GAS AND ELECTRICITY. AN ORDINANCE to authorize the Middletown Gas, Light and Coke Company to lay pipes for the conveyance of gas through the streets.

SECTION 1. BE IT ORDAINED by the Council of the Incorporated Village of Middletown, Butler County, Ohio:

That the Middletown Gas, Light & Coke Company be and they are hereby authorized to use the streets, lanes, alleys and public grounds of said village for the purpose of laying down pipes for the conveyance of gas in and through said village for the use of said village and its inhabitants.

SECTION 2. That all injuries done to the streets, alleys, sidewalks or other public or private property of said village or to any private property of any citizen or other person or persons by said company, by excavation or otherwise, shall be repaired by said company, with due diligence, and the same shall be left and kept in as good condition as before said injury was done.

SECTION 3. That for and during the period of ten years from and after the passage of this ordinance, the - price of which the said Incorporated Village of Middletown shall require the Middletown Gas, Light & Coke Company to furnish the said Village of Middletown, for the purpose of lighting the streets, public buildings, public offices, and to other consumers in said village, either public or private

shall not exceed four dollars per thousand cubic feet for gas - actually consumed. Provided nothing in this ordinance - shall be so construed as to prevent the council of said vil

lage from contracting with said Middletown Gas, Light & - Coke Company to light any street, lane, alley, market space,

public landing or common or part thereof, to be lighted as aforesaid, during the year 1872 and each and every succeeding year thereafter, during said term of ten years, at a specified price per post and burner; provided that the cost shall not exceed the price hereinbefore fixed.

SECTION 4. If the gas works for manufacturing said gas shall be located within the corporate limits of said Village of Middletown, the council of the said village at

the time said works are being erected, shall have the priviledge of approving the location.

SECTION 5. That all the privileges hereby granted shall be null and void unless the said gas works shall be erected and at least one mile of main pipe be laid within one year from the passage of this ordinance.

SECTION 6. Nothing in this ordinance shall be so taken or construed as to abridge or diminish in any way whatever any powers or privileges conferred on council of said village by Chapter 31 of the municipal code or any section thereof.

SECTION 7. This ordinance to be in force from and after its passage and publication according to law.

Granting to the Middletown Electric Light Company permission, etc.

SECTION 1. BE IT ORDAINED by the Council of the Incorporated Village of Middletown:

That permission be granted to the Middletown Electric Light Company, a corporation under the laws of the State of Ohio, to erect and maintain the necessary number of iron towers, poles, wires, supports and such other fixtures as are necessary to the business of furnishing light by electrical currents, and said village is authorized to contract with said Middletown Electric Light Company for lighting the streets, alleys, avenues, highways and public grounds, within the corporate limits of said village for any period of time according to law.

SECTION 2. This ordinance shall take effect and be in force from and after its passage and publication according to law.

Granting permission to the Middletown Edison Illuminating Company.

SECTION 1. BE IT ORDAINED by the Council of the Incorporated Village of Middletown:

That permission be granted the Middletown Edison Illuminating Company, a corporation incorporated under the general laws of the State of Ohio, to erect poles and conductors of cedar, chestnut or iron poles to be at least twenty-five feet high and painted, and to maintain and support wires and other fixtures, in, through and under the streets, alleys and public grounds in a manner not to interfere with other wires, poles, public travel and private property.

SECTION 2. This ordinance shall take effect and be in force on and after its passage and publication according to law.

To grant the right-of-way to the Middletown Gas Company to lay down in North Broad Street and in sewer on Second Street an iron water pipe.

SECTION 1. BE IT ORDAINED by the Council of the City of Middletown:

That a right is hereby given and granted to the Middletown Gas Co. to make and excavate a trench or ditch from its works on North Broad Street, southwardly to Second Street, and to connect and enter into the inside of said sewer, westwardly to the river, for the purpose of laying down in said trench an iron pipe, one and one-fourth inches in diameter; and to attach on the inside of said sewer an iron pipe of the said size of one and one-fourth inches to be securely fastened by good, strong iron staples, to the side wall of the sewer, about five feet above the bottom line of the sewer. The said iron piping to be used by the Middletown Gas Company to pass through such pipe the wash-water from its works and shall not be used for any other purpose or use.
