Ordered, That the Clerk deliver said bill to the Assembly and request their concurrence therein.

The Assembly bill (No. 675, Rec. No. 254) entitled "An act to amend the Tax Law, in relation to fees of collector on returned taxes in Herkimer county," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

The Assembly bill (No. 359, Senate Reprint No. 1072, Rec. No. 129) entitled "An act to amend the Town Law, in relation to application of certain provisions to Livingston county," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

The Senate bill (No. 646, Int. No. 227) entitled "An act to repeal article one-a of the Military Law and to amend the Education Law, in relation to military training and the Military Training Commission, and to abolish such comission," having been announced for third reading, Mr. Mullan moved that said bill be recommitted to the committee on military affairs, with instructions to said committee to amend and report the same forthwith, to be reprinted as amended and restored to its place in the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Swift, from the committee on military affairs, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

The Senate bill (No. 1379, Int. No. 597) entitled to amend the Code of Criminal Procedure, in relation to professional and corporate bondsmen," having been announced for third reading, Mr. Cotillo moved that said bill be recommitted to the committee on codes.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Boylan offered a resolution, in the words following: Whereas, In the death of James Cardinal Gibbons, the church has lost a distinguished leader, the nation a staunch and inspiring patriot and humanity a kindly and helpful friend.

Be it Resolved, That when the Legislature adjourns this evening, it do so out of respect to the memory of Cardinal Gillbons,

and as a mark of appreciation of the loss which his death entails to the people of the State, and of the nation.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative by a rising

vote.

Mr. Walker moved that the committee of the whole be discharged from the consideration of Senate bill (No. 850, Int. No. 766) entitled "An act to amend chapter four of the Laws of eighteen hundred and ninety-one, entitled 'An act to provide for rapid transit railways in cities of over one million inhabitants,' with reference to payments for work done and the method of enforcement thereof," and that the said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Pitcher moved that the committee of the whole be discharged from the consideration of Senate bill (No. 1177, Int. No. 550) entitled "An act to amend the Conservation Law, in relation to the regulation of the flow of rivers and streams by reservoirs," and that the said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Towner moved that the committee of the whole be discharged from the consideration of Senate bill (No. 775, Int. No. 703) entitled "An act to amend the Insurance Law, in relation to limitation of expenses of domestic life insurance corporations," and that the said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Simpson moved that the committee of the whole be discharged from the consideration of Senate bill (No. 413, Int. No. 393) entitled "An act authorizing the Public Service Commission of the first district to permit the Nassau Electric Railroad Company to operate its cars without exchanging transfers with connecting lines, notwithstanding the provisions of any charter,

franchise agreement of statute," and that the said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question. whether the Senate would agree to said motion, and it was decided in the affirmative.

The Assembly returned the Senate bill (No. 472, Int. No. 142) entitled "An act to amend the Tax Law, in relation to exemption from taxation."

Also, Senate bill (No. 131, Int. No. 129) entitled "An act to amend chapter three hundred and four of the Laws of nineteen hundred and nineteen, entitled 'An act to create the board of equalization for the county of Erie for the equalization of taxes and assessments, and to define its powers and duties,' in relation to the compensation of the commissioners of equalization," with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said bills to the Governor. The Assembly returned the Senate bill (No. 266, Assembly Reprint No. 1366, Int. No. 256) entitled "An act authorizing the board of trustees of the village of Bath, Steuben county, to use certain moneys, the proceeds of the sale of village hall bonds, for the payment of bonds of the village, and providing for the levy and collection of taxes for the payment of the balance of such bonds and to reimburse such village hall fund."

Ordered, That the Clerk deliver said bill to the Governor.

The Senate bill (No. 497, Int. No. 112) entitled "An act to amend the Greater New York charter, in relation to temporary transfer of employees," was returned by the mayor of the city of New York, with a certificate that a public hearing has been duly held on said bill in pursuance of law, and that the mayor and local legislative body have duly accepted the same.

Ordered, That the Clerk deliver said bill to the Governor.

The Senate bill (No. 371, Int. No. 355) entitled "An act to amend the Greater New York charter, in relation to devolving upon the commissioner of plant and structures powers and duties of the president of the borough of Manhattan relating to certain viaducts," was returned by the mayor of the city of New York, with a certificate that a public hearing has been duly held

on said bill in pursuance of law, and that the mayor and local legislative body have duly accepted the same.

Ordered, That the Clerk deliver said bill to the Governor.

The Senate (No. 393, Int. No. 373) entitled "An act to amend the charter of the city of Buffalo, in relation to members of the police and fire departments of said city," was returned by the mayor of the city of Buffalo, with a certificate that a public hearing has been duly held on said bill in pursuance of law, and that the mayor and local legislative body have duly accepted the same. Ordered, That the Clerk deliver said bill to the Governor. Mr. Lusk moved that the Senate do now adjourn.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Whereupon the Senate adjourned out of respect to the memory of the late Cardinal Gibbons.

The journal of yesterday was read and approved.

Mr. Ames introduced a bill (Int. No. 1166) entitled "An act making an appropriation for the completion of the improvement of Chadakoin river, known as Chautauqua lake outlet, as provided by chapter seven hundred and fifty-eight of the Laws of nineteen hundred and thirteen," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on finance.

Mr. Harris introduced a bill (Int. No. 1167) entitled "An act to amend the Real Property Law, in relation to the survey, map or plan to be filed in an action to register title to real property," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

Mr. Lusk introduced a bill (Int. No. 1168) entitled "An act to amend chapter four hundred and three of the Laws of nine
