On motion of Mr. Griffin, C. H. Walker was appointed Assistant Clerk, pro tempore.

Mr. Parmelee moved that the house proceed to the election of a committee of five, on credentials;

Which was agreed to.

Messrs. Hunt, McCartney, Griffin, Crow and Seybolt, having been put in in nomination;

On motion of Mr. Parmelee they were declared to be elected.

Mr. Griffin moved that the House take a recess of twenty minutes;
Which was agreed to.

Mr. Griffin, from the Committee on Credentials, submitted the following report.

The Committee on Credentials of the several members of House have had the same under consideration, and instruct me to report that they have found the following named persons elected to seats in the House:

On motion of Mr. Stewart, the report was adopted and the committee discharged from the further consideration of the subject.

Mr. McLennan moved that the Clerk appoint a committee of three to wait upon the Secretary of State, Hon. Thomas P. Kennard, and request him to administer the oath of office to the members;

Which was agreed to, and

Messrs. McLennan, Smith and Tisdel were so appointed, when the Secretary appeared within the bar and duly administered the oath of office to the members; which was signed by them, as follows, viz:

We and each of us do solemnly swear that we will support the Constitution of the United States and the Constitution of the State of Nebraska, and faithfully discharge the duties of the office of Representatives to the Legislature, to the best of our ability; so help us God.

Which was agreed to.

Mr. Griffin moved that the House proceed to the election of Speaker; Which was agreed to.

Mr. Church nominated Wm. McLennan.

Those who voted for Mr. McLennan were Messrs. Barnard, Blakely, Brewer, Brewster, Brush, Chase, Church, Crow, Evans, Fitchie, Fox, Furay, Gardner, Griffin, Hagood, Hoile, Hunt, Jones, Loveland, McCartney, McKinnon, Naffziger, Parmelee, Parish, Rathmann, Rhodes, Seybolt, Shook, Smith, Speice, Steinman, Stewart, Stout, Talbot, Tisdel, Tullis and Zimmerer-38.

On motion of Mr. McKennon, Mr. McLennan was excused from voting. Mr. McLennan having received all the votes given, was declared unanimously elected.

Mr. Griffin moved that a committee of two be appointed to conduct the Speaker to the chair;

Which was agreed to, and

Messrs. Griffin and Seybolt were appointed said committee.

Mr. Stewart moved that the House proceed to elect a Chief Clerk;
Which was agreed to.

Mr. Stewart nominated John S. Bowen.

Those who voted for Mr. Bowen were Messrs. Barnard, Blakely, Brewer, Brewster, Brush, Chase, Church, Crow, Evans, Fitchie, Fox, Furay, Gardner, Griffin, Hagood, Hoile, Hunt, Jones, Loveland, McCartney, McCaig, McKinnon, Naffziger, Parmelee, Parrish, Rathmann, Rhodes, Seybolt, Shook, Smith, Speice, Steinman, Stewart, Stout, Talbot, Tisdel, Tullis, Zimmerer and Mr. Speaker-39.

Mr. Bowen, having received the whole number of votes cast, was declared unanimously elected.

Mr. McCartney moved to proceed to elect an Assistant Clerk;

Which was agreed to.
