repayment of the mortgage debt, and the surrenderors mortgagors are in possession in statu quo without readmission or fine (Simonds v. Laund, Cro. Eliz. 239), and all that is necessary is for the mortgagee to sign a warrant to the steward authorising him to vacate the conditional surrender (see form in Wharton's Tractates, a re-surrender of the estate from C. H. E. to the uses Blackburn, 23rd Nov. 1869. (Q. 6.) COSTS.-In the absence of an express stipulation to the contrary, the vendor bears the costs incident to the acknowledgment of a deed by a married woman, and I believe it is the usual practice for the vendor's solicitor to prepare the memorandum, certificate, and affidavit, on the engrossment of the deed being sent to him for examination, and they are signed and sworn at the time of completion, or payment of the purchasemoney; the certificate and affidavit being subsequently filed by the vendor's solicitor, and office copy certificate (when obtained) handed over by him, on his undertaking, to the purchaser's solicitor. This is the usual convenient and courteous practice, but a captious solicitor may require the certificate and affidavit to be filed, and office copy certificate delivered to him before payment of the purchase money, for he has an undoubted right to have the title complete and to attest himself the vendor's execution of his own client's purchase, and Viney v. Chaplin, 31 L. T. Rep. N. S. 142; Jolly v. Hancock, 22 L. J. Ex. 38; 19 L. T. Rep. N. S. 170; 7 Ex. Rep. 820, do not apply to the question put by R. P. C. That case arose out of the examination of the title-deeds with the abstract, when a conveyance was procured with the memorandum of acknowledgment upon it signed by a judge, but there was no office copy of the certificate of acknowledgment; and as the acknowledged deed formed an essential part of the title in question, it was held that a good title was not made out to the purchasers by the mere production of the deed with the memorandum thereon, but that proof was also necessary, and must be given, of the filing of the certificate pursuant to the 85th section of the Act; and the absence of such proof (an office copy of the certificate) was sufficient to entitle the purchaser to recover back his deposit. And there seems to have been good reason for this, for the defect was incurable, as the court had no power to authorise the judge to give a fresh certificate: (36 L. J., N. S., 233, C. P.) There is, perhaps, one thing more dangerous for a would-be orator than writing a speech, learning it, and repeating it from memory, and that is the learning and repeating a ready-made speech from a book. The man who thus begins is hopelessly lost. Even if his borrowed plumes are not detected and ruthlessly plucked away upon the instant by some lover of fun, he will assuredly never afterwards trust his own inspirations. Hence our opinion that this little book is purely mischievous. Even if read merely to suggest topics and modes of treatment, it cannot fail to give to the speaker a stilted manner that will betray the artificial character of his promptings. But the model speeches collected under various heads of parochial, municipal, convivial, and such like, did time and space permit, might raise shouts of laughter by quotations of their absurdities. We cannot, therefore, commend this publication to our readers; on the contrary, we are bound to exhort them sedulously to shun it. It can do them no service, it may do them much harm. The new policies issued were 220 in number, assuring 306,6257, and producing in new premiums the sum of 10,067 198. 9d. The total premiums received in the year were 77,2377. 98. 6d., and the income from all sources amounted to 97,9377, 128. Id. The charges of management, 31781. 128. 7d. have, notwith standing the increased business, scarcely exceeded those of the year 1967. The claims by death which have been paid during the year amounted, including bonuses, to 24,174. 118. 11, assured under 24 policies:-Of this sum, 12,187. 88. Sd. fell on the non-profit class, and 11,9907. 3. d. on participating policies. These amounts are below what might have been anticipated, according to the society's tables, and are one-third less than the sums paid for claims in the year 1967. The existing assurances exceed two millions and a half. The assets of the society amounted to 195,18%. 148. 9d., and the average rate of interest at which they were invested, on the S1st Dec.. was 4. per cent. This calenlation excludes the sum which represents the value of the society's house, but estimates the amount invested in the purchase of reversions as producing 5 per cent. The increase in the assets during the year exceeded 50,000., being more than half the total income. Adding to the above sum the amount of premiums which were actually due at the closing of the account, and which were paid before the expiration of the usual days of grace, viz., 54267, 38. 8d, the assets exceeded half a million sterling.
