SECTION 5. This ordinance shall take effect and be in force from and after its passage.

Granting the right-of-way to the W. B. Oglesby Paper Co., of Middletown, Ohio, to construct, operate and maintain a railroad switch along the west side of Water Street from Second Street to First Street.

BE IT ORDAINED by the City Council of Middletown, Ohio, as follows:

SECTION 1. That the right be and the same is hereby granted to the W. B. Oglesby Paper Co., of Middletown, Ohio, to construct and operate and maintain a railroad switch for steam cars so as to connect the paper mill property of said company with the railroad switch of the Cleveland, Columbus & Indianapolis Railroad Company, now located on Water Street in said city.

Said right-of-way being over and along the following route: Commencing on the east side of Water Street at a point near Second Street between First and Second Streets in said city; thence crossing the race-way of the Hydraulic Company to the west side of Water Street, and thence along the west side of Water Street to First Street, the privileges hereby granted being subject to any and all rights heretofore granted to the Middletown Hydraulic Company of said city.

SECTION 2. The said railroad switch shall be constructed along such grades as may be most convenient and to the satisfaction of the city engineer and the street commissioner of said city.

SECTION 3. Said grant is further subject to the right of the City of Middletown to grant to any other person, persons or corporations, the right to use said railroad switch to reach any mill or manufactory, and the City of Middletown shall have the right to use said railroad switch to reach the water works or pumping station of said city.

SECTION 4. The said W. B. Oglesby Paper Co. shall place planks for a distance of two feet on each side of the rails extending from the east to the west side of that part of Water Street crossed by said switch in such a manner that same may be crossed by teams and vehicles of all kinds, and shall keep same in repair, provided the City Council deem the same necessary.

SECTION 5. The said W. B. Oglesby Paper Co. shall pay all damages that may be caused in any way by the construction or operation of said railroad switch, and shall forever hold the city free and harmless from any claim or claims for damages arising out of the construction, operation and maintenance of said railroad switch.

SECTION 6. This ordinance shall take effect and be in force from and after its passage and publication according to law.

To grant the Wrenn Paper Company the right to construct a switch across Fourth Street at a point west of the Hydraulic Race, in the City of Middletown.

BE IT ORDAINED by the Council of the City of Middletown, State of Ohio:

SECTION 1. That the right be and the same is hereby granted to The Wrenn Paper Company, of Middletown, Ohio, to construct a railroad switch in and along Fourth Street from the property of the Gardner Paper Company across the property of The Hydraulic Company, and thence across and along Fourth Street, west of the hydraulic raceway, substantially as defined on a plat or map of the same filed with the application for such right, and on file in the office of the Board of Public Service of the City of Middletown.

SECTION 2. The said switch track shall be so constructed as not to interfere with public travel in and along said Fourth Street, and the same shall be constructed and the space between the tracks planked or otherwise filled and kept filled, as required by the Board of Public Service of the City of Middletown, and the said track shall be constructed, completed and maintained to the satisfaction of the Board of Public Service of the City of Middletown.

SECTION 3. The said The Wrenn Paper Company shall at all times hold the City of Middletown free and harmless and indemnified against any and all claims for damages of whatever kind arising out of or connected with the construction or maintenance of the said switch.

.SECTION 4. This ordinance shall take effect and be in force from and after its passage and publication according to law.

AN ORDINANCE to grant to William J. Sebald and his assigns the right to construct, operate and maintain a private switch track across a sixteen-foot alley running north and south one hundred and thirty-five feet west of Curtis Avenue.

BE IT ORDAINED by the Council of the City of Middletown, State of Ohio, as follows:

SECTION 1. That the right be and the same is hereby granted to William J. Sebald, his heirs and assigns, to construct, operate and maintain a private switch track across an alley running north and south one hundred and thirtyfive feet west of Curtis Avenue.

SECTION 2. Said private switch track shall be constructed across said alley, from the property of the C. L. & N. Ry, to the property of said William J. Sebald, about one hundred and seventy feet northwardly from Sixth Street, and shall be so constructed as not to interfere with the travel, passage and use of said sixteen-foot alley by the cwners of abutting property or public. '

SECTION 3. Said switch track across said alley shall be planked on each side of the rails of said switch track and between the rails thereof, and shall be constructed under the supervision of and to the satisfaction of the Board of Public Service of the City of Middletown, and the said crossing shall be kept in good repair by the said William J. Sebald to the satisfaction of the Board of Public Service.

SECTION 4. No cars shall be permitted to stand across - said alley, and said crossing shall only be used for the pur- pose of switching cars to the property owned by the said - William J. Sebald.

SECTION 5. The said William J. Sebald shall at all times save the City of Middletown free and harmless from any and all claims for damages arising out of the construction, operation and maintenance of the said switch track.

SECTION 6. This ordinance shall take effect and be in force from and after the earliest period allowed by law.

To grant to The Middletown Electric Light & Power Company the right to extend its railroad switch along the west side of Clinton Street in front of the real estate owned by it.

BE IT ORDAINED by the Council of the City of - Middletown, State of Ohio:

SECTION 1. That the right be and the same is hereby granted to The Middletown Electric & Power Company, its successors and assigns, to erect and maintain in and along the west side of Clinton Street an extension of its railroad switch, in front of lot number 1203, as the same is known and designated on the recorded plat of Middletown, Ohio, being the premises owned by said company, for the purpose of switching cars to its plant and unloading therefrom.

SECTION 2. Said extension of said switch track shall be constructed under the supervision and to the satisfaction of the Board of Public Service of said city, and shall be maintained to the satisfaction of said Board or its successors in office.

SECTION 3. The said The Middletown Electric & Power Company, its successors and assigns, shall at all times save the City of Middletown free and harmless from any and all loss or damage by reason of the construction, operation and maintenance of said railroad switch.

SECTION 4. This ordinance shall take effect and be in force from and after the earliest period allowed by law.

Granting to The Wardlow-Thomas Paper Company the right to construct, operate and maintain a railroad switch across and along an alley running east and west and south of Sixth Street, and from the towing path of the Miami & Erie Canal to a point that would interest the westerly line of the property owned by The Wardlow-Thomas Paper Company.

BE IT ORDAINED by the City Commission of the City of Middletown, State of Ohio:

SECTION 1. That the right be and the same is hereby granted to The Wardlow-Thomas Paper Company, its successors and assigns, the right to construct, operate and maintain a railroad switch across and along an alley running east and west (being the first alley south of Sixth Street) from the towing path of the Miami & Erie Canal, to a point that would interest the westerly line of the property owned by The Wardlow-Thomas Paper Company, under the terms and conditions hereinafter stated.

SECTION 2. The said The Wardlow-Thomas Paper Company shall at all times hold the City of Middletown free and harmless from any claim or claims for damages of any kind whatsoever arising out of the erection, construction and maintenance of said railroad switch, and shall at all times maintain proper planking in said alley-way over said tracks to the satisfaction of the City Commission.

SECTION 3. The said railroad switch shall be constructed substantially along the line shown on a blue print attached to the application of said The Wardlow-Thomas
