To regulate the price which the Ohio Fuel Supply Company, its successors or assigns may charge for natural gas for and during the ensuing ten years in the City of Middletown, State of Ohio.

BE IT ORDAINED by the Council of the City of Middletown, State of Ohio:

SECTION 1. That during the period of ten years from and after the passage of this ordinance and its acceptance by The Ohio Fuel Supply Company, said company, its successors and assigns may charge for natural gas furnished to the said City of Middletown and to the citizens and private consumers thereof at the rate of forty cents per thousand cubic feet, making a net rate of thirty cents per thousand cubic feet if paid at the company's office in said city on or before the tenth day of the month following that in which the natural gas has been consumed; but said The Ohio Fuel Supply Company, its successors or assigns shall in no event during said term of ten years charge for natural gas so furnished more than the prices herein specified.

Provided, however, that in case the quality of the gas furnished shall in any month for an aggregate period of seventy-two hours fall below the standard of eight hundred British thermal units to the cubic foot (to be ascertained by the inspector of gas or other officer or agent appointed by the Board of Public Service for that purpose). Then the bills of consumers of natural gas furnished during said month shall be discounted ten per cent from the net price or rate hereinbefore provided, and if said time that such natural gas shall fall below the standard herein fixed for a longer period than seventy-two hours an additional discount of ten per cent for each seventy-two hours shall be made from said bills for each additional seventy-two hours or part thereof that the same shall fall below said standard.

SECTION 2. This ordinance shall be and remain in - full force from and after its passage and publication ac

cording to law and its acceptance by The Ohio Fuel Supply Company, its successors or assigns, as herein provided.

To regulate the price which The Middletown Gas. and Electric Light Company may charge for artificial gas for and during the ensuing ten years in the City of Middletown, State of Ohio.

BE IT ORDAINED by the Council of the City of - Middletown, State of Ohio:

SECTION 1. That during the period of ten years from and after the passage of this ordinance, its acceptance by The Middletown Gas and Electric Light Company and the publication of said ordinance as provided by law, said company, its successors and assigns may charge for artificial gas furnished to the City of Middletown and to the citizens and private consumers thereof, the following prices:

At the rate of one dollar per thousand cubic feet for all consumers of one thousand cubic feet or more per month.

At the rate of $1.50 per thousand cubic feet for all consumers of less than one thousand cubic feet per month.

A discount of ten cents a thousand cubic feet to be allowed if bills are paid by the tenth of each month for gas consumed during the preceding month.

A minimum price of twenty-five cents per month will be charged to all consumers where monthly bills do not amount to twenty-five cents at the current rate, for any one month.

The said The Middletown Gas & Electric Light Company, its successors or assigns shall in no event during said term of ten years charge for artificial gas so furnished more than the prices herein specified.

SECTION 2. This ordinance shall take effect and be in force from and after its acceptance by said The Middletown Gas & Electric Light Company, and its publication as required by law.

AN ORDINANCE to grant a franchise unto the Middletown Gas and Electric Light Company, to construct, operate and maintain a system of conduits in and through the streets, lanes, alleys and public places of the City of Middletown, Ohio, and to prescribe the terms and conditions of such grant.

BE IT ORDAINED by the Council of the City of Middletown, State of Ohio:

SECTION 1. That the right be and the same is hereby granted unto The Middletown Gas and Electric Company to construct, operate and maintain wires in conduits underground for conducting electricity for light, heat and power purposes through the streets, alleys, lanes and public places of the City of Middletown, Ohio, by the construction of the necessary conduits or underground pipes for the wires for the period of twenty-five years from and after the passage of this ordinance, under the terms and conditions herein contained.

SECTION 2. For the purpose of enabling said company to convey said electric current under ground, the right is hereby granted to the said company to construct in and along the public streets and alleys under the surface thereof underground conduits or pipes, in which to place and maintain electric cables, wires and other conductors, together with the necessary manholes, junction boxes, connection boxes, feeders, pipes and connections to and from such subways and conduits and all the necessary fixtures and appliances for the placing and safely carrying electricity or electrical conductors beneath the surface of said streets, alleys and public ways.

SECTION 3. For the purpose of constructing said conduits or subways, the said company is hereby authorized to excavate or dig into any street, alley or public way under the terms and conditions herein set forth.

SECTION 4. Before digging into or opening the surface of any street, alley or public way, application shall be made to the Director of Public Service or his successor in office, or any other board or officer lawfully having charge of the streets, alleys and public ways of the City of Middletown, Ohio. Said application shall contain a statement where the excavation shall begin and the length thereof, the name of the street or alley to be cut into or excavated for that purpose, the kind and character of the conduit to be constructed, and a map or plat showing the place and depth of such proposed conduit, and all of which work shall be done to the full and complete satisfaction of the Director of Public Service of said city or his successor in office, or any other board or officer lawfully having charge of the streets, alleys and public ways of said city.

SECTION 5. If any street or alley permanently paved shall be cut into, the pavement of such street shall be fully and promptly restored to as good condition as the same was prior to making such excavation therein, and to the full and complete satisfaction of the Director of Public Service or his successor in office, or any other board or cfficer lawfully having charge of the streets and alleys of said city.

The said company shall pay the actual costs and expenses of an inspector employed for the purpose of inspecting the restoration of any such street or alley, upon the presentation of a bill for the same.

SECTION 6. On all other streets, the surface of the same shall be promptly restored to as good condition as it was prior to making such excavation therein, in accordance with the directions and to the full and complete satisfaction of the Director of Public Service or his successor in office or any other board or officer lawfully having charge of the streets and alleys of said city.

SECTION 7. 'All conduits shall be constructed and maintained as not to interfere with the public or private sewers in and along any street or alley or interfere with the public or private water mains in any street or alley, or interfere with the conduits or underground ways of any telephone or telegraph company in any such street or alley, and so as not to interfere with the gas mains in any street or alley.

SECTION 8. The said company shall promptly restore the sidewalk, curb, gutter or any other work in any street or alley to the same condition as they were before being cut into by said company for the purpose of constructing its conduits, and if the same is not done within five days after notice so to do, the said city may have the same done at the costs and expenses of the said company.

SECTION 9. The said company shall furnish to the said City of Middletown a complete map or plan showing the location of all conduits to be constructed by it and whenever any new conduits are constructed the said map or place shall be amended to show such new construction.

SECTION 10. The said company shall at all times hold the City of Middletown free and harmless from any and all loss or damage that may occur or arise. out of the construction, operation and maintenance of said electric light and power system.

SECTION 11. Before commencing any work under this grant, the said company shall file with the City Auditor a bond in the sum of five thousand dollars ($5,000.00) with sureties to the satisfaction of the Council of the City of Middletown, conditioned that it will faithfully comply with each and every provision of this ordinance relating to the restoration of streets, alleys, sidewalks, curbs, gutters and other property of the City of Middletown, to the payment of all the expenses of inspectors appointed by the city and to protect the city from loss, and said bond shall be for the term of twenty-five years.

SECTION 12. The said company shall at all times faithfully comply with all the laws of the State of Ohio
