(Q. 12.) VENDITIONI EXPONAS.-F. bought the box-not the contents. M.'s personal representatives could recover in trover or detinue. They, however, would hold for the purposes of the will or administration. If no person be entitled beneficially as creditor, legatee, or next of kin, the Crown will take the contents of the box as bona vacantia against an administrator; but an executor would be entitled as against the Crown, unless an intention that he should not take beneficially could be inferred from the will: (See Russell v. Clowes, 2 Coll. 648; Dacre v. Patrickson, 3 Jur. N. S. 863; Read v. Stead man, 26 Beav. 495.) a Z. Y. This writ is so uncommon in practice, and the particular facts which occasion "Article's" question so very rare, that I venture, with great diffidence, to offer my views upon the subject, without the aid of any direct authority, in the hope that my doing so may invoke some opinion of weight upon so unique and interesting a point. Students may have passed over, without reflection, the nature and meaning of the writ; theretore, at the risk of being thought puerile, I will explain it thus: Suppose A. sues B., obtains judgment against him, and issues a writ of fi. fa., the sheriff seizes the judgment-debtor's goods, in pursuance of the writ, and proceeds to sell to satisfy the judgment debt and costs, but fails to sell for lack of purchasers; the sheriff, being obliged to make his return to the writ under which he levied, states that he has taken the goods, but they remain in his possession for want of buyers; A., the judgment-creditor, being desirous of realising his debt and costs, issues a judicial writ, directed to the sheriff, commanding him to sell the goods so remaining in his hands, to satisfy the judgment; this second writ is called a "venditione exponas." From the way in which the querist has stated his facts I am disposed to think that the contents of the box (the lot purchased by F.) ought to be considered in the nature of treasure-trove; for I cannot suppose that the sheriff's officers would sell a box without a knowledge of its contents, unless the contents were not visible upon inspection, or were hidden or concealed in a secret drawer, or other receptacle not apparent to an ordinary observer. I must assume this, but it would have been better if the querist had stated the nature of the contents, and the reason why it was not discovered prior to the sale and delivery to F. In the absence of this explanation I will state, shortly, what is treasuretrove, and what seem to be the rights of property therein. Treasure-trove is, in great measure, a branch of the Royal revenue, and is of very ancient origin; it is called in Latin Thesaurus inventus, which is, where any money or coin, gold, silver, plate, or bullion, is found hidden in the earth, or other private place, and if the owner be unknown, the treasure belongs to the Crown, but in case he that hid it be known, or afterwards found, he is entitled to it; if found in the sea, or upon the earth, the finder, and not the Crown, is entitled to it, if no owner appears. It is from the hiding, or secreting, and not the abandonment, that the title of the Crown attaches. A person who conceals his treasure in a secret place, does not thereby relinquish it, but impliedly reserves the right to retake it when he thinks proper; if he dies without taking it again, and his secret dies with him, the law gives the property, when found, to the Crown, in augmentation of the royal revenue. Treasure thrown into the sea, or cast upon the open earth, or casually lost and unclaimed, is supposed to be absolutely abandoned, and therefore, in law, belongs to the finder, unless the owner appear and reclaim it, which negatives the abandonment, and dispossesses the finder. In the finding of ordinary lost property, two points must be made out to justify a conviction for larceny against the finder for appropriating the property found: first, that the prisoner had at the time of finding an intention of appropriating it; secondly, that he had at that time reasonable ground for believing that the owner could be discovered; and that may be either from previous knowledge of the chattel, or from there being some name or mark upon it at the time he picked it up, which indicated who the owner was. To be guilty of felony, the finder of an article must know who the owner is, or have reasonable means at the time of finding it, of knowing who he is. Per Hill, J.: Reg. v. Christopher, 22 J. P. 771; 28 L. J. 35, M. C.; see also Reg. v. Dixon, 19 J. P. 759; Reg. v. Vest, 3 C. L. R. 87; Reg. v. Moore, 25 J. P. 132. If these two points fail of proof, there is no criminal offence in the appropriation; but the real owner may, I apprehend, recover his property by civil action on proper proof of ownership, loss, and non-abandonment; hence, if I am right in assum. ing that the property discovered by F. (the supposed fortunate purchaser) after his purchase, is treasuretrove, the owner (it known) would be entitled to recover it by action; if no owner is found or known, then the property belongs to the Crown, and F. will be liable to an indictment for not discovering it. Now if M. were living, he or she would be the owner, and his or her title having passed under the judgment and execution to the judgment-creditor, he will be the owner and entitled to sue F. for the recovery of the treasure. I can cite no direct authority for this right of action, therefore I have been somewhat elementary in stating the grounds upon which I form my opinion, which " Article" must please accept JAMES BELL. quan, val. Blackburn, 8th Nov. 1869. (Q. 13.) WILLS AND BEQUESTS.-It seems clear that E. F. can take, and in order thereto, the confirmation by codicil was unnecessary. The wife or husband, whose leracy is made void under the 1 Vict. c. 26, s. 15, must have stood in that relation at the time of the Z. Y. attestation: (See Hayes and Jarman's Concise Forms Mr. Collisson, Mr. Kelly, Mr. Nisbet, Mr. Roberts, of Wills, 7th edit. p. 29, in noits.) Mr. S. Smith, Mr. Thomas, Mr. Walker, Mr. Whyte, Mr. Wynne, and Mr. Boodle (Secretary), the following grants were made, viz., 201. to the son of a deceased member, who, from serious illness is unable to follow his Profession; 101. to the daughter of a deceased member; and 10l. to the daughter of a deceased non-member. - I think there can be no doubt that the fact of an attesting witness to a will marrying a legatee subsequently to the date of the will does not affect the legacy or bequest. The 24th section of 7 Will. 4, and 1 Vict. c. 26, enacts that every will shall be construed with reference to the real and personal estate comprised immediately before the death of the testator, unless a in it, to speak and take effect as if it had been executed contrary intention shall appear. The operation of the section is restricted to the property given by the will; as to the persons to whom it is given, the rules of construction, existing before the passing of the Act, are not altered, and, before the passing of the Act, it was settled that anything occurring to affect the credibility of a witness subsequently to the date of the attestation would not invalidate the will: (Sweet's Introduction to the Statute, A.D. 1837.) The legacy or bequest given by the will to E. F. was not given to an attesting witness, or to the wife or husband of one, and it would seem a reductio ad absurdam, to contend that the subsequent marriage of a legatee with an attesting witness would, perforce of the 15th section, render the gift or legacy void. If the legacy is void because of C. D.'s marriage with E. F., the codicil, attested by other witnesses, certainly would not make it valid, for the effect of the codicil may be said to be a revival of the execution (so to speak) of the will; and the codicil being executed subsequently to the marriage, it would be more reasonable to contend that the gift or bequest to E. F. is void by reason of the codicil; but as the codicil did not in terms affect E. F., or her interest under the will, it cannot operate so as to affect her or her interest by reason of the enactment of the 15th section, for it has been held that a bequest to a person by will is not voided by that person being witness to a codicil, and the converse (1 Burr. 423; Tempest v. Tempest, 2 Kay and Jo. 635); there the bequest was to the witness personally, but here the bequest was not to the witness, or to his or her wife or husband within the meaning of the statute. The charges, not such charges only as are usual and reasonable. Z. Y. The 57 Geo. 3, c. 93, fixes the costs and charges to be taken for making a distress for rent under 201.; where the rent claimed exceeds 201., the costs and charges are not fixed or uniform, and are optional, but they must be reasonable. The charges for preparing the warrant of distress, notice, and copies, are, in some places, 13s. 4d.; but in any case, above 201., discretionary, if fair and reasonable. I should consider the following a fair and reasonable scale of costs and charges on a distress for say 401: Instructions for and preparing warrant to levy, notice, and copies (8 L. T. Rep. N. "The standing committee of the Newcastleupon-Tyne and Gateshead Law Society, at this, the forty-third annual general meeting of the society, beg to present the following report of their proceedings since the last annual meeting. "The business in Parliament during the present year's session, having primary reference to the Irish Church question, little opportunity was afforded for the consideration of subjects affecting the legal profession; but the following important Bills more or less occupied the attention of your committee, viz. : "1. The Bankruptcy Bill, and that for the Abolition of Imprisonment for Debt. "2. Mr. Locke King's Real Estate Intestacy Bill. "3. Mr. Norwood's Admiralty Jurisdiction County Court Bill. "4. And one on the same subject proposed by the Liverpool Law Society. "No. 1 was pushed through Parliament in a Bill was disposed of, and little opportunity was somewhat rapid manner, after the Irish Church afforded for deliberation upon the detail, but your committee's suggestions were forwarded to Mr. Headlam and Mr. Joseph Dodds, M.P. "Since the Bill passed, queries have lately been received as to its practical working, so that orders may be framed having regard to the views of the Profession. These queries will require early attention in the ensuing year. "No. 2 (Mr. Locke King's Bill) was referred to Mr. Dees, whose remarks (see minutes of 29th May) will be found worthy of notice. The Bill, however, was withdrawn. "Nos. 3 and 4 engaged considerable attention. The practical experience of Mr. Hodge, and the junior secretary were brought to bear upon the details. An Act was passed by which the juris diction of the County Court was extended to claims arising out of any agreement relating to the use or hire of any ships, or to the carriage of goods, not exceeding 300l., or above that, by consent. "Communications have been received from the Metropolitan and Provincial Law Association, and the Bristol Law Society, as to the propriety of 0 13 4 solicitors accepting the office of Trustee in Bankruptcy, and, upon due consideration, your com mittee came to the conclusion that it would not be inconsistent with the standing of the Profession to do so, upon such terms as might be deemed fit in each particular case. 980 Of course, the solicitor's charges might fairly be increased in special cases, or where the amount of levy is large, or where there has been special trouble. No doubt some other correspondent will supply a scale from actual practice, which will be a useful guide. A note of a modern case upon this subject may not be out of place here: "Where a bailiff distrains for rent by the authority of the landlord, and while in possession the landlord gives notice to the bailiff that the rent is paid, the bailiff has no authority to sell to pay his charges:" (Harding v. Hall, 14 W. R. 646; 14 L. T. Rep. N. S. 410.) There is no analogy between this and the attorney's right (which I shall attempt to show in answering "H.'s" query) to proceed for his costs after a debt is paid. Blackburn, 8th Nov. 1869. JAMES BELL. (Q. 17.) TOLL.Without a knowledge of the provisions of the special Act authorising the creation of the road, an opinion on this question cannot be of much value. It may, however, be stated that, under the General Turnpike Act (3 & 4 Geo. 4, c. 126), s. 41, which imposes penalties for the evasion of tolls, contains a special exception in favour of "the owner or occupier or servant, or one of the family of the owner or occupier" of the land adjoining the turnpike road, through or upon which land, other persons, if they go with intent to evade payment of toll, are made liable to penalties. Z. Y. LAW SOCIETIES. LAW ASSOCIATION. "In consequence of a discussion at a meeting of your committee in April last on the subject of a law university, a suggestion was made that Mr. R. S. Watson should attend a meeting which was convened in London on the subject. Mr. Watson kindly consented, and has taken much interest in the deliberations which then and have since occurred, both personally and by correspondence. It appears that a sub-committee was appointed at the meeting to draw up a Bill, the guidance of which Sir Roundell Palmer was to undertake. The idea was to have a law university which should be an educating as well as an examining institution. Mr. Watson reports that he was impressed with the desirableness of strengthening and developing the existing agencies of legal education in London and the Universities of Oxford and Cambridge, and considered that it would be better to improve and develope those which were already established in preference to starting something new and untried. "Mr. Watson states that his views received considerable confirmation from a visit to Oxford, soon after the London meeting, where he found that additional inducements were held out to the study of law, and that in the library of All Souls' College there was a most interesting collection of foreign law books, and that the colonial statutes formed an important part of the collection. Mr. Watson, however, concluded his remarks by stating that the members of our Profession ought to con which looks to improving the status of the Pro fession by insuring the intellectual proficiency of its members.
