of the certificate of convenience and necessity which the Commission issued to Elk Creek Lake, Inc., the parties desire that a certificate of authority to transact business as a public utility under the provisions of Section 196.49 (1) of the Statutes be issued to the Elk Creek Power Company. A supplemental petition filed in June 1936, by the Elk Creek Power Company requests the issuance of this certificate of authority.

The Commission finds that the issuance of the certificate of authority hereinafter ordered is in the public interest and required by public convenience and necessity.

IT IS THEREFORE ORDERED, That a certificate of authority to transact business as a public utility in sections of the towns of Spring Brook in Dunn County and Union in Eau Claire County, described as follows:

Sections 1, 2, 3, 4, 5, 35, 36, 25; the east 1/2 of 26, 24 and 13; and the south 1/4 of the east 1/2 of 12 in the town of Spring Brook, Dunn County. Also, the northwest 1 of the northwest 1/4 of section 19; the southwest 14 and northwest 1/2 of the northwest 14 of section 18; and the southwest 1/4 of the southwest 1/4 of section 7 of the town of Union, Eau Claire County,

be and the same is hereby issued to the Elk Creek Power Company.
