any wagon, dray or other conveyance and thereby impede public travel on any street, alley or public way.

Who deemed guilty of SECTION 4. The person or persons, placing said ma- 5

terial on such street, alley or public way, or loading or unloading any car, and the person in charge of the factory, building or store, occupied by such person, partnership or corporation, shall be deemed guilty of a violation hereof, if such person permits any violation of the first three sections of this ordinance in front of said premises, and the agent of any corporation having charge of the building occupied by such corporation shall be deemed to be the representative of such corporation and liable to prosecution for any violation of this ordinance by the servants, agents or employees of such corporation.

Penalty.

SECTION 5. Any person or persons who shall be found guilty of any violation of this ordinance or part thereof shall on conviction before the Mayor be fined in any sum not less than five dollars nor more than fifty dollars and the costs of prosecution.

SECTION 6. This ordinance shall take effect and be in force from and after its passage and publication according to law.

Unlawful to

vehicles to on streets.

AN ORDINANCE to prevent the obstruction of streets and alleys in the City of Middletown.

SECTION 1. BE IT ORDAINED by the Council of the City of Middletown: allow That it shall be unlawful for the driver, owner or perstand son having the ordering or superintendence of any cart,

dray, wagon, or other vehicle, new or old finished or unfinished, to suffer same to be and remain in any street, alley, . avenue, or other highway within the limits of the City of Middletown, for more than one hour after the same has been placed there; provided, that nothing in this section shall be so construed as to interfere with market wagons

on market days, and evenings previous thereto while at. tending market.

SECTION 2. It shall be unlawful for any person or per- Unlawful to stop vesons to stop any carriage, wagon, dray, buggy, or other hicles at crossings. vehicle, so as to interrupt the crossing at the intersection of any street or alley, in the regular course of the sidewalk, and shall not immediately remove the same on request being made, or shall be absent from such carriage, wagon, or vehicle, if a horse or animal, or team shall be attached thereto, so that such request cannot be made.

SECTION 3. Any person or persons violating the pro- Penalty. visions of the proceding sections, shall, upon conviction thereof before the mayor be fined in any sum not less than twenty-five dollars, and the costs of prosecution.

SECTION 4. All ordinances or parts of ordinances, in conflict with this ordinance, be and the same are hereby repealed, and this ordinance shall take effect and be in force from and after its passage.

VACATION OF STREETS AND ALLEYS.
To vacate Kenton Street and a part of Crane street.

Whereas, on the 11th day of April A. D., 1902 a petition was presented to Council for the vacation of Kenton street and that part of Crane street lying East of an alley running along the east ends of lots 1521 and 1554; and

Whereas, notice of the pendency and prayer of said petition has been given as required by law, and upon hearing the council is satisfied that there is just cause for such vacation, and that the same would not be detrimental to the general interest and should be made.

Therefore, BE IT ORDAINED by the Council of the City of Middletown, Ohio, that Kenton street and that part of Crane street, lying east of any alley running along the

east ends of lots 1521 and 1554 be and the same are hereby vacated, and this ordinance shall take effect and be in force from and after its passage and publication according to law.

To vacate a part of Clinton Street extended.

Whereas, on the 9th day of May, 1902, a petition was presented to Council for the vacation of the southern extremity of Clinton street extended being that portion of said street lying south and west of the main right of way of the Middletown and Cincinnati railroad; and,

Whereas, notice of the pendency and prayer of said. petition has been given as required by law, and upon hearing the Council is satisfied that there is just cause for such vacation, and that the same would not be detrimental to the general interest and should be made.

Therefore BE IT ORDAINED by the Council of the City of Middletown, Ohio, that the above described part of said street be and the same is hereby vacated, and this ordinance shall take effect and be in force from and after its passage and publication according to law.

To vacate an alley between West Alley and Hydraulic Street.

Whereas, on the 9th day of May A. D. 1902 a petition was presented to Council for the vacation of an alley between Hydraulic street on the west and west alley, on the east and lying between lot 43 on the North and lot 46 on the south as said lots are known and designated on the recorded plat of the City of Middletown, Ohio; and,

Whereas, notice of the pendency and prayer of said petition has been given as required by law, and upon hearing the Council is satisfied that there is just cause for such vacation, and that the same would not be detrimental to the general interest, and should be made.

Therefore, BE IT ORDAINED by the Council of the City of Middletown, Ohio, that said alley as above mentioned be and the same is hereby vacated and this ordinance shall take effect and be in force from and after its passage and publication according to law.

To vacate an alley from Fifth street to the north line of lots No. 262 and 263, Middletown, Ohio.

Whereas, a petition was presented to the Council on the 24th day of Oct., 1902, praying for the vacation of an alley from Fifth Street south to the north line of lots No. 262 and 263 as said lots are known and designated on the recorded plat of the City of Middletown, Ohio; and,

Whereas, notice of the pendency and prayer of said petition has been given by publishing the same for six consecutive weeks as provided by law, and

Whereas, the Council is satisfied there is good cause for such vacation, that it will not be detrimental to the general interest, and that the same should be made.

Therefore, BE IT ORDAINED by the Council of the City of Middletown, State of Ohio, that said alley from Fifth street south to the north line of lots No. 262 and 263 ke and the same is hereby vacated.

To vacate an alley in Gunckel and Johnston's Subdivision, running from Grimes Street to Sorg Street between Third Street and Second Street.

Whereas, on the tenth day of Nov. A. D. 1905, a peti. tion by persons owning lots in the immediate vicinity of an alley running from Grimes street to Sorg street between Second and Third streets was duly presented to Council praying that said alley may be vacated, between the points named and notice of the pendency and prayer of said petition has been given as required by law for six consecutive weeks.

And whereas Council upon hearing being satisfied that there is good cause for such vacation as prayed for and it will not be detrimental to the general interest and said vacation ought to be made, Now Therefore,

BE IT ORDAINED by the Council of the City of Middletown, State of Ohio:

SECTION 1. That an alley in Gunckel and Johnson's Subdivision running from Grimes street to Sorg street between Second and Third streets be and the same is hereby vacated.

SECTION 2. This ordinance shall take effect and be in force from and after the earliest period allowed by law.

To vacate an alley running north and south between lots No. 1944 and 2475 in the City of Middletown.

BE IT ORDAINED by the Council of the City of Middletown, State of Ohio:

Whereas, on the eighth day of Dec. 1905 a petition by persons owning lots in the immediate vicinity of an alley running north and south between lots 2475 and 1944 in the City of Middletown was duly presented to Council praying that said alley between the points designated shall be vacated and notice of the pendency and prayer of the petition has been given as required by law by publication in The Daily Signal and The Daily Journal, newspapers of opposite politics, printed and of general circulation in said City, for six consecutive weeks,

And whereas Council upon hearing is satisfied that there is good cause for such vacation as prayed for and that it will not be detrimental to the general interest, and ought to be made.
