That all laws authorizing the granting of licenses to groceries and coffee-houses, and to merchants to sell spirituous, malt, and vinous liquors, in the town of Monticello, be and the same is hereby repealed, and hereafter it shall not be lawful for any person, within the corporate limits of said town, or within one mile thereof, to sell any spirituous, malt, or vinous liquors, or any mixture thereof, in quantities less than three gallons : Provided however, That merchants in good faith, druggists and apothecaries may any such liquors for medical purposes, in quantities as small as one quart, upon the presentation of a written certificate from a physician in good standing that the same is needed for medical purposes in the family of the applicant, or for himself. Í 2. That any person who shall violate the provisions of the first section of this act shall, upon conviction, be fined fifty dollars, and be imprisoned in the jail of Wayne county, until the fine and costs of prosecution are paid : Provided however, That the imprisonment shall not exceed in. duration the time fixed by law for imprisonment under a capias ad sulisfaciendum. ģ 3. That any person who shall keep a tippling house in said town shall, upon conviction, befined in the sum of two hundred dollars, and imprisoned in said jail the time to be fixed as provided in the second section of this act. § 4. This act to take effect from its passage, and remain in force for two years, at the expiration of which time the laws now in force touching the subjects of this act shall stand revived. That William Herron, late sheriff of Fulton county, shall have credit with the public treasury for the sum of nine hundred and four dollars and ninety-four cents, collected by him on an execution in favor of the Commonwealth oi Kentucky against T. E. Reed, and others, for the revenue due from said county for the year 1859, the same having been paid over by him under duress to A. B. Cole, Captain of Pontotoc Dragoons, No. 1, by the orders of Maj. Gen. Leonidas Polk of the Confederate army. § 2. This act to take effect from and after its passage. Approved March 2, 1863. CHAPTER 970. AN ACT supplemental to the act for the benefit of M. W. Galloway, late sheriff of the county of Graves, approved February 21st, 1863. Be it enacted by the General Assembly of the Commonwealth of Kentucky: $ 1. That where any tax payer in the county of Graves shall have paid his taxes for the year 1860, and shall be unable to produce the sheriff's receipt therefor, in consequence of the same baving been lost or destroyed, the said M. W. Galloway shall not be allowed to distrain for such taxes, if the tax payer, or any one having knowledge of the paynient, shall, before some officer authorized to administer oaths, make affidavit to the payment of said taxes, and the loss of the sheriff's receipt therefor. 82. Sulphur Spring and Manufacturing Company. $1. That an act, entitled, “An act to incorporate the Petroleum Sulphur Spring and Manufacturing Company," approved March 1, 1860, be and the same is hereby amended as follows, to-wit: The capital stock of said company shall be two hundred thousand dollars, and no greater amount of stock shall be issued by the president and directors of said company. 2. This act shall'take effect from its passage. Approved March 2, 1863. CHAPTER 973. Danville, Dix River, and Lancaster Turnpike Road. $ 1. That the county court of Boyle county, a majority of the justices being present and concurring, be and the same is hereby authorized to subscribe, either in stock or by way of donation as the court may think best, such sum of money, for the purpose of repairing the Danville, Dix river, and Lancaster turnpike road; and that said court shall have power to levy a tax upon the people of Boyle county to raise the necessary means to meet such subscription. 82.
