CHAPTER 161.

AN ACT for the benefit of H. P. Bozarth, late sheriff of Grayson county, and his sureties.

WHEREAS, From information received it is supposed that a sale of the property of H. P. Bozarth, late sheriff of Grayson county, and his suretics, for the payment of the revenue due by said sheriff for the year 1860, took place on the 23d day of September, 1861, before the general act for the benefit of sheriffs, passed at the present session of the General Assembly, took effect; therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That said late sheriff and his sureties shall be entitled to all the benefits of said general act, as well for the sum made by sale under execution as to any balance due by said sheriff, as though no sale of their property, or of the property of either of them, had been made: Provided, however, That as to the amount made by the sale aforesaid, the purchaser or purchasers of the property under said sale shall see proper to relinquish his or their title and claim to the property acquired by virtue of such sale and pur

chase.

§ 2. This act shall take effect from and after its passage. Approved October 3, 1861.

CHAPTER 163.

AN ACT for the benefit of the sheriff of Livingston county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That R. S. Boyd, sheriff of Livingston county, shall be allowed until the first day of March next, in which to collect the county levy for the year 1861, in said county, and to return his delinquent list in the collection of said levy: Provided, The sureties of said sheriff, in his official bond, shall first give their written consent, in the county. court of Livingston county, that the said sheriff may avail himself of the benefit of this act.

§ 2. This act shall take effect from and after its passage. Approved October 3, 1861.

CHAPTER 165.

AN ACT for the benefit of James R. Garland and his deputies, late sheriffs of
Lewis county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That James R. Garland and his deputies, late sheriffs of Lewis county, be, and they are hereby, allowed the further time of two years, from and after the passage of this act, to collect all taxes and fee bills now in their hands: Provided, That the said sheriff and his deputies shall be responsible to any party aggrieved, for any illegal distress or other misconduct under privileges granted by this act.

§2. This act to be in effect from and after its passage. Approved October 3, 1861.

CHAPTER 166.

AN ACT for the benefit of the Shelbyville and Taylorsville turnpike road company.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That it shall and may be lawful for the Shelbyville and Taylorsville turnpike road company, so soon as they grade their road from its present terminus to Campbell's Cross Roads, and prepare the same for receiving the metal, to receive and collect, at their present gate, tolls equal to the tolls of a gate and a half.

CHAPTER 167.

AN ACT in relation to the trustee of the jury fund for the counties of Bath and Daviess.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall not be lawful for the clerk of the circuit or county courts of the counties of Bath and Daviess, to hold or exercise the office of trustee of the jury fund. § 2. This act to take effect from and after its passage. Approved October 3, 1861.

CHAPTER 168.

AN ACT for the benefit of John C. Burks, guardian for the heirs of Joseph
Ewing, deceased.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That John C. Burks, guardian for the infant heirs of When settle Joseph Ewing, deceased, may hereafter settle his accounts as guardian, in the Boyd county court; but before any such settlement is made, the guardian shall procure copies of the inventories of his wards' estate, filed in the Greenup county court clerk's office, and also copies of any settlements made by him, as guardian, with the Greenup county court; upon County court the filing of said copies in the clerk's office of the Boyd county court, the said court shall have jurisdiction to settle the accounts of said guardian.

CHAPTER 169.

AN ACT supplemental to the act, entitled "An act for the benefit of R. P. Sanders, late sheriff of Taylor county, and his sureties; and for the benefit of the sheriff of Madison county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That R. P. Sanders, late sheriff of Taylor county, and his sureties, shall not be entitled to the benefit of the act passed at the present General Assembly releasing them from the payment of the judgment for damages obtained against them in the Franklin circuit court, recited in said act, unless the said sheriff and his sureties shall fully secure the treasury the amount of the judgment against them in the Franklin circuit court, for the revenue of Taylar county, by replevying and promptly paying, when due, one half of said judgment, including interest and costs, in six months, and the other half in twelve months from the time this act takes effect, in the manner prescribed by the general act passed at the present session of the General Assembly, for the benefit of the several sheriffs and their sureties.

§ 2. This act shall take effect from and after its passage. Approved October 3, 1861.

CHAPTER 172.

AN ACT to define magistrates' districts and regulate election precincts, in
Franklin county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the boundary of district No. 1, in Franklin county, be established as follows, to-wit: Beginning at the mouth of Z. Lewis' branch, on Kentucky river; thence up said branch to the Franklin and Owen turnpike road; thence with said road to the Steadman's mill road, between H. Giltner and Charles O'Hara; thence with said road to Mount Pleasant meeting-house; thence with the road leading from said meeting-house to the Georgetown turnpike, near R. C. Anderson's pond; thence with said Georgetown turnpike to the intersection of the same with the Versailles turnpike; thence with the Versailles turnpike to the Woodford county line; thence with the same to the Kentucky river, and with the river to Cardwell's ferry; thence crossing the river to John Cardwell's, and with the ferry road to the Lawrenceburg turnpike, at the foot of Crockett's hill; thence up said turnpike to the road near Tap. Farmer's slaughter-house; thence with said road to where it intersects the old dirt road leading to Lawrenceburg, near Thomas Middleton's; thence with said. dirt road to the Louisville turnpike, at W. Stevens'; thence with the turnpike to the farm formerly owned by Ro. Hambleton, including it; thence to White's branch, and down the same to South Benson; thence down the same to main Benson; thence a line to include the residence of T. G. Doolin, on the old New Castle road; thence with said road to the county bridge on Benson, and down the same to Buzzard Roost; thence a line to include the lands formerly owned by P. Major, to Stoney creek road, and with said road to Stoney creek, at the mouth of Daviess' branch; thence up said branch to include Daniel Smith's farm; thence down a drain from said Smith's farm to Kentucky river; thence down the river to the beginning. Said district is hereby divided into two voting precincts, as follows: all that part of said district north of the old Newcastle road, Montgomery street, in Frankfort, and the Versailles turnpike road, shall constitute one precinct, and the voting place shall be at the market-house in Frankfort; and all that part of said district south of said roads and street, shall constitute another precinct, and the voting place shall be at the court-house in Frankfort.

§ 2. The boundary of district No. 2 shall be as follows: Beginning at the mouth of II. Giltner's lane, near the residence of H. B. Innis; thence to Elkhorn creek, and down the same to the mouth of Clark's branch; thence up said branch to the main forks; thence up the left hand fork

thereof, including R. C. Gayle; thence to the head of the
Rocky branch; thence to include the residence of Mrs.
Catherine Gayle; thence to the tan-yard owned by J. A.
Carter, including said Carter and
Hukle; thence
down the branch from said tan-yard to the Cincinnati
road, at R. B. Sebree's; thence with said road to Scott
county line, and with the same to the Woodford county
line, and with the same to the Versailles turnpike;
thence with the line of district No. 1 to the beginning.
The voting place in said district to be at the Forks of Elk-
horn.

§3. The boundary of district No. 3 shall be as follows: Beginning at the mouth of Z. Lewis' branch, on Kentucky river; thence down the river to the Owen county line, and with the same to the Scott county line, and with said line to the line of district No. 2; and thence with the lines of districts Nos. 1 and 2 to the beginning. The voting place to be at Peak's Mill.

§ 4. The boundary of district No. 4 shall be as follows: Beginning at the Anderson county line, on Kentucky river; thence down the river to Cardwell's ferry; thence with the line of district No. 1 to the residence of T. G. Doolin, on the Newcastle road; thence with said road to Harrison Allison's, including him; thence with the Christiansburg road to the Shelby county line; thence with said line to the Anderson county line, and with the same to the beginning. The voting place in said district to be at Bridgeport.

§ 5. The boundary of district No. 5 is hereby established so as to embrace all that part of Franklin county south of the Kentucky river not embraced by the provisions of this act within the boundaries of districts Nos. 1 and 4; and the voting place in said district shall be at or near where it now is.

§ 6. This act shall take effect from its passage; and all acts, or parts of acts, in conflict with it, are hereby repealed.

CHAPTER 173.

AN ACT to repeal an act, entitled "An act for the benefit of the sheriffs of
Barren and Metcalfe counties."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act for the benefit of the sheriffs of Barren and Metcalfe counties," approved May 24, 1861, be, and the same is hereby, repealed, and that the sheriff of Metcalfe county be, and he is hereby,
