accessible for the purposes of collection of the garbage therein, and they shall not be kept upon the street, alleys, sidewalks or other public place; such tank or vessel shall be of a capacity not less than ten (10) gallons. SECTION 6. And person, firm or corporation found guilty of any violation of any of the provisions of this ordinance shall be fined in any sum not more than fifty dollars, to be collected as other fines are collected and paid into the city treasury to the credit of the general fund.

SECTION 7. Any ordinance or part or parts of ordinances in conflict with any of the provisions of this ordinance be and the same are hereby repealed.

Duty of Health

SECTION 8. That it shall be and is hereby declared to be the duty of the health officer employed by the Board of Health of said city to take charge and oversight of the en. forcement of this ordinance, and to carry the provisions thereof into effect and operation.

an emergency ordinance and necessary for the proper preservation of the public health, and shall be in force and effect from and after passage.

SECTION 1. BE IT ORDAINED by the Council of the City of Middletown:

That it shall be unlawful for any person or persons to in any way defile or pollute water in the well or pipes oi the water works in said city.

SECTION 2. That no person shall construct a privyvault, or use the same within the territory north of the center line of First Street, and west of the Erie and Miami Canal, unless the same shall be built with walls of brick or stone, not less than eight inches thick, laid with a full joint of cement mortar and plastered inside, and when completed the same shall be perfectly water tight.

SECTION 3. It shall be unlawful for any person to mar, deface or break or otherwise injure any of the buildings,

machinery, pipes, hydrants, valves or other fixtures appurtenant or belonging to the water works of said city, or in any manner disable or obstruct said works, or attempt to disable or obstruct the same, for fire or domestic service.

AN ORDINANCE prohibiting the hauling of any gravel, stone, sand, dirt, offal, garbage, manure, rubbish, lime or other loose material or substances over or through any of the streets of the City of Middletown in any wagon or other vehicle which is not so constructed as to prevent the material with which it may be loaded from dropping, sifting through or in any manner being strewn upon any of said streets.

BE IT ORDAINED by the Council of the City of Middletown, State of Ohio:

SECTION 1. SECTION 2. Any person violating any of the provisions of this ordinance shall, upon conviction thereof, be fined not more than twenty-five dollars ($25.00) or less than five ($5.00) dollars for each offense.

SECTION 3. This ordinance shall take effect and be in force from and after the earliest period allowed by law.

RULES AND REGULATIONS OF THE

BOARD OF HEALTH.

SECTION 10. Physicians and midwives shall report to the Board of Health all births in the City of Middletown, at which they have assisted professionally, on or before the first day of the month next succeeding that in which the birth may have taken place.

Burial permit.

BURIALS. SECTION 11. No person shall convey a corpse to or from the City of Middletown without a permit from the health officer. Any person violating the above section shall, upon conviction thereof, be fined in any sum not exceeding fifty (50) dollars.

SECTION 12. It shall be the duty of every undertaker, nits Health or any other person about to remove any corpse for burial, Board regulations. to obtain from the Board of Health a permit to do so; and

before obtaining such permit, he shall deposit with the health officer a certificate setting forth as nearly as possible the name, age, sex, nativity, color and occupation; whether married or single, number and street of late residence, (and when a non-resident, place of previous residence), cause and date of death, duration of last illness, and the place and date of intended interment, which certificate shall be signed by the physician or surgeon in attendance at the time of death; in case no physician or surgeon was in attendance, then the certificate shall be signed by some relative or attendant, and all certificates necessary to complete a proper death return, whether signed by physi

cians, surgeons, undertakers, or other persons, shall be plainly and legibly written with ink. In case a coroner's inquest shall be held, that fact shall be stated. If any such physician, surgeon, relative or attendant refuse to sign such certificate, such undertaker or other person shall report the same to the health officer, who shall forthwith investigate the case.

SECTION 13. When complaint is made, or a reasonable Board may visit any

affected place. belief exists that an infectious or contagious disease prevails in any locality or house, the Board may visit such locality or house, make all necessary investigations by inspection, and discovering that such infectious or contagious diseases exist, send the person so diseased to the pest-house or hospital.

SECTION 14. The owner or agent of a house in which Duty of physicians a person resides who has the smallpox or any other disease dangerous to the public health, and the physician called to attend the person so affected, shall, within twenty-four (24) hours after becoming cognizant of the fact, give notice thereof to the Board of Health, and when a person so affected is removed to a pest-house or hospital, the Board is empowered to use all necessary means to restrain him of his liberty until the danger of infection or contagion from such disease ceases. Any person who fails to comply with any of the provisions of the preceding section shall pay a fine upon conviction thereof not exceeding fifty (50) dollars.

SECTION 15. A person removed to a pest-house or Punishment. hospital who willfully leaves or escapes therefrom before the physician in attendance issues a certificate of restored health, shall, upon conviction, be fined not less than five (5) dollars, nor more than fifty (50) dollars.
