1863. CHAPTER 893. AN ACT to authorize the holding a levy and court of claims in Webster county. Whereas, it is represented to this General Assembly, that in consequence of the presence of Confederate troops in Webster county, no levy court or court of claims was held for the year 1862—therefore, Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That it shall be lawful for the county judge to call and hold a levy and court of claims for Webster county, on the third Monday in March, 1863; and all the acts of said court shall be as legal and valid as if said court had been held at the time prescribed by law. § 2. This act to take effect from its passage. Approved February 26, 1863. CHAPTER 894. AN ACT amendatory to the act incorporating Crab Orchard Seminary. Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That the powers heretofore granted to John Owsley, William Whitly, and others, known by the name and style of "The Proprietors of the Crab Orchard Seminary," under the provisions of an act of the General Assembly, entitled, "An act to incorporate the Crab Orchard Seminary, in Lincoln county," approved February 7th, 1840, shall hereafter vest in the trustees of the town of Crab Orchard, and their successors; and that all the powers granted by said act to the said John Owsley, Wm. Whitley, and others, shall hereafter be exercised by said trus tees of the town of Crab Orchard, with all necessary authority and power, as a corporote body, to carry into ef fect any and all needful rules and regulations for successfully conducting said seminary as an educational institution, which are not inconsistent with the laws and consti. tution of this State, nor those of the United States. § 2. The Legislature reserves the right to change, amend or repeal this charter at pleasure. §3. This act shall be in force from its passage. Approved February 26, 1863. CHAPTER 895. AN ACT to change the line of a magistrates' and constable's district, in Carter county. Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That the line between districts No. 3, and No. 4, in Carter county, be changed so as to embrace the farm of Johnson Garvin and the new residence of James Garvin, Esq., within district No. 4. §2. AN ACT allowing the sheriff of Webster county further time to collect and pay in the revenue and county levy for the year 1862. Whereas, it is represented to this General Assembly, that during the greater portion of the year 1862 confederate forces had possession of Webster county, thereby preventing the sheriff of Webster county from collecting the coun ty levy and revenue taxes, or performing any duties pertaining to his office; and whereas, the said sheriff resigned his office, and the county judge proceeded to make an appointment to fill said vacancy-therefore, Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That the sheriff of Webster county be allowed the further time until the first day of September, 1863, to collect and pay in the revenue and county levy for the year 1862: Provided however, That said sheriff shall not be entitled to the benefits of this act unless his sureties in his bond for the collection of said revenue shall first appear in the Webster county court, and by an order to be made upon its records, consent that said sheriff may accept the benefits of this act, and that they will still continue bound as sure ties aforesaid, as if this act had not been passed. § 2. This act to take effect from and after its passage. Approved February 26, 1863. CHAPTER 897. AN ACT for the benefit of James R. Gordon, of Calloway county. Be it enacted by the General Assembly of the Commonwealth of Kentucky: 1. That the Auditor of Public Accounts be and he is hereby directed to draw his warrant on the treasury in fa 1863. vor of James R. Gordon, for the sum of one hundred and five dollars, payable out of any money in the treasury not otherwise appropriated. § 2. This act to take effect from its passage. Approved February 26, 1863. CHAPTER 898. AN ACT to legalize an election held in Webster county on the 27th of Whereas, it is represented to this General Assembly that in consequence of the disturbed state of the country some of the county officers elect for Webster county refus ed to qualify and enter upon the duties of office, thereupon an election was held on the 27th day of December, 1862, to fill vacancies, and the persons then and there elected did. qualify and enter upon the duties of office; and whereas, doubts exists as to the legality of said election-therefore, Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That the election held in the county of Webster, for county officers, on the 27th day of December, 1862, shall be deemed in all respects legal; and all the acts of offi cers chosen at said election shall be as lawful as if said officers had been elected and qualified at the usual time prescribed by law. § 2. This act to take effect from and after its passage. Approved February 26, 1863. CHAPTER 899. AN ACT for the benefit of F. A. Smith, late sheriff of Hart county. Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That F. A. Smith, late sheriff of Hart county, be and he is allowed until the first day of June, 1863, to make out and report his delinquent list of the State revenue and county levy for said county for the year 1862. §2. This act to take effect from and after its passage. Approved Ferbuary 26, 1863 CHAPTER 900. AN ACT for the benefit of the town of Livermore, in McLean county. Be it enacted by the General Assembly of the Commonwealth of Kentucky: 1. That the "act to extend the corporate limits of the town of Livermore," approved February 17th, 1858, be so amended, that the trustees of said town may procure the extension of the streets and alleys of the original town, and the opening of others through that portion of ground included by said act, by petition to the county court of McLean county; and the proceedings therefor shall be governed by the provisions of article six, chapter 100, of the Revised Statutes. § 2. This act to have effect from its passage. Approved February 26, 1863. 1863. CHAPTER 901. AN ACT to authorize the sale of property at the Market House in Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That in all cases when, by law, the sheriff or commissioner of McCracken county is required to sell property at the court-house door, the sale may be made at the market house in Paducah; and such sale, so made, shall be as valid as if made at the court-house door. §2. This act shall take effect from its passage, and continue in force for two years and no longer. Approved February 26, 1863. CHAPTER 902. AN ACT to amend an act, entitled, an act to incorporate the Eminence Be it enacted by the General Assembly of the Commonwealth of Kentucky: §1. That the 1st section of an act, entitled, an act to incorporate the Eminence female academy, approved March 14th, 1862, be so amended as to read, that the literary institution heretofore established in the town of Eminence, Ky., shall hereafter be known as the Eminence Male and Female Academy. § 2. This act shall take effect from its passage. Approved February 26, 1863. 1863. CHAPTER 903. AN ACT for the benefit of W. R. McFerran, of Barren county. Be it enacted by the General Assembly of the Commonwealth of Kentucky: That the further time of two years, from and after the passage of this act, is given Wm. R. McFarren, late judge of the Barren county and quarterly court, to list and collect his fee bills, subject to all the pains and penalties now imposed by law for issuing and collecting illegal fee bills. Approved February 26, 1863. CHAPTER 904. AN ACT for the benefit of James E. Wright, Clerk of the Logan Be it enacted by the General Assembly of the Commonwealth of Kentucky: § 1. That James E. Wright, clerk of the county court of Logan county, in any future settlement of his accounts with the treasury, shall have credit for the sum of one hundred and ninety-nine dollars and ninety cents, being the amount of public revenue in his hands as clerk, which he was compelled to pay H. E. Read, commissioner of the so-called Provional Government of Kentucky, on the 6th day of January, 1861. 2. This act to take effect from and after its passage. Approved February 26, 1863. CHAPTER 905. AN ACT for the benefit of school district No. 58, in Kenton county. Be it enacted by the General Assembly of the Commonwealth of Kentucky: in § 1. That school district, No. 58, in Kenton county, which a school was taught five months during the year 1862, but irregularly reported by the trustees thereof, be and the same is hereby entitled to report for the past year, and to receive an allowance in common with the regularly reported districts for said year 1862. §2.
