the residence, occupation, profession or business of such person, which shall extend more than four feet from the building, and less than seven feet from the pavement, over or into the pavement, shall, on conviction, be fined not more than five dollars or imprisoned not more than ten days, or both.

SECTION 49. Whoever sells at auction upon any of the Selling goods at aucstreets, highways, alleys or sidewalks, within the City of Middletown, any goods, wares, or merchandise, household furniture or other articles or things whatever which has been bought for the purpose of selling again for profit, or interrupts the free and proper use of the sidewalks within the said city, by standing upon or otherwise occupying the same shall, on conviction, be fined not more than twenty dollars or imprisoned not more than twenty days, or both.

PAWN BROKERS. To regulate pawn brokers and to fix the amount of license of the same.

SECTION 1. BE IT ORDAINED by the Council of the City of Middletown:

That no person shall carry on or conduct the business or calling of pawn broker, or of loaning money on personal property in the City of Middletown, without having obtained from the Mayor of the city a license so to do .

SECTION 2. Whoever loans money on the deposit or pledge of personal property, or who purchases personal property or choses in action, on condition of selling the same back again at a stipulated price, is hereby defined and declared to be a pawnbroker.

Amount of license.

SECTION 3. The Mayor of the City of Middletown may grant a pawnbroker's license to any person of good moral character, who may apply therefore, when the applicant pays into the treasury of the corporation the sum of twentyfive dollars, and executes a bond, with surety to the satisfaction of the Mayor of the City of Middletown, in the sum of five hundred dollars, that the applicant will conform to the requirements of the law and all ordinances of the corporation, and said license shall be good for one year.

SECTION 4. The person so licensed shall keep a correct list and description, in a book for that purpose, of every

the article pledged or deposited with him, or upon which ad

vances of money have been made, or which may be purchased by him, which list and description shall be at all times opened to the inspection of the chief or superintendent of police of the corporation, or of a police officer ,deputed by him or by the Mayor, to make such inspection; and he shall, at all times, when required by any police officer or Mayor aforesaid, produce and show any article so listed and described, which may be in his possession; he shall also register in such book the name and place of residence of the depositor, and time when deposit was made; all the entries shall be written in ink in the English language, and no entry shall be erased, obliterated or defaced.

SECTION 5. Every person so licensed shall prepare and deliver to the Mayor every day, before the hour of twelve Mayor. o'clock, a legible and correct copy from such registry, of the description of all personal property, bonds, notes or other securities received on deposit or purchases during the preceding day, together with the hour at which article was received, together with the description of the person by whom left in pledge, or from whom the same were purchased.

SECTION 7. Penalty.

SECTION 11. A person convicted of a violation of any of the provisions of this ordinance, where no other penalty is provided for, shall be fined not less than ten nor more than two hundred dollars.

SECTION 12. This ordinance shall take effect and be in force from and after its passage.

POLICE DEPARTMENT. AN ORDINANCE fixing the number, salaries and bonds of members of the Police Department in the City of Middletown, State of Ohio.

SECTION 1. That the Police Department of the City of enf Police Middletown, State of Ohio, shall be composed of the follow

ing officers and other members, who shall receive the respective salaries hereinafter provided, payable semi-monthly out of the Police Fund of said city, and shall give the re

SECTION 2. The Police Department, as constituted herein, shall be classified by the Director of Public Safety as required by law.

SECTION 3. This ordinance shall take effect and be in force from and after the earliest period allowed by law, Jan. 1, 1911, but shall not effect the term of office or employment or other members now serving in the Police Department of said city.

To define the duties and to establish the salary and to fix the bond of the Chief of Police of the City of Middletown, Ohio.

BE IT ORDAINED by the City Commission of the City of Middletown, State of Ohio:

SECTION 1. That it is hereby declared to be the duty Duties of Chief of of the Chief of Police to direct all members of the Police Department of said city in their acts and to see that they shall preserve the peace, protect persons and property, and obey and enforce all the ordinances of said city, and all criminal laws of the State of Ohio and of the United States of America; to report his actions and the conduct of the Police Department to the City Commission at all times when called upon to do so, and in all things to observe and obey all lawful orders and directions of said City Commission and of its members; it shall be his duty to do all things required of him by Section seven of Article five of the charter of said city, and such other duties with reference to the Municipal Court as may from time to time be required of him by the City Commission.
